J.\n<\/p>\n<p>     This appeal  is filed by the father of Rajeeva, who was<br \/>\nmarried to  respondent No.1,  in the month May, 1987 and who<br \/>\ncommitted suicide  within four\tmonths. This appeal is filed<br \/>\nagainst three  respondents who\twere tried  for the offences<br \/>\npunishable under  Sections 306,\t Part B\t and  498A  IPC\t and<br \/>\nacquitted  by\tthe  trial  court  and\twhose  acquittal  is<br \/>\nconfirmed by the High court.\n<\/p>\n<p>     The fact  that marriage of Rajeeva with respondent No.1<br \/>\ntook place  on 18.5.87\tis not in dispute. It is also not in<br \/>\ndispute that she committed suicide on 4.9.87.\n<\/p>\n<p>     It was  the prosecution  case that\t she  had  committed<br \/>\nsuicide as a result of cruelty practiced by the respondents.<br \/>\nIt was alleged that respondent No.1 &#8211; the husband was having<br \/>\nan affair  with another\t woman and  for that  reason he also<br \/>\nused to\t beat her often. It was also alleged that respondent<br \/>\nNos. 2\tand 3  were demanding  dowry from her and her father<br \/>\nand as\tthe articles  demanded were not given they were ill-<br \/>\ntreating her.  In order\t to prove  its case, the prosecution<br \/>\nexamined the Parents of Rajeeva, her sister and her friend.\n<\/p>\n<p>     The trial\tcourt after  appreciating that evidence came<br \/>\nto the conclusion that their evidence was not consistent and<br \/>\nit did\tnot inspire  any confidence as regards the demand of<br \/>\ndowry and  ill-treatment. The trial court also held that the<br \/>\nact of coming late at night by the husband did not amount to<br \/>\nan act\tof cruelty, It, therefore, accredited the accused of<br \/>\nall the charges levelled against them.\n<\/p>\n<p>     The  High\t court\tafter  reappreciating  the  evidence<br \/>\nconfirmed those\t findings. The\tHigh Court has held that the<br \/>\nwhole story  regarding demand  of dowry\t was  unnatural\t and<br \/>\nimprobable in  view of\tthe fact that Rajeeva was married to<br \/>\nrespondent No.1\t at the\t instance of respondent Nos. 2 and 3<br \/>\nthat before or at the time of marriage they had not demanded<br \/>\nany dowry  and that  they also knew that financial condition<br \/>\nof the\tfather of  Rajeeva was\tnot such  that he could have<br \/>\ngiven a\t scooter, a  fridge, and almirah, a water filter and<br \/>\ncash of Rs.2000\/-.\n<\/p>\n<p>     On going  through the  judgments of both the courts and<br \/>\nthe evidence,  We find\tthat the  reasons given\t by the\t two<br \/>\ncourts for  not placing\t reliance  upon\t the  aforesaid\t two<br \/>\nwitnesses are not at all improper, PW l &#8211; father of Rajeeva,<br \/>\nhappened to  be a  friend of  respondent Nos.  2 and  3. His<br \/>\ndaughter was  married to respondent No. 1 at the instance of<br \/>\nrespondent Nos.2  and 3. It was also not disputed that while<br \/>\nfixing the  marriage, no  demand for dowry was made. In view<br \/>\nof these  facts and circumstances, it is not believable that<br \/>\nwithin seven  days of  the marriage, they would have started<br \/>\ndemanding such articles. Even in the letter, Ex.P.4 produced<br \/>\nby the\tfriend of  Rajeeva &#8211;  PW 5,  there is  no mention of<br \/>\ndemand of dowry or ill-treatment, by any of respondents.
