Respondents\n\n\nCORAM: HON'BLE MR.JUSTICE AJAY KUMAR MITTAL\n\nPresent:   Mr.Sant Pal Singh Sidhu, Advocate,\n           for the petitioner.\n\n           Mr.P.S.Thiara, Advocate, for the respondents.\n\nAJAY KUMAR MITTAL, J.\n<\/pre>\n<p>           The plaintiff-petitioner has approached this Court<\/p>\n<p>under Article 227 of the Constitution of India, for setting aside the<\/p>\n<p>order dated 19.8.2006, passed by the Civil Judge (Senior<\/p>\n<p>Division), Ludhiana (Annexure-P1) whereby the application filed<\/p>\n<p>by it for temporary injunction restraining the respondents from<\/p>\n<p>disconnecting the electricity supply to the meter of the petitioner<\/p>\n<p>and also from recovering the amount of penalty from it, was<\/p>\n<p>dismissed and the order dated 26.3.2009 (Annexure P-2) whereby<\/p>\n<p>the District Judge, Ludhiana, on appeal there against affirmed the<\/p>\n<p>same.\n<\/p>\n<p>           In para 6 of its order, the lower Appellate Court while<\/p>\n<p>affirming the order of the trial court recorded as under:<\/p>\n<blockquote><p>                  &#8220;I have heard Ld. Counsel for the parties and I<br \/>\n<span class=\"hidden_text\"> C.R.No.3031 of 2009                                                   -2-<\/span><\/p>\n<p>               am of the considered opinion that the instant<\/p>\n<p>               appeal deserves to be dismissed. It is admitted<\/p>\n<p>               fact between the parties            that initially the<\/p>\n<p>               sanctioned load was extended from 79.847 KW<\/p>\n<p>               to 298.012 KW and the electric connection was<\/p>\n<p>               converted into L.S. Category. The appellant had<\/p>\n<p>               approached the Dispute Settlement Committee<\/p>\n<p>               for the settlement of issues and had deposited<\/p>\n<p>               50% of the alleged demand.                The argument<\/p>\n<p>               raised   by    the   appellant     that    the   Dispute<\/p>\n<p>               Settlement     Committee     was      biased      as    it<\/p>\n<p>               comprised of the full time employees of Punjab<\/p>\n<p>               State Electricity Board holds no ground because<\/p>\n<p>               the appellant can not be allowed to challenge the<\/p>\n<p>               constitution of Dispute Settlement Committee<\/p>\n<p>               after having appeared before the same and<\/p>\n<p>               having been unsuccessful in getting favourable<\/p>\n<p>               orders from the same.            Furthermore, if the<\/p>\n<p>               appellant had any grievance against the order of<\/p>\n<p>               the Dispute Settlement Committee, it had the<\/p>\n<p>               remedy    to     approach        Dispute     Settlement<\/p>\n<p>               Authority, which is appellate authority. Although<\/p>\n<p>               the civil court jurisdiction is not barred by<\/p>\n<p>               scheme framed by Punjab State Electricity<br \/>\n<span class=\"hidden_text\"> C.R.No.3031 of 2009                                              -3-<\/span><\/p>\n<p>               Board, by composing a Dispute Settlement<\/p>\n<p>               Committee, yet it does not take away remedy of<\/p>\n<p>               the    Dispute   Settlement    Authority   i.e.   the<\/p>\n<p>               Appellate Authority. The applicant is duty bound<\/p>\n<p>               to make the payment of the alleged demand, if it<\/p>\n<p>               is proved that he violated the Peak Load Hour<\/p>\n<p>               Restrictions, therefore, there is no prima facie<\/p>\n<p>               case in its favour. The balance of convenience<\/p>\n<p>               is also not in favour of the appellant and no<\/p>\n<p>               irreparable loss would be caused to it, if the<\/p>\n<p>               injunction is not granted in its favour. If case is<\/p>\n<p>               finally decided in favour of the applicant\/plaintiff,<\/p>\n<p>               the money deposited by the appellant can be<\/p>\n<p>               adjusted in the future bills raised by Punjab<\/p>\n<p>               State Electricity Board for the consumption of<\/p>\n<p>               electricity by the appellant.       The judgment<\/p>\n<p>               W.B.S.E.B Vs. Faqir Chand Rice Mills and other<\/p>\n<p>               (supra) relied upon by the appellant lays down<\/p>\n<p>               that only half the amount should be directed to<\/p>\n<p>               be deposited in the matters of money claims. In<\/p>\n<p>               the said judgment, Hon&#8217;ble Supreme Court has<\/p>\n<p>               infact observed that obligation is cast upon the<\/p>\n<p>               consumers to pay the amount subject to the<\/p>\n<p>               determination of controversy in the suit and in<br \/>\n<span class=\"hidden_text\"> C.R.No.3031 of 2009                                               -4-<\/span><\/p>\n<p>                 the said judgment Hon&#8217;ble Supreme Court<\/p>\n<p>                 directed the consumer of electricity to deposit a<\/p>\n<p>                 sum of Rs.12 lacs within a period of two months.<\/p>\n<p>                 Hence, the said judgment has not laid down the<\/p>\n<p>                 law that only half the amount should be directed<\/p>\n<p>                 to be deposited. In fact it says that at least half<\/p>\n<p>                 of the amount would be directed to be deposited.<\/p>\n<p>                 Therefore, I find no merit in the appeal and the<\/p>\n<p>                 same is hereby dismissed. The lower Court file<\/p>\n<p>                 be returned alongwith the copy of this judgment<\/p>\n<p>                 for compliance.     The parties are directed to<\/p>\n<p>                 appear before the ld. Trial Court on 21.4.2009. &#8220;<\/p><\/blockquote>\n<p>           In view of the above observations of the courts below<\/p>\n<p>and for the reason that no illegality or perversity could be shown<\/p>\n<p>therein by the learned counsel for the petitioner, this Court does<\/p>\n<p>not find any ground to interfere with the impugned orders in<\/p>\n<p>exercise of its jurisdiction under Article 227 of the Constitution of<\/p>\n<p>India.
