BHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/04\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE RAVI R.TRIPATHI)<\/p>\n<p>1.0\tPresent<br \/>\napplication is filed by the applicant &#8211; convict through jail<br \/>\nseeking Temporary Bail for a period of 60 days so as to carry out<br \/>\nnecessary repairs in the house.\n<\/p>\n<p>2.0\tRule.\n<\/p>\n<p> Learned Additional Public Prosecutor Mr. Pandya waives service of<br \/>\nprocess of Rule.\n<\/p>\n<p>3.0\tThe<br \/>\nlearned Additional Public Prosecutor invited the attention of the<br \/>\nCourt to the Jail Remarks.  In the months of March &#8211; April<br \/>\n2011, the applicant &#8211; convict had enjoyed first Furlough.  In<br \/>\napplication, in last but one Paragraph, the applicant &#8211; convict<br \/>\nhas mentioned the reason as to why he could not carry out the repairs<br \/>\nof the house and he has also stated that necessary material is<br \/>\nalready collected and if he is granted Temporary Bail, he will be<br \/>\nable to carry out the repairs of house.\n<\/p>\n<p>4.0\tTaking<br \/>\ninto consideration the contents of the application, the application<br \/>\nis allowed.  The applicant &#8211; convict is ordered to be released<br \/>\non Temporary Bail for a period of 30 days from the date<br \/>\nof his release, on his executing a personal bond of Rs.5,000\/-<br \/>\n(Rupees Five Thousand only) to the satisfaction of the jail<br \/>\nauthorities.\n<\/p>\n<p>4.1\tThe<br \/>\napplicant &#8211; convict shall surrender to the jail authorities on<br \/>\nexpiry of the Temporary Bail period.\n<\/p>\n<p>4.2\tRule<br \/>\nis made absolute to the aforesaid extent.\n<\/p>\n<p>[<br \/>\nRavi R.
