No.45040 of 2010\n                  WAKALI PANDEY, SON OF LATE RADHA KISHUNA PADNEY\n                                            Versus\n                                  THE STATE OF BIHAR\n                                          -----------\n<\/pre>\n<p>2.   16.03.2011               Heard learned counsel for the petitioner, learned<\/p>\n<p>                   counsel for the Informant and the State.\n<\/p>\n<p>                              The petitioner seeks bail in a case instituted for the<\/p>\n<p>                   offence under Sections 147, 148, 149, 447, 341, 323, 324, 307,<\/p>\n<p>                   302 and 506 of the Indian Penal Code.\n<\/p>\n<p>                              It has been submitted that the petitioner is merely<\/p>\n<p>                   said to be a member of the mob whereas the specific overt act<\/p>\n<p>                   is alleged against Ved Prakash and Ashok Pandey.<\/p>\n<p>                              Considering the same, let the petitioner above<\/p>\n<p>                   named, who is in custody since be released on bail on<\/p>\n<p>                   furnishing bail bond of Rs. 5,000\/- (Five thousand) with two<\/p>\n<p>                   sureties of the like amount each or any other surety to be fixed<\/p>\n<p>                   by the court concerned to the satisfaction of Chief Judicial<\/p>\n<p>                   Magistrate, East Champaran, Motihari, in Turkauliaya P.S.<\/p>\n<p>                   Case No. 320 of 2010 subject to the following conditions: (i)That<\/p>\n<p>                   one of the bailors will be a close relative of the petitioner who<\/p>\n<p>                   will give an affidavit giving genealogy as to how he is related<\/p>\n<p>                   with the petitioner. The bailor will undertake to furnish<\/p>\n<p>                   information to the court about any change in address of the<\/p>\n<p>                   petitioner. (ii)That the affidavit shall clearly state that the<\/p>\n<p>                   petitioner is not an accused in any other case and if he is, he<\/p>\n<p>                   shall not be released on bail. (iii)That the bailor shall also state<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>        on affidavit that he will inform the court concerned if the<\/p>\n<p>        petitioner is implicated in any other case of similar nature after<\/p>\n<p>        his release in the present case and thereafter the court below<\/p>\n<p>        will be at liberty to initiate the proceeding for cancellation of bail<\/p>\n<p>        on the ground of misuse. (iv)That the petitioner will give an<\/p>\n<p>        undertaking that he will receive the police papers on the given<\/p>\n<p>        date and be present on date fixed for charge and if he fails to<\/p>\n<p>        do so on two given dates and delays the trial in any manner, his<\/p>\n<p>        bail will be liable to be cancelled for reasons of misuse.
