Civil Application No.1226 of 2010 in Special Civil<br \/>\n\tApplication No.9860 of 2000, on 26.8.2010 had passed the following<br \/>\n\torder:-\n<\/p>\n<p>The<br \/>\n\tpresent application is for review and modification of the order<br \/>\n\tdated 27.01.2010 passed by this Court in SCA No.9860\/00 and the<br \/>\n\tcontention is that certain documents which could not have been<br \/>\n\tproduced are now produced and therefore, this Court may review the<br \/>\n\tmatter.\n<\/p>\n<p>After<br \/>\n\tsome argument, Mr.Desai, learned counsel appearing for the applicant<br \/>\n\tstates that if the applicant is permitted to withdraw the main<br \/>\n\tSpecial Civil Application itself by recalling the earlier order and<br \/>\n\tpermitted to file fresh Special Civil Application by production of<br \/>\n\tthe necessary documents, the same would meet with the ends of<br \/>\n\tjustice.\n<\/p>\n<p>Mr.Dave<br \/>\n\tfor respondent No.1 and and Baiju Joshi for respondent No.3 has no<br \/>\n\tobjection for such purpose.  It has been stated that the respondent<br \/>\n\tNo.2 is in liquidation.\n<\/p>\n<p>Considering<br \/>\n\tthe facts and circumstances, it appears that if the petitioner is<br \/>\n\tdesirous to withdraw the main Special Civil Application itself, no<br \/>\n\tprejudice would be caused.\n<\/p>\n<p>Hence,<br \/>\n\tupon the declaration of the petitioner to withdraw the main Special<br \/>\n\tCivil Application and to file a fresh one by producing necessary<br \/>\n\tdocuments, the earlier order dated 27.01.2010 in Special Civil<br \/>\n\tApplication No.9860\/00 is recalled and the petition is restored.\n<\/p>\n<p>Application<br \/>\n\tdisposed of accordingly.\n<\/p>\n<p>As<br \/>\n\tper the above referred order, the earlier order dated 27.1.2010 in<br \/>\n\tthe present proceedings is recalled and the main Special Civil<br \/>\n\tApplication is restored.  Consequently, the Special Civil<br \/>\n\tApplication is to be reconsidered.\n<\/p>\n<p>As<br \/>\n\tper the declaration made and recorded herein above, the learned<br \/>\n\tCounsel for the petitioner is desirous to withdraw the Special civil<br \/>\n\tApplication with liberty to file a fresh petition after producing<br \/>\n\tnecessary documents.\n<\/p>\n<p>Permission<br \/>\n\tgranted.  Disposed of as withdrawn.
