JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n\t\t\t\tDate\n: 17\/06\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\npetition, under Article 226 of the Constitution of India, has been<br \/>\nfiled, with the following prayers :-\n<\/p>\n<p>&#8220;7.\tThe<br \/>\npetitioners respectfully pray that, on the basis of the facts and<br \/>\ncircumstances as mentioned hereinabove and which may be urged at the<br \/>\ntime of hearing, the Honourable Court may be pleased to issue a writ<br \/>\nof mandamus or any other appropriate writ, order or direction to the<br \/>\nrespondent authorities and may be pleased to:-\n<\/p>\n<p>(A)\tdirect<br \/>\nthe respondent authorities to consider the case of the petitioners<br \/>\nfor appointment and also give appointment to the petitioners, on the<br \/>\nposts of Assistant Public Prosecutors, Class-II which have remained<br \/>\nvacant, pursuant to the advertisement No: 15 of 2008-09, and <\/p>\n<p>(B)\tPending<br \/>\nadmission and final disposal of this petition the Honourable Court<br \/>\nmay be pleased to direct the respondent authorities to consider the<br \/>\ncase of the petitioners for appointment, on the posts of Assistant<br \/>\nPublic Prosecutor, Class-II which have remained vacant, pursuant to<br \/>\nthe advertisement No:15 of 2008-09, and <\/p>\n<p>(C)\taward<br \/>\nthe cost of this petition, and <\/p>\n<p>(D)\tgrant<br \/>\nany other relief or pass any other order which the Honourable Court<br \/>\nmay consider as just and proper in the facts and circumstances of the<br \/>\ncase.\n<\/p>\n<p>2.\tBriefly<br \/>\nstated, the case of the petitioners is that their names are figuring<br \/>\nin the waiting-list prepared by respondent No.2 (Gujarat Public<br \/>\nService Commission). After the appointment of 199 persons as<br \/>\nAssistant Public Prosecutors, from the select-list, about 18 posts<br \/>\nare still lying vacant, but the waiting-list is not being operated<br \/>\nfor filling up  the said vacancies. Aggrieved thereby, the<br \/>\npetitioners have approached this Court by filing the present<br \/>\npetition.\n<\/p>\n<p>3.\tMr.\n<\/p>\n<p>Vaibhav A. Vyas, learned advocate for the petitioners has submitted<br \/>\nthat some of the petitioners have made a representation to respondent<br \/>\nNo.1 on 09.04.2011, upon which no decision has been communicated to<br \/>\nthe petitioners so far. It is emphasized by the learned advocate for<br \/>\nthe petitioners that the waiting-list shall expire on 23.07.2011, and<br \/>\nif the representation is not decided at an early date, the right of<br \/>\nthe petitioners for consideration for appointment would suffer.
