Advocate\n\nHon'ble Ravindra Singh,J.\n<\/pre>\n<p>Heard\u00a0learned\u00a0counsel\u00a0for\u00a0the\u00a0applicants\u00a0and\u00a0learned\u00a0A.G.A.<br \/>\nThis \u00a0 application \u00a0 has \u00a0 been \u00a0 filed \u00a0 by \u00a0 the \u00a0 applicants \u00a0 Rajendra\u00a0<br \/>\nSingh,\u00a0Ranvijay\u00a0Singh\u00a0and\u00a0Ritu\u00a0Singh\u00a0with\u00a0a\u00a0prayer\u00a0to\u00a0quash\u00a0<br \/>\nthe\u00a0order\u00a0dated\u00a021.8.2009\u00a0passed\u00a0by\u00a0Special\u00a0C.J.M,\u00a0Kanpur\u00a0<br \/>\nNagar\u00a0in\u00a0case\u00a0no.\u00a093\u00a0of\u00a02007.\n<\/p>\n<p>It\u00a0is\u00a0contended\u00a0by\u00a0learned\u00a0counsel\u00a0for\u00a0the\u00a0applicants\u00a0that\u00a0in\u00a0this\u00a0<br \/>\ncase\u00a0final\u00a0report\u00a0has\u00a0been\u00a0submitted\u00a0by\u00a0the\u00a0I.O.,\u00a0the\u00a0same\u00a0has\u00a0<br \/>\nbeen\u00a0rejected\u00a0by\u00a0learned\u00a0Magistrate\u00a0concerned\u00a0and\u00a0order\u00a0of\u00a0re\u00ad<br \/>\ninvestigation\u00a0 has\u00a0 been\u00a0passed,\u00a0 which\u00a0is\u00a0 illegal,\u00a0 because\u00a0the\u00a0<br \/>\norder\u00a0of\u00a0re\u00adinvestigation\u00a0can\u00a0not\u00a0be\u00a0passed.<br \/>\nIn \u00a0 reply \u00a0 of \u00a0 the \u00a0 above \u00a0 contention \u00a0 it \u00a0 is \u00a0 submitted \u00a0 by \u00a0 learned\u00a0<br \/>\nA.G.A.\u00a0that\u00a0that\u00a0the\u00a0impugned\u00a0order\u00a0dated\u00a021.8.2009\u00a0may\u00a0be\u00a0<br \/>\nmodified.\n<\/p>\n<p>Considering\u00a0the\u00a0submissions\u00a0made\u00a0by\u00a0learned\u00a0counsel\u00a0for\u00a0the\u00a0<br \/>\napplicants,\u00a0learned\u00a0A.G.A.\u00a0and\u00a0from\u00a0the\u00a0perusal\u00a0of\u00a0the\u00a0record\u00a0it\u00a0<br \/>\nappears \u00a0 that \u00a0 the \u00a0 learned \u00a0 Special \u00a0 C.J.M. \u00a0 Kanpur \u00a0 Nagar \u00a0 has\u00a0<br \/>\npassed \u00a0 the \u00a0 order \u00a0 of \u00a0 re\u00adinvestigation, \u00a0 the \u00a0 order \u00a0 of \u00a0 re\u00ad<br \/>\ninvestigation \u00a0 can \u00a0 not \u00a0 be \u00a0 passed, \u00a0 the \u00a0 order \u00a0 of \u00a0 further\u00a0<br \/>\ninvestigation\u00a0can\u00a0be\u00a0passed\u00a0in\u00a0such\u00a0a\u00a0case,\u00a0therefore,\u00a0the\u00a0order\u00a0<br \/>\ndated \u00a0 21.8.2009 \u00a0 passed \u00a0 by \u00a0 learned \u00a0 special \u00a0 C.J.M. \u00a0 Kanpur\u00a0<br \/>\nNagar\u00a0is\u00a0modified\u00a0to\u00a0the\u00a0extent\u00a0that\u00a0the\u00a0I.O.\u00a0shall\u00a0do\u00a0the\u00a0further\u00a0<br \/>\ninvestigation\u00a0 in \u00a0 the \u00a0 above\u00a0 mentioned\u00a0 case\u00a0 crime\u00a0 no.\u00a0 540\u00a0 of\u00a0<br \/>\n2008.\n<\/p>\n<p>It \u00a0 is \u00a0 further \u00a0 directed \u00a0 that \u00a0 applicants \u00a0 move \u00a0 application \u00a0 for\u00a0<br \/>\nappearance\/\u00a0 surrender\u00a0 before\u00a0 the\u00a0 court\u00a0 concerned\u00a0 within\u00a0 30\u00a0<br \/>\ndays\u00a0from\u00a0today\u00a0on\u00a0which\u00a0the\u00a0court\u00a0concerned\u00a0shall\u00a0fix\u00a0the\u00a0date\u00a0<br \/>\nof\u00a0surrender\/appearance,\u00a0in\u00a0the\u00a0meantime\u00a0the\u00a0court\u00a0concerned\u00a0<br \/>\nshall\u00a0seek\u00a0the\u00a0instructions\u00a0from\u00a0the\u00a0prosecution\u00a0side.\u00a0In\u00a0case\u00a0<br \/>\nthe\u00a0applicant\u00a0moves\u00a0the\u00a0application\u00a0for\u00a0bail\u00a0on\u00a0the\u00a0day\u00a0of\u00a0the\u00a0<br \/>\nappearance\u00a0or\u00a0 surrender,\u00a0the\u00a0same\u00a0shall\u00a0be\u00a0considered\u00a0and\u00a0<br \/>\ndisposed\u00a0of\u00a0on\u00a0the\u00a0same\u00a0day\u00a0by\u00a0the\u00a0courts\u00a0below\u00a0and\u00a0for\u00a015\u00a0<br \/>\ndays\u00a0the\u00a0N.B.W.\u00a0issued\u00a0against\u00a0the\u00a0applicants\u00a0shall\u00a0be\u00a0kept\u00a0in\u00a0<br \/>\n abeyance..\n<\/p>\n<p>With\u00a0this\u00a0direction,\u00a0this\u00a0application\u00a0is\u00a0finally\u00a0disposed\u00a0of.<br \/>\nOrder Date :- 12.1.2010<br \/>\nRPD\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Rajendra Singh And Others vs State Of U.P.
