Justice K.K.DENESAN\n\n Dated :13\/12\/2006\n\n O R D E R\n                            K.K.DENESAN, J.\n\n                    -----------------------------\n\n                        WP(C)No. 30797 OF 2006\n\n                    -----------------------------\n\n                 Dated this the 13th December, 2006.\n\n\n\n                                 JUDGMENT\n<\/pre>\n<p>      The   petitioner   is   a   candidate   included   in   the<\/p>\n<p>supplementary   list   of   Scheduled   Caste   for   appointment   to<\/p>\n<p>the   post   of   Assistant   Engineer   (electrical)   in   the   Kerala<\/p>\n<p>State   Electricity   Board.     The   grievance   of   the   petitioner<\/p>\n<p>is  that   one   NJD   vacancy   which   arose   during   the   currency   of<\/p>\n<p>the list was not promptly reported by the KSEB and that has<\/p>\n<p>caused   problems   for   the   petitioner.     It   is   also   contended<\/p>\n<p>that   the   vacancy   was   subsequently   reported   by   the   KSEB   on<\/p>\n<p>30.10.2006   and   notwithstanding   the   validity   of   the   list,<\/p>\n<p>the Commission refused to advise the petitioner who was the<\/p>\n<p>next candidate to be advised for appointment.\n<\/p>\n<p>      2.        Counsel   for   the   Commission   submits   that   the<\/p>\n<p>petitioner   could   not   be   advised   for   appointment   since   the<\/p>\n<p>main   list   had   been   exhausted   on   19.9.2006   and   the   vacancy<\/p>\n<p>reported   on   30.10.2006   for   the   advice   of   a   candidate   from<\/p>\n<p>the supplementary list was of no use.  It is also submitted<\/p>\n<p>that in the light of the decision of the apex Court in <a href=\"\/doc\/1164866\/\">Nair<\/p>\n<p>Service   Society   v.   District   Officer,   Kerala   Public   Service<\/p>\n<p>Commission<\/a>      {2003(3)   KLT   1126},   the   supplementary   list<\/p>\n<p>cannot be operated after candidates from the main list have<\/p>\n<p><span class=\"hidden_text\">WPC 30797\/2006                      2<\/span><\/p>\n<p>been   exhausted.       The   petitioner   is   not   entitled   for   the<\/p>\n<p>reliefs.
