Justice M.SASIDHARAN NAMBIAR\n\n Dated :06\/10\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n              ------------------------------------------\n               CRL.M.C.NO.3091 OF 2009\n              ------------------------------------------\n               Dated       6th    October 2009\n\n                           O R D E R\n<\/pre>\n<p>           Petitioner is the accused in C.C.112\/2008<\/p>\n<p>now pending as L.P.13\/2009 on the file of                    Judicial<\/p>\n<p>First  Class  Magistrate-II,             Perinthalmanna.         This<\/p>\n<p>petition  is  filed     under       Section        482   of  Code  of<\/p>\n<p>Criminal Procedure      to quash the proceedings against<\/p>\n<p>the petitioner contending that entire disputes                   with<\/p>\n<p>first respondent was settled amicably.<\/p>\n<p>         2.     First        respondent appeared through a<\/p>\n<p>counsel and also filed Annexure-A2 affidavit stating<\/p>\n<p>that entire disputes were settled                    amicably and in<\/p>\n<p>such circumstances, he has no objection for quashing<\/p>\n<p>the proceedings.\n<\/p>\n<pre>         3.   Learned            counsel            appearing     for\n\npetitioner,  first      respondent           and      learned  Public\n\nProsecutor were heard.\n\n<\/pre>\n<p>         4.    Annexure-A1 final report based on which<\/p>\n<p>cognizance  for the offence under Sections 341, 323<\/p>\n<p>and 294(b) of Indian Penal Code was taken shows that<\/p>\n<p>prosecution  case is that on 16\/6\/2007 at 7 p.m                 first<\/p>\n<p><span class=\"hidden_text\">CRMC 3091\/09                 2<\/span><\/p>\n<p>respondent was wrongfully restrained and  simple hurt was<\/p>\n<p>caused on him by beating on his face and also uttered<\/p>\n<p>obscene words and thereby committed the offences under<\/p>\n<p>Sections 341, 323 and 294(b) of Indian Penal Code. Except<\/p>\n<p>the offence under Section 294(b)   of Indian Penal Code,<\/p>\n<p>the other offences are compoundable under Section 320 of<\/p>\n<p>Code of Criminal Procedure. Offence under Section 294(b)<\/p>\n<p>of Indian Penal Code as alleged is purely personal     as<\/p>\n<p>against first respondent. Annexure-II affidavit filed by<\/p>\n<p>first respondent establish that though it is not a<\/p>\n<p>compoundable offence, entire disputes were settled and<\/p>\n<p>first respondent   is not intending to proceed with the<\/p>\n<p>case, as he has no subsisting        grievance. In such<\/p>\n<p>circumstances, even if petitioner is to be tried,  chance<\/p>\n<p>of a successful conviction is very bleak. As held by the<\/p>\n<p>Apex court in <a href=\"\/doc\/1442974\/\">Madan Mohan Abbot v. State of Punjab<\/a> (2008<\/p>\n<p>(3) KLT 19 (SC) in such circumstances, it is not in the<\/p>\n<p>interest of justice to proceed with the case.<\/p>\n<p>          Petition is allowed.
