Justice V.RAMKUMAR\n\n Dated :18\/06\/2007\n\n O R D E R\n                           V.RAMKUMAR, J.\n\n                         ----------------------------\n\n                       Crl.R.P.No. 1230\/2007\n\n                         -----------------------------\n\n                Dated this  18th day of June, 2007\n\n\n                               O R D E R\n<\/pre>\n<p>             In   this   revision   filed   under   Section   397   read<\/p>\n<p>with Section 401 Cr.P.C,   the petitioner, who was accused<\/p>\n<p>in Crime No.96\/2006 of Anchal police station for an offence<\/p>\n<p>punishable   under   Section   511   of   Section   420   IPC,<\/p>\n<p>challenges the orders passed by the trial Court as well as<\/p>\n<p>the lower Appellate Court refusing the revision petitioner&#8217;s<\/p>\n<p>application   filed   under   Section   452   Cr.P.C   seeking<\/p>\n<p>permanent   custody   in   respect   of   two   idols   &#8211;   one   of   Lord<\/p>\n<p>Dharmasastha  made in  Panchaloham  and  another  of  Lord<\/p>\n<p>Vishnu.\n<\/p>\n<\/p>\n<p>      2.     Assailing   the   impugned   orders,     Adv.   Sri.<\/p>\n<p>Jayakumar, the learned counsel  appearing for the revision<\/p>\n<p>petitioner, made the following submissions before me:-<\/p>\n<p>      The   revision   petitioner   had   agreed   to   purchase   the<\/p>\n<p>idol of Lord Dharmasastha on 10.1.2005 from one Sobhana<\/p>\n<p>alias   sobha   for   a   total   consideration   of     Rupees   Eleven<\/p>\n<p>Lakhs   out   of   which   Rupees   Five   Lakhs   was   paid     in<\/p>\n<p>advance.     The   idol   was   handed   over   to   the   revision<\/p>\n<p>petitioner, who had undertaken to pay the balance amount<\/p>\n<p>Crl.R.P.1230\/2007<\/p>\n<p><span class=\"hidden_text\">                                      2<\/span><\/p>\n<p>of   Rupees   Six   Lakhs   as   and   when   the   idol   was   sold   by<\/p>\n<p>him.     The   said   idol   as   well   as   the   idol   of   Lord   Vishnu<\/p>\n<p>were, thereafter, seized by the police on 14.2.2006 from<\/p>\n<p>Vedarpacha   house   at   Cheepvayal     where   the   revision<\/p>\n<p>petitioner   was   residing   on   rent.     Both   the   idols   were<\/p>\n<p>produced   before   the   J.F.C.M,   Anchal,     who   ordered   the<\/p>\n<p>same   to   be   kept   in   safe   custody   in   the   Sub   Treasury,<\/p>\n<p>Anchal.          The   revision   petitioner   filed   Crl.M.C<\/p>\n<p>No.1068\/2006   before   this   Court   under   Section   482<\/p>\n<p>Cr.P.C   seeking   to   quash   the   F.I.R.     As   per   the   order<\/p>\n<p>dated 31.5.2006,  this Court quashed the F.I.R.  If so, the<\/p>\n<p>properties   which   were   seized   from   the   custody   of   the<\/p>\n<p>revision   petitioner   were   liable   to   be   returned   to   him<\/p>\n<p>under   Section   452   Cr.P.C.     The   revision   petitioner,<\/p>\n<p>therefore,  filed  C.M.P.No.4705\/2006   before  the  J.F.C.M,<\/p>\n<p>Anchal under Section 452 Cr.P.C.   The said petition has<\/p>\n<p>been dismissed by that Court.   The said order has been<\/p>\n<p>confirmed in appeal by the  lower appellate Court.  Going<\/p>\n<p>by   the   decision   in    <a href=\"\/doc\/548752\/\">N.Madhavan     v.     State   of   Kerala<\/p>\n<p>(AIR<\/a>     1979     SC     1829),    in   a   case   where   after   an<\/p>\n<p>enquiry or trial, the accused is discharged or acquitted,<\/p>\n<p>Crl.R.P.1230\/2007<\/p>\n<p><span class=\"hidden_text\">                                          3<\/span><\/p>\n<p>the   Court   should   normally   restore   the   property     to   the<\/p>\n<p>person from whose custody it was taken and a departure<\/p>\n<p>from   this   rule   of   practice   should   not   be   lightly   made<\/p>\n<p>especially   when   there   is   no   dispute   or   doubt   regarding<\/p>\n<p>the   question   as   to   the   person   from   whose   custody   the<\/p>\n<p>property   was   seized.     The   petitioner   also   relies   on<\/p>\n<p>Malabar Cashewnuts &amp; Allied products  v.   State of<\/p>\n<p>Kerala  (1982  KLT  532),  where,  in the event of any<\/p>\n<p>rival   claim   of   title,   the   proper   course   would   be   for   the<\/p>\n<p>disputing   party   to   get   their   title   established   before     a<\/p>\n<p>Civil Court,   before the Criminal Court can be requested<\/p>\n<p>to pass an order under Section  452 Cr.P.C.   Hence, the<\/p>\n<p>Courts below were not justified in rejecting the claim of<\/p>\n<p>the revision petitioner.   In any view of the matter, since<\/p>\n<p>Sobhana has no claim over the idol of Lord Vishnu,   the<\/p>\n<p>Courts  below ought to have given custody of the same to<\/p>\n<p>the revision petitioner.\n<\/p>\n<\/p>\n<pre>       3.     Adv.         Sri.         Dinesh,         who         has         filed\n\n\nCrl.M.A.No.5911\/2007   seeking   the     impleadment   on\n\n\nbehalf   of   one   Sobhana     alias   Sobha     in   this   revision,\n\n\n<\/pre>\n<p>made the following submissions before me in support of<\/p>\n<p>Crl.R.P.1230\/2007<\/p>\n<p><span class=\"hidden_text\">                                     4<\/span><\/p>\n<p>his application for   impleading:-\n<\/p>\n<\/p>\n<p>       The   idol   of   Lord   Dharmasastha   belonged   to   the<\/p>\n<p>father   of   the   said   Sobhana   and   it   was   taken   by   the<\/p>\n<p>revision   petitioner   for   the   purpose   of   shooting   a<\/p>\n<p>cinematographic   film   and   Sobhana   had   given   him   a<\/p>\n<p>Power of Attorney to move a petition under Section 452<\/p>\n<p>Cr.P.C.     But   the   revision   petitioner   acted   against     the<\/p>\n<p>interests of Sobhana and that is the reason why she has<\/p>\n<p>sought her intervention in this revision.<\/p>\n<p>       4.    I find myself unable to accept both the above<\/p>\n<p>contentions.           The   only   point   which   arises   for<\/p>\n<p>consideration   in   this   revision   is   as   to   whether   the   two<\/p>\n<p>idols   were   seized   from   the   physical   custody   of   the<\/p>\n<p>revision   petitioner   so   as   to   entitle   him   to  restoration   of<\/p>\n<p>the custody of the same, consequent on the termination<\/p>\n<p>of the proceedings before the Court.  Crime No. 96\/2006<\/p>\n<p>of Anchal police station was registered at the instance of<\/p>\n<p>one   Bhargavan   Pillai.       The   allegation   was   that   the<\/p>\n<p>revision   petitioner,   who   was   the   accused   in   the   said<\/p>\n<p>crime,   had   attempted   to   commit   an   offence   punishable<\/p>\n<p>under Section  420 IPC.   On  14.2.2006 the police  seized<\/p>\n<p>Crl.R.P.1230\/2007<\/p>\n<p><span class=\"hidden_text\">                                    5<\/span><\/p>\n<p>both the idols &#8211; one of Lord Dharmasastha and other of<\/p>\n<p>Lord Vishnu from one Vedarpacha House at Cheepvayal.<\/p>\n<p>The revision petitioner has not been able to prove before<\/p>\n<p>the Courts    below that the said house either  belongs  to<\/p>\n<p>him or was in his occupation as a tenant.  Admittedly, the<\/p>\n<p>revision   petitioner   was  not   present   when   the   seizure   of<\/p>\n<p>the   idols   was   made.     No   doubt,     in   Crl.M.C.1068\/2006<\/p>\n<p>filed   by   the   revision   petitioner   for   quashing   the   F.I.R<\/p>\n<p>registered against him, this Court  as per the order dated<\/p>\n<p>31.5.2006,   allowed   the   revision   and   quashed   the   F.I.R.<\/p>\n<p>Consequently,   the   possession   of   two   idols   which   were<\/p>\n<p>seized in the case will have to be restored to the person<\/p>\n<p>from   whom   they   were   seized.     Both   the   Courts     below<\/p>\n<p>have   concurrently   held   that   there   was   no   evidence   to<\/p>\n<p>show that   two idols were seized from the possession of<\/p>\n<p>the   revision   petitioner.     Hence,   there   is   no   question   of<\/p>\n<p>applying the dictum laid down in AIR  1979  SC  1829.<\/p>\n<p>      5.     The request of Sobhana for impleading her in<\/p>\n<p>this   revision   also   cannot   be   entertained.     Admittedl,   a<\/p>\n<p>similar  request made by her  before the lower appellate<\/p>\n<p>Court was rejected and she has not  chosen to assail the<\/p>\n<p>Crl.R.P.1230\/2007<\/p>\n<p><span class=\"hidden_text\">                                         6<\/span><\/p>\n<p>said   order.         If     Sobhana   is   aggrieved   by   any   order<\/p>\n<p>passed by the  Criminal  Court  prejudicially  affecting  her<\/p>\n<p>rights,   it   is   open   to   her   to   assail   the   said   orders.     That<\/p>\n<p>cannot be done by impleading herself in a revision filed<\/p>\n<p>by somebody else.\n<\/p>\n<\/p>\n<p>       6.      The   Courts     below   cannot   be   held   to   have<\/p>\n<p>committed   any   illegality,   irregularity   or   impropriety   in<\/p>\n<p>rejecting the claim  by the revision petitioner for custody<\/p>\n<p>of   the   idols   in   question   in   a   claim   made   under   Section<\/p>\n<p>452   Cr.P.C.     Apart   from   the   fact   that   there   was   no<\/p>\n<p>evidence   of   actual   seizure   from   the   physical   custody   of<\/p>\n<p>the revision petitioner, there was also a rival claim over<\/p>\n<p>the same.  Hence, if the revision petitioner wants to have<\/p>\n<p>the custody of the idols of Lord Dharmasastha and Lord<\/p>\n<p>Vishnu, the proper course is to approach the Civil Court<\/p>\n<p>and   get   his   rights   declared   and,   thereafter,   move   the<\/p>\n<p>Criminal Court for custody.\n<\/p>\n<\/p>\n<p>       7.      It is true that  Sobhana had no claim over the<\/p>\n<p>idol   of   Lord   Vishnu.     But   that   does   not   mean   that   the<\/p>\n<p>revision  petitioner is  entitled  to custody of the  said idol<\/p>\n<p>as   well,   since   the   very   same   reasons   which   apply   in<\/p>\n<p>Crl.R.P.1230\/2007<\/p>\n<p><span class=\"hidden_text\">                                      7<\/span><\/p>\n<p>respect   of   the   idol   of   Lord   Dharmasastha   equally   apply<\/p>\n<p>in the case of  the idol of  Lord Vishnu as well.  There is<\/p>\n<p>no   evidence   of   actual   seizure   of  the   said   idol     from   the<\/p>\n<p>physical   custody   of   the   revision   petitioner,   so   as   to<\/p>\n<p>enable   him   to   move   the   Criminal   Court   under   Section<\/p>\n<p>452 Cr.P.C.   In respect of said idol also,   the remedy of<\/p>\n<p>the revision petitioner is to move the Civil Court.<\/p>\n<p>              This  revision, which is devoid of any merit,  is<\/p>\n<p>accordingly   dismissed.
