Rajesh\n\n    For  respondents   :      Mr.A.Saravanan GA (Crl.side) for R1\n                              Mr. R.Venkatesh for R2\n                       \n                              \n                              \n                              \nO R D E R\n<\/pre>\n<p>      The  first  petitioner and the second respondent   are<\/p>\n<p>husband  and wife whose marriage was held on 27.10.1995  and<\/p>\n<p>they lived together in the first petitioner&#8217;s house and  due<\/p>\n<p>to difference of opinion arose between themselves,  they had<\/p>\n<p>parted  in  March,  2002. Thereafter, the second  respondent<\/p>\n<p>lodged a complaint against the petitioners before the  first<\/p>\n<p>respondent in Crime No.30 of 2004 for the offence punishable<\/p>\n<p>under Sections   498 (A), 506 (i) r\/w 406 IPC and Section  4<\/p>\n<p>of   Dowry   Prohibition  Act.    The  said  complaint   was<\/p>\n<p>registered in C.C.No.1064 of 2005 on the file of the learned<\/p>\n<p>Judicial Magistrate, Alandur against all the petitioners for<\/p>\n<p>the  offence  stated  supra.  The said  case  is  posted  to<\/p>\n<p>03.10.2007.   Before  ever  the  first  petitioner  filed  a<\/p>\n<p>petition for divorce in F.C.O.P.No.2245 of 2004 on the  file<\/p>\n<p>of  the  II  Additional  Family Court,  Chennai.     Pending<\/p>\n<p>F.C.O.P.,  both  the parties desired to  settle  the  matter<\/p>\n<p>between  themselves.   The terms of settlement  between  the<\/p>\n<p>parties are as follows:\n<\/p>\n<blockquote><p>       i)   That  the  parties mutually  agree  to<br \/>\n       live  separately by dissolving the marriage<br \/>\n       held  on  27.10.1995 by filing  a  petition<br \/>\n       for   divorce   by  mutual  consent   under<br \/>\n       Section  13-B  of Hindu Marriage  Act   and<br \/>\n       necessary   miscellaneous   petitions    to<br \/>\n       expedite  the  matter  and\/  or  any  other<br \/>\n       petition to settle the matter amicably  and<br \/>\n       quickly.\n<\/p><\/blockquote>\n<blockquote><p>       ii)   The  I petitioner agrees to  withdraw<br \/>\n       the  divorce OP filed by him in OP  No.2245<br \/>\n       of   2004   and  pending  before   the   II<br \/>\n       Additional Family Court, Chennai.\n<\/p><\/blockquote>\n<blockquote><p>       iii)   Both the minor children will  remain<br \/>\n       in  the  care  and custody  of  the  second<br \/>\n       respondent.  The first petitioner gives  up<br \/>\n       his  visiting rights towards the  children.<br \/>\n       The  first petitioner agrees to pay  a  sum<br \/>\n       of  Rs.1,00,000\/- towards  the  maintenance<br \/>\n       of  the  minor children as full  and  final<br \/>\n       settlement.  The parties agree not to  make<br \/>\n       any  further  claim against each  other  in<br \/>\n       future.   All  their articles are  mutually<br \/>\n       exchanged.\n<\/p><\/blockquote>\n<blockquote><p>       iv.   The petitioners agree to file a quash<br \/>\n       petition  in  the  Hon&#8217;ble  High  Court  of<br \/>\n       Madras  to  quash the criminal case  in  CC<br \/>\n       No.1064\/2005  now  pending  before  the   a<br \/>\n       Judicial  Magistrate Court,  Alandur.   The<br \/>\n       II  respondent agrees to say  no  objection<br \/>\n       for   quashing  CC  No.1064\/2005   in   the<br \/>\n       Hon&#8217;ble  Court  of Madras as  the  offences<br \/>\n       are      non-compoundable.      The      II<br \/>\n       respondent\/de facto complainant  agrees  to<br \/>\n       withdraw any other complaint lodged by  her<br \/>\n       against  the petitioners with any competent<br \/>\n       authority or Court of law.\n<\/p><\/blockquote>\n<blockquote><p>       v.  The  parties have mutually agreed  that<br \/>\n       the   filing  of  mutual  consent   divorce<br \/>\n       petition  and  the steps to  between  taken<br \/>\n       for  quashing  the  criminal  case  in   CC<br \/>\n       No.1064\/2005    have    to     be      done<br \/>\n       simultaneously and to cooperate  with  each<br \/>\n       other  to  settle  the issue  amicably  and<br \/>\n       quickly  without affecting both the parties<br \/>\n       herein  in  any manner in any future  date.<br \/>\n       The  parties  mutually agree  to  move  the<br \/>\n       High  Court to quash the Criminal Complaint<br \/>\n       as the offenes are non-compoundable.&#8221;<\/p><\/blockquote>\n<\/p>\n<p>      5.  Heard  the  learned Government Advocate  (Criminal<\/p>\n<p>Side).\n<\/p>\n<\/p>\n<p>      6.  Learned  counsel for the petitioners would  submit<\/p>\n<p>that when any criminal cases pending between the spouses and<\/p>\n<p>in  case they settle the matter during the pendency  of  the<\/p>\n<p>cases,  the  settled law paves way to allow the  parties  to<\/p>\n<p>compound   non-compoundable  offence  and  in  exercise   of<\/p>\n<p>inherent power, the High Court may quash the proceedings, to<\/p>\n<p>meet  the  ends  of  justice.  The  proposition  of  law  is<\/p>\n<p>illuminatingly  highlighted in the decision of  the  Hon&#8217;ble<\/p>\n<p>Supreme  Court in B.S.Joshi and Others v. State  of  Haryana<\/p>\n<p>and  Another,  2003 Supreme Court Cases (Cri)  848,  in  the<\/p>\n<p>following lines :\n<\/p>\n<\/p>\n<blockquote><p>                &#8220;In  the  present case,  the  wife<br \/>\n         filed  an  affidavit  that  the  FIR  was<br \/>\n         registered   at  her  instance   due   to<br \/>\n         temperamental  differences  and   implied<br \/>\n         imputations.  There may be  many  reasons<br \/>\n         for  not supporting the imputations.   In<br \/>\n         such  eventuality, there would almost  be<br \/>\n         no  chance of conviction.  So,  it  would<br \/>\n         not  be  proper  to decline  to  exercise<br \/>\n         power  of quashing on the ground that  it<br \/>\n         would   be  permitting  the  parties   to<br \/>\n         compound  non-compoundable offences.   It<br \/>\n         would, however, be a different matter  if<br \/>\n         the  High  Court  on facts  declines  the<br \/>\n         prayer   for  quashing  for   any   valid<br \/>\n         reasons  including lack  of  bona  fides.<br \/>\n         Further,  in <a href=\"\/doc\/1738333\/\">Madhavrao Jiwajirao  Scindia<br \/>\n         v.    Sambhajirao   Chandrojirao   Angre,<\/a><br \/>\n         (1988) 1 SCC 692, it was held that  while<br \/>\n         exercising  inherent  power  of  quashing<br \/>\n         under  Section 482, it is  for  the  High<br \/>\n         Court  to  take  into  consideration  any<br \/>\n         special  features  which  appear   in   a<br \/>\n         particular  case to consider  whether  it<br \/>\n         is  expedient  and  in  the  interest  of<br \/>\n         justice   to  permit  a  prosecution   to<br \/>\n         continue.  The special features  in  such<br \/>\n         matrimonial   matters  are  evident.   It<br \/>\n         becomes   the  duty  of  the   court   to<br \/>\n         encourage    genuine    settlements    of<br \/>\n         matrimonial disputes.&#8221;<\/p><\/blockquote>\n<p>          7. In the said judgment, Their Lordships have held<\/p>\n<p>that  if  for  the  purpose  of securing  ends  of  justice,<\/p>\n<p>quashing of FIR becomes necessary, Section 320 Cr.P.C. would<\/p>\n<p>not be a bar to the exercise of power of quashing and merely<\/p>\n<p>because   the  said  provision  enumerates  non-compoundable<\/p>\n<p>offences, the Court cannot decline to exercise the power  of<\/p>\n<p>quashing and that such non-exercise of inherent power  would<\/p>\n<p>prevent women from settling earlier.<\/p>\n<p>           8.  Guided  by the principles formulated  in  the<\/p>\n<p>above  said  ruling  and considering the  special  features,<\/p>\n<p>which  are evident, it is to be held in this case,  being  a<\/p>\n<p>matrimonial  one, that the Court is duty bound to  encourage<\/p>\n<p>genuine  settlement of matrimonial disputes.   If  a  sacred<\/p>\n<p>ceremony of a marriage is affected by some skirmishes, which<\/p>\n<p>arise between the spouses, and re-union is not possible, and<\/p>\n<p>their  relationship is irretrievably strained, in  case  the<\/p>\n<p>Court finds that the compromise entered into between them is<\/p>\n<p>a  genuine one, there is no stumbling block for the Court to<\/p>\n<p>entertain  the same and in order to avoid future heart-burns<\/p>\n<p>between  them  and  take  the own  course  of  life  without<\/p>\n<p>reference to the other after they got separated, it is  just<\/p>\n<p>and  necessary  to  recognise the  settlement  entered  into<\/p>\n<p>between  them.  Declining to entertain such a  request  from<\/p>\n<p>both  the  spouses,  taking  the  hyper-technical  view  and<\/p>\n<p>considering the proviso under Section 320 Cr.P.C., would  be<\/p>\n<p>counter productive.\n<\/p>\n<\/p>\n<p>          9. Under the circumstances and following the dicta<\/p>\n<p>laid  down by the Hon&#8217;ble Apex Court, in order to  meet  the<\/p>\n<p>ends  of justice, the memo of compromise, arrived at between<\/p>\n<p>the  first petitioner and the second respondent, is recorded<\/p>\n<p>and accepted and the proceedings in C.C.No. 1064 of 2005  on<\/p>\n<p>the   file  of  Judicial  Magistrate,  Alandur  are   hereby<\/p>\n<p>quashed.\n<\/p>\n<\/p>\n<p>            10.
