No. 98 of 2009 were constrained to prefer<br \/>\n\tapplication under Section 163-A of the M.V. Act claiming<br \/>\n\tRs.4,08,500\/- on account of the death of deceased, who died on<br \/>\n\taccount of vehicular accident occurred on 31st October,<br \/>\n\t2008, when he was going on Motorcycle bearing registration No.<br \/>\n\tGJ-23-K-7575 as a pillion rider. The deceased was going with one<br \/>\n\tBhagwanbhai, who was riding the Motorcycle. On account of said<br \/>\n\taccident, the deceased was unconscious and he was moved to the<br \/>\n\thospital wherefrom, in the same condition, he was taken to home.<br \/>\n\tAfter being shifted at his residence, within 6 days he died. On<br \/>\n\taccount of ignorance, no P.M. was performed nor was it requested to<br \/>\n\tbe performed. The dependent-claimants preferred MACP No. 98 of 2009<br \/>\n\tunder Section 163A of the M.V. Act. The Insurance Policy is of the<br \/>\n\tcomposite policy and that fact was not disputed. The Tribunal after<br \/>\n\tappreciating the facts and evidence and law on the point, partly<br \/>\n\tallowed the claim petition and awarded sum of Rs.3,06,911\/- together<br \/>\n\twith proportionate costs and interest at the rate of 9% p.a from the<br \/>\n\tdate  of the application till realization. Being aggrieved and<br \/>\n\tdissatisfied with the award and judgment dated 30th June,<br \/>\n\t2010, the appellant preferred this appeal for the reasons stated<br \/>\n\ttherein.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Shri M.S. Shah appearing for the appellant contended that<br \/>\n\tthe First Information Report is not filed, meaning thereby, no<br \/>\n\toffence is registered in respect of the occurrence of the incident<br \/>\n\tin question. The Insurance Company in its written statement raised a<br \/>\n\tspecific plea with regard to the serious doubt of the insured<br \/>\n\tvehicle being involved in the accident and therefore, it was the<br \/>\n\tduty cast upon the Tribunal to appreciate the said contention in its<br \/>\n\ttrue perspective. He further submitted that the deceased had been<br \/>\n\ttaken home and he died at his residence. Deceased&#8217;s widow<br \/>\n\tSavitaben, had deposed through affidavit, wherein, it has come out<br \/>\n\tclearly that vehicle was not driven properly and on account of<br \/>\n\tvehicular accident, her husband died and he was taken home from the<br \/>\n\thospital and within short period thereafter, he died. The PM was<br \/>\n\talso not requested to be performed so as to make out a cause for<br \/>\n\tdeath. Thus, there being no evidence with regard to the deceased&#8217;s<br \/>\n\tdeath occurring on account of vehicular accident and therefore, the<br \/>\n\tTribunal ought not to have allowed the claim petition. The certified<br \/>\n\tcopy of the affidavit and cross-examination of Savitaben is taken on<br \/>\n\trecord.\n<\/p>\n<p>The<br \/>\n\tCourt is unable to accept the submission of learned advocate for the<br \/>\n\tappellant for the following reasons.\n<\/p>\n<p>The<br \/>\n\tnarration of the entire incident, as it emerged from the claim<br \/>\n\tpetition as well as the testimony of the widow, which has came by<br \/>\n\tway of affidavit and her cross-examination, conclusively go to show<br \/>\n\tthat the appellant did not seriously dispute the accident nor did<br \/>\n\tthey dispute the involvement of the insured vehicle, had this being<br \/>\n\tthe case, then, the cross-examination would not have ended with only<br \/>\n\ttwo questions, which have been in respect of the widow has not seen<br \/>\n\tthe accident in question from her own eye. The widow has narrated<br \/>\n\tthe entire incident in detail and fact that deceased had been<br \/>\n\tunconscious and he was in that state, taken to the hospital,<br \/>\n\ttherefrom, as he was not recovering, he had to be shifted to home on<br \/>\n\taccount of poor condition and without recovering consciousness, the<br \/>\n\tdeceased died within 6 days from the date of he being shifted to<br \/>\n\thome. These all facts clearly go to show that the involvement of the<br \/>\n\tinsured vehicle in the accident cannot be said to be doubtful as<br \/>\n\tsought to be canvassed by learned advocate for the appellant. The<br \/>\n\tnon-filing of the FIR in itself cannot be said to be so grave lapse<br \/>\n\ton the part of the claimants and\/or the concerned so as to defeat<br \/>\n\tthe just and proper compensation on account of death of the deceased<br \/>\n\tin vehicular accident. The decision relied upon by the Tribunal in<br \/>\n\tcase of  Gujarat State Road Transport Corporation Vs.<br \/>\n\tMariambai A. Adamji (since deceased) through his heirs and Lrs.<br \/>\n\tZubeda Abdulhabib &amp; Anr., reported in 2003(1) GLR<br \/>\n\t574 is applicable to the facts and situation of the case. This Court<br \/>\n\tis of the view that the question with regard to witness not being an<br \/>\n\teye-witness, in itself is not sufficient to discard her involvement<br \/>\n\twith regard to insured vehicle in question. The reasoning and<br \/>\n\tfindings of the Tribunal, therefore, deserves to be appreciated.
