SAHAI\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate<\/a>\n: 06\/09\/2011 \n\n \n\n \n \n\t\t\t\t\tORAL\nJUDGMENT<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE KS JHAVERI)<\/p>\n<p>1.\t\tBy<br \/>\nway of this petition, the petitioner has challenged the judgment of<br \/>\nthe Central Administrative  Tribunal, Ahmedabad dated 23.3.2004 in<br \/>\nO.A.No. 521 of 2003.\n<\/p>\n<p>2.\t\tThe<br \/>\nOriginal Application preferred by the petitioner was rejected. While<br \/>\nconsidering the case, the Tribunal in paragraph 9.6 has observed as<br \/>\nunder:\n<\/p>\n<p>&#8220;6. In the<br \/>\npresent case, the order impugned has been passed by the Prasar<br \/>\nBharati and the respondents are also officers of the Prasar Bharati<br \/>\nincluding Union of India which has been made party through Director<br \/>\nGeneral, All India Radio, Prasar Bharati Corporation. Thus, the<br \/>\ndepartment of Information and Broadcasting Corporation, Government of<br \/>\nIndia has not been made a party.&#8221;\n<\/p>\n<p>Further,<br \/>\nin paragraph 4.3 of the affidavit-in-reply, it has been categorically<br \/>\nstated that the case of petitioner was considered thrice.
