That on 08-04-06, when the claimant was going in<\/p>\n
his motor bike bearing registration No. KA–~09–Q–3896<\/p>\n
from bus stand of Holenarasipura towards Karyalaya<\/p>\n
extension. the driver of Maruthi car bearing registr2it.i0n<\/p>\n
No. KL\u00ab11–R-5536 came in a rash and my<\/p>\n
manner and dashed against him. As the-_ V’<\/p>\n
claimant fell down and sustained  <\/p>\n
\ufb01led a claim petition beforethe  Ho1penafrjas1pui~ai,’iup<\/p>\n
seeking compensation of  \ufb02\ufb01fribunal
\nby impugned judgrneht’   awarded
\ncompensation of  at 8% p.a.

6. After hearing the learned Counsel for the parties<\/p>\n
and perusing the award of the Tribunal, I am of the<\/p>\n
View that the compensation awarded by the <\/p>\n
not just and proper. it is on the lower side and  ”<\/p>\n
it is deserved to be enhanced.\n<\/p>\n
7. The claimant has <\/p>\n
1) Abrasions over rightelbow. over’left’v_elbo\u00a3V;’ over i’<\/p>\n
left knee. left leg, left an1_;le.,
\n2] Fracture of left_.rireAli’a raacller_)LlVi.1A”si
\n3] Fracture of ”\n<\/p>\n
4)  left   uplosterior malleolus
\nLacerated Wou’r1fc.l,c over frontal region of head<\/p>\n
In_}’1rri_es  him are evident from the<\/p>\n
wound ce’rti~fic’ate’v-_–  Out Patient Chit — Ex.P.14.<\/p>\n
 V’  in  record  18. discharge card — Ex.P. 19, X.-<\/p>\n
 supported by oral evidence of the<\/p>\n
c1a3′.mant.’a,nd doctor examined as P.Ws.1 and 2<\/p>\n
V  respectifely.\n<\/p>\n
  — doctor has stated in his evidence that claimant<\/p>\n
“has sustained permanent disability to an extent of 30%<\/p>\n
to left leg. 8%<\/p>\n

8. Considering the nature of injuries. Rs.55,000\/–<\/p>\n
awarded by the Tribunal towards pain and suffering is<\/p>\n
just and proper and there is no scope for enhance_fn.ent<\/p>\n
under this head.\n<\/p>\n
9. Claimant has producedgn3edic’al”‘ v”.for.i <\/p>\n
Rs.10,412\/—- and he was treated’-as  <\/p>\n
one month at Hemavathi Hospitavl. Hole,naifas.i.pura. 2 L’<\/p>\n
Considering the same, Rs.A15.iOQ0;\/\u00abr awardcdilby the
\nTribunal towards medical. -and expenses is on
\nthe lower sidev._:Therefore,’   Rs.20,000\/–
\nis awarded aridincidental expenses.<\/p>\n
10. Clairnant. it ” to. have been earning<\/p>\n
 by carrying on business in<\/p>\n
 ;_eoffee powder} running a petrol bunk on lease<\/p>\n
  d’oing’a;g1ficu1ture and also doing LIC. He has not<\/p>\n

\n  rfroInl:’.income tax at EX.P.7. Agent licence copy — Ex,P.8,
\n   ._a_.nnual statement copy ~ Ex.P’.9, annual returns copy —<\/p>\n

He has not produced income tax returns (saral form) for
\nconsecutive three years prior to the accident and for<\/p>\n

business”i’anCip dot-um’ents a_re'”‘not produced regarding
\nreduction’ of inco”me’v\u00abin-~.,4the above business after he<\/p>\n
sustained “i~njVui*.iVe’s in the accident. But considering<\/p>\n
win}uries'””sustained. disability stated by the<\/p>\n
 u_d’o’ctor;3 \/o_  limb and an amount of discomfort and<\/p>\n
which he has to undergo for the rest of his<\/p>\n
 it isijust and proper to award Rs.50,000\/~ towards<\/p>\n

  Thus the claimant is entitled for the following<\/p>\n
compensation:\n<\/p>\n
