SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 02\/05\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India<br \/>\nthe petitioner-original plaintiff has prayed for an appropriate writ,<br \/>\norder or direction quashing and setting aside the impugned judgment<br \/>\nand order passed by the learned Additional District Judge, Kheda at<br \/>\nNadiad dated 18\/03\/2010 in Miscellaneous Civil  Appeal No. 11\/2008 as<br \/>\nwell as the order passed by the learned trial Court below Exh. 5<br \/>\ndated 30\/12\/2006 in Regular Civil Suit No. 6\/2006.\n<\/p>\n<p>2.\tThe<br \/>\npetitioner herein has instituted Regular Civil Suit No. 6\/2006 in the<br \/>\nCourt of learned  Civil Judge (Junior Division), Kheda against the<br \/>\ndefendants for declaration and permanent injunction as well as with<br \/>\nrespect to the sale deed in favour of original defendant no. 6<br \/>\nclaiming some right on the basis of some writing alleged to be<br \/>\nagreement to sell executed in the year 1988.  It is to be noted that<br \/>\nat the relevant time when the agreement to sell was alleged to have<br \/>\nbeen executed in the year 1988 admittedly the land in question was<br \/>\nrestricted New Tenure  land and the same could not have been<br \/>\ntransferred without prior permission of the appropriate authority and<br \/>\nwithout making the payment of premium.  It appears that subsequently<br \/>\nin the year 2002 the original owners i.e. original defendants nos. 1<br \/>\nto 5 submitted an application before appropriate authority for<br \/>\nconverting the land from New Tenure to Old Tenure and removing the<br \/>\nrestriction under Section 43 of the Bombay Tenancy Act and on payment<br \/>\nof premium the same was converted from New Tenure to Old Tenure and<br \/>\nthereafter, after a period of four years original defendants nos. 1<br \/>\nto 5 have sold the said land in question in favour of original<br \/>\ndefendant no. 6 by registered sale deed.  It is to be noted that the<br \/>\npetitioner is claiming the right on the basis of the alleged<br \/>\nagreement to sell of the year 1988 against which original  defendant<br \/>\nno. 6 is having valid title on the basis of the registered sale deed<br \/>\nexecuted by the original land owners.  The petitioner has now and at<br \/>\npresent prayed for injunction against original defendants no. 6, who<br \/>\nis having right, title and interest on the basis of the registered<br \/>\nsale deed executed by the original owners.  It is to be noted that as<br \/>\nsuch there are no allegation against original defendant no. 6  that<br \/>\nthe sale deed is in favour of original defendant no. 6 is collusive,<br \/>\nmalafide and\/or  to defraud the rights of the<br \/>\npetitioner-original plaintiff.\n<\/p>\n<p>3.\tIn<br \/>\nthe backdrop of the aforesaid facts and circumstances of the case,<br \/>\nprayer for injunction against original defendant no. 6 is required to<br \/>\nbe considered.  When original defendant no. 6  is having a valid<br \/>\nright, title or interest in his favour on the basis of the registered<br \/>\nsale deed executed by the original land owners, who has paid the full<br \/>\nsale consideration, no injunction can be granted against him and in a<br \/>\nsuit filed by the petitioner-original plaintiff, who is claiming the<br \/>\nright solely on the basis of the agreement to sell alleged to have<br \/>\nbeen executed in the year 1988.  At the most the petitioner-original<br \/>\nplaintiff may claim the damages and that to against the original<br \/>\nowners i.e. defendants nos. 1 to 5.  Under the circumstances, both<br \/>\nthe Courts below have rightly refused to grant injunction in favour<br \/>\nof the petitioner-original plaintiff.  There are concurrent findings<br \/>\nof fact given by both the Courts below with respect to possession.<br \/>\nIn any case, considering the aforesaid facts and circumstances of the<br \/>\ncase, no illegality has been committed by the both the Courts below<br \/>\nin refusing to grant injunction in favour of the petitioner, which<br \/>\ncalls for the interference of this Court in exercise of powers under<br \/>\nArticle 227 of the Constitution of India.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above, the present petition fails and the same deserves<br \/>\nto be dismissed and is accordingly dismissed.\n<\/p>\n<p>\t\t\t\t\t\t\t(M.R.\n<\/p>\n<p>SHAH, J.)<\/p>\n<p>siji<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Ramjibhai vs Kalidas on 2 May, 2011 Author: M.R.
