The said   Criminal Revision Application No. 624 of<br \/>\n1999 was permitted to be converted into Criminal Appeal No. 958 of<br \/>\n2007 vide order dated 11.7.2007. By way of this Appeal, the present<br \/>\nappellant challenges the aforesaid order.\n<\/p>\n<p>\t\tHeard<br \/>\nthe learned advocate for the parties and the learned APP for opponent<br \/>\nNo.1.\n<\/p>\n<p>\t\tThe<br \/>\nappeal is admitted.\n<\/p>\n<p>2.\t\tThis<br \/>\ncourt  has gone through the entire rojkam as well as  the ?Sno<br \/>\ninstructions?? pursis filed by the advocate of the complainant.  No<br \/>\ndoubt, the complainant has not remained present before the court when<br \/>\nthe matter was called out.  It seems that the RPAD Notice issued<br \/>\nthrough the advocate of the complainant was not served on the<br \/>\ncomplainant and it was returned with an endorsement  ?Snot found??.<br \/>\nThis shows that the complainant was not present at the residence when<br \/>\nthe Notice was sent. Without going into this fact, the trial court<br \/>\nhas, in haste, passed the order.  Had the complainant been informed<br \/>\nby his advocate, certainly she would have been present before the<br \/>\ncourt. Be that as it may, in the opinion of this court, the matter<br \/>\nhas to be decided on merits and it should not be thrown out on<br \/>\ntechnical grounds.\n<\/p>\n<p>3.\t\tIn<br \/>\nview of the above,  the appeal is allowed. The order passed by the<br \/>\ntrial court is  quashed and set aside.  The trial court is directed<br \/>\nto fix the matter  on day-to-day basis for conducting the trial.
