Justice M.N.KRISHNAN\n\n Dated :27\/07\/2007\n\n O R D E R\n                     M.N.KRISHNAN, J.\n               -----------------------------\n                 WP(C)No. 23087 OF 2007 W\n               -----------------------------\n              Dated this the 27th July, 2007.\n\n                         JUDGMENT\n<\/pre>\n<p>    This writ petition is filed seeking to set aside the<\/p>\n<p>order  of  the   learned  Subordinate  Judge,  Manjeri  in<\/p>\n<p>I.A.1273\/06 in O.S.145\/2002.   It was an application filed<\/p>\n<p>by the plaintiff for amendment of the plaint.   A suit was<\/p>\n<p>pending before the Hon&#8217;ble High Court of Madras and during<\/p>\n<p>its pendency a compromise was entered into between the<\/p>\n<p>parties and it is averred that items 210 to 282 of the<\/p>\n<p>plaint schedule property therein was set apart to the share<\/p>\n<p>of the plaintiffs jointly and therefore the plaintiffs are<\/p>\n<p>claiming  right  over  that  property.     They had   given<\/p>\n<p>description of the property in that fashion and when a<\/p>\n<p>commissioner appointed by the court visited the property he<\/p>\n<p>found  that  the  survey  numbers,  description  etc.   are<\/p>\n<p>incorrect and he had plotted the plaint schedule property<\/p>\n<p>as shown by the plaintiffs which takes in a different<\/p>\n<p>survey number, description etc.    Whatever it may be, in<\/p>\n<p>order to succeed in a case of this nature the plaintiff has<\/p>\n<p>to establish that the property now claimed were obtained by<\/p>\n<p>them in pursuance of the decree passed by the High Court of<\/p>\n<p>Madras and until and unless they are able to establish that<\/p>\n<p>the property now incorporated by amendment is the property<\/p>\n<p><span class=\"hidden_text\">WPC 23087\/07                 2<\/span><\/p>\n<p>which they had obtained under the decree, the plaintiff<\/p>\n<p>will  not   be entitled  to  any  decree.    It  has to  be<\/p>\n<p>understood that at a point of time when thousands of acres<\/p>\n<p>of property were involved in a suit and a receiver was<\/p>\n<p>appointed   and  the   receiver  giving  the   schedule  of<\/p>\n<p>properties, naturally there would have been omissions and<\/p>\n<p>commissions.  Therefore that shall not be used as a weapon<\/p>\n<p>to dislodge the case of a party if really the party is<\/p>\n<p>entitled   to the  property  in  law.    Therefore, by  the<\/p>\n<p>amendment   no special right is conferred on the plaintiff<\/p>\n<p>but it is made easier for the court to consider the<\/p>\n<p>question whether the property as amended and incorporated<\/p>\n<p>is obtained by the plaintiff by virtue of the document of<\/p>\n<p>title relied on by them.   So far as adverse possession is<\/p>\n<p>concerned, it is a settled law that there must be an<\/p>\n<p>admission of title of the person against whom adverse<\/p>\n<p>possession is claimed.     I am not going much into the<\/p>\n<p>details because it may prejudice the right of the party at<\/p>\n<p>a later stage.    Therefore, by allowing the amendment no<\/p>\n<p>undue hardship is caused, it will not change the character<\/p>\n<p>of the suit but it is really necessary for resolving the<\/p>\n<p>controversy between the parties.   I make it clear that the<\/p>\n<p>defence in their additional written statement can take all<\/p>\n<p>the  defence   available  including  the  plea  of  adverse<\/p>\n<p><span class=\"hidden_text\">WPC 23087\/07                 3<\/span><\/p>\n<p>possession and limitation and the identity of the property<\/p>\n<p>and the court has to dispose of the matter after permitting<\/p>\n<p>both  sides  to   adduce  evidence  in   support  of   their<\/p>\n<p>respective contentions.
