Justice K.T.SANKARAN\n\n Dated :20\/11\/2006\n\n O R D E R\n<\/pre>\n<p>                            K.T.SANKARAN, J<\/p>\n<p>                     &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;\n<\/p>\n<p>                          Crl.R.P.No.3676 of 2006<\/p>\n<p>                     &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;\n<\/p>\n<p>            Dated this the 20th day of November, 2006<\/p>\n<p>                                    ORD<br \/>\n                                           ER<\/p>\n<p>      The   petitioner,   accused   in   C.C.No.327\/2003   on   the   file   of<\/p>\n<p>the court of the Judicial Magistrate of First Class II- Attingal, was<\/p>\n<p>convicted   for   the   offence   under   Section   138   of   the   Negotiable<\/p>\n<p>Instruments   Act.     The   trial   court   sentenced   him   to   undergo<\/p>\n<p>simple imprisonment for  a period of three  months and to pay a<\/p>\n<p>compensation   of   Rs.   53,000\/-   and   in   default   of   payment   of<\/p>\n<p>compensation, to undergo simple imprisonment for 3 weeks.  The<\/p>\n<p>petitioner challenged the conviction  and sentence in  Crl.Appeal<\/p>\n<p>No.397\/2004.     The   appellate   court   allowed   the   appeal   in   part,<\/p>\n<p>confirmed the conviction and modified the sentence, imposing a<\/p>\n<p>sentence   for   imprisonment   till   the   rising   of   the   court.     The<\/p>\n<p>direction   to   pay   compensation   of   Rs.53,000\/-   was   modified   as<\/p>\n<p>compensation   of   Rs.50,000\/-   and   in   default   of   payment,   the<\/p>\n<p>petitioner   was   directed   to   undergo   simple   imprisonment   for   a<\/p>\n<p>period of three months.\n<\/p>\n<p>      2.    The   learned   counsel   for   the   petitioner   submits   that<\/p>\n<p><span class=\"hidden_text\">CRRP3676\/2006                           -2-<\/span><\/p>\n<p>the   petitioner   is   prepared   to   pay   the   compensation.     But   at<\/p>\n<p>present, due to the financial difficulties, he is not able to pay the<\/p>\n<p>compensation   within   a   short   time.     The   counsel   submits   that<\/p>\n<p>three months&#8217; time may be granted to the petitioner  to pay the<\/p>\n<p>compensation amount.  The request is reasonable and, therefore,<\/p>\n<p>it is allowed.\n<\/p>\n<p>       In   the   light   of   what   is   stated   above,   the   conviction   and<\/p>\n<p>sentence   are   confirmed.     However,   the   petitioner   is   granted<\/p>\n<p>three   months&#8217;   time   to   pay   the   compensation   amount.     The<\/p>\n<p>petitioner shall  appear before  the  trial  court on 19th  December,<\/p>\n<p>2006 for undergoing the imprisonment till the rising of the court<\/p>\n<p>and   shall   also   appear   on   such   date   as   may   be   directed   by   the<\/p>\n<p>trial court till the compensation amount is paid.
