Bus towards Tilakwada for repairing of his clothes and<br \/>\n\tnear Devadia the said S.T. Bus had stopped due to repairing in the<br \/>\n\tbus and, therefore, the appellant got down from the bus and was<br \/>\n\tproceeding on foot towards Tilakwada Road and at that time, the<br \/>\n\trespondent No.1 came in a jeep car from back side and dashed with<br \/>\n\tthe appellant and as a result of the same, the appellant sustained<br \/>\n\tinjuries on his legs. He was hospitalized for one month as an indoor<br \/>\n\tpatient and suffered permanent partial disability on account of the<br \/>\n\tsame. Hence, he preferred  Motor Accident Claim Petition No.47 of<br \/>\n\t1985, whereby the Motor Accident Claim Tribunal rejected the claim<br \/>\n\tof the appellant. Hence, present appeal.\n<\/p>\n<p>Mr.J.M.\n<\/p>\n<p>\tPatel, learned advocate for the appellant, has submitted that the<br \/>\n\tTribunal has erred in reducing the amount by 1\/2 on the wrong basis<br \/>\n\tthat disability is required to be reduced from 30% to 15%; that the<br \/>\n\tTribunal has erred in not properly applying the ratio of the<br \/>\n\tdecision in the case of 1982(2) GLR 379 and that the<br \/>\n\tTribunal has erred in reducing the disability from 30% to 15%. In<br \/>\n\tview above submissions, it is prayed that the appeal may be allowed<br \/>\n\tby allowing the claim petition in toto.\n<\/p>\n<p>Having<br \/>\n\tconsidered the contentions raised by the learned counsel for the<br \/>\n\tappellant, averments made in the appeal and the documentary evidence<br \/>\n\tproduced on record, it transpires that the Tribunal after taking<br \/>\n\tinto consideration all the relevant documents and evidence on record<br \/>\n\thas partly allowed the claim petition filed by the appellant. It is<br \/>\n\tpertinent to note that the Tribunal on the basis of the decision of<br \/>\n\tthis Court reported in 1985 (2) GLR 379 has assessed the disability<br \/>\n\tat 15% of the whole body instead of 30% prescribed by the doctor.<br \/>\n\tThus, the conclusion arrived at by the Tribunal in reducing the<br \/>\n\tdisability which is on the basis of the decision of this Court<br \/>\n\tcannot be said to be unjust and improper. Further, the doctor had<br \/>\n\tassessed the disability 30% of the left leg and not of the whole<br \/>\n\tbody. Hence, the Tribunal has rightly applied the ratio of the above<br \/>\n\tcited decision to the present case.\n<\/p>\n<p>\tIn<br \/>\n\tview of aforesaid, I am of the opinion that the view taken by the<br \/>\n\tTribunal is just and proper. The Tribunal has assigned cogent and<br \/>\n\tconvincing reasons for arriving at the conclusion. Over and above<br \/>\n\tthe reasons assigned hereinabove, I adopt the reasons assigned by<br \/>\n\tthe Tribunal and do not find any illegality much less any perversity<br \/>\n\tin the findings recorded. I am in complete agreement with the<br \/>\n\tfindings recorded by the Tribunal. No case is made out to interfere<br \/>\n\twith the findings recorded by the Tribunal. Hence, present appeal<br \/>\n\tdeserves to be dismissed.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, present appeal fails and is, accordingly,<br \/>\n\tdismissed.
