DAVE\n\t\t\n\t\n\n \n\nDate\n: 08\/09\/2008 ORAL JUDGMENT<\/pre>\n<p>1\tRule.\n<\/p>\n<p>Learned counsel, Mr. K.B. Pujara waives service of Rule on behalf of<br \/>\nthe respondent. At the request of learned counsel for the parties,<br \/>\nthis petition is taken up for final hearing.\n<\/p>\n<p>2\tThis<br \/>\npetition under Articles 226 and 227 of the Constitution of India is<br \/>\nfiled by the petitioner, who claims to have purchased a flat from one<br \/>\nRajendrakumar Gokulprashad Aherwal on 9th June 2007 by way<br \/>\nof power of attorney and sale agreement, for the following relief:\n<\/p>\n<p>?SYour<br \/>\nLordships be pleased to issue appropriate writ of mandamus,<br \/>\ncertiorari, prohibition, or any other suitable writ, order in the<br \/>\nnature of writ of mandamus to direct the respondent to give<br \/>\nelectricity supply to the petitioner at the premise.??\n<\/p>\n<p>3\tIt<br \/>\nis averred in the petition that the erst-while owner, Rajendrakumar<br \/>\nGokulprashad Aherwal [old consumer] had illegally utilized<br \/>\nelectricity and a case under Section 135(1)(b) of the Electricity<br \/>\nAct, 2003 [for short, &#8216;the Act&#8217;] came to be registered against him,<br \/>\nand, ultimately, the competent Court under the Act sentenced said<br \/>\nRajendrakumar Gokulprashad Aherwal  to undergo R.I. for two years and<br \/>\nfine of Rs.4,50,000\/- by judgment and order dated 26th<br \/>\nJune 2007 in Electricity Special Criminal Case No.8 of 2007. Against<br \/>\nthe order, Rajendrakumar Gokulprashad Aherwal  filed Criminal Appeal<br \/>\nNo.995 of 2007 with Criminal Misc. Application No.8413 of 2007 in<br \/>\nthis Court and Rajendrakumar Gokulprashad Aherwal  was granted<br \/>\nconditional bail of depositing Rs.1 lakhs.\n<\/p>\n<p>4\tThe<br \/>\npetitioner purchased flat No.48\/556, Vaishali Flat, Gujarat Housing<br \/>\nBoard, Bapunagar, Ahmedabad, [for short &#8216;the said flat&#8217;] from<br \/>\nRajendrakumar Gokulprashad Aherwal  by virtue of unregistered<br \/>\nagreement to sell dated 9.6.2007 and general power of attorney dated<br \/>\n9.6.2007. Whether the transfer of the said flat by the above mode is<br \/>\nlegal or not is a different question, but the fact remains that the<br \/>\noutstanding energy dues of the electricity company relatable to  the<br \/>\nsaid flat remains unpaid by the  erstwhile owner.\n<\/p>\n<p>5\tThe<br \/>\nlearned counsel for the petitioner submits that the petitioner is not<br \/>\nliable to pay the outstanding dues of the  erstwhile owner  and the<br \/>\nElectricity Company is duty bound to provide electricity connection<br \/>\nto the petitioner who is occupying the said flat by virtue of<br \/>\nunregistered agreement to sell dated 9.6.2007 and general power of<br \/>\nattorney dated 9.6.2007.\n<\/p>\n<p>6\tUpon<br \/>\na query posed before the learned counsel for the petitioner whether<br \/>\npetitioner has right to seek electricity connection to a flat whose<br \/>\nerstwhile owner has not paid outstanding dues to the electricity<br \/>\ncompany and, under what provisions of the Act, the petitioner can<br \/>\nchallenge the refusal of electricity connection,  the learned counsel<br \/>\nfor the petitioner is unable to satisfy this Court.\n<\/p>\n<p>7\tMr.\n<\/p>\n<p>K.B. Pujara, learned counsel for the respondent-Electricity Company,<br \/>\nhas heavily relied upon the affidavit-in-reply filed by the Manager<br \/>\nof the Electricity Company and submitted that the erst-while owner<br \/>\nhad committed theft of electricity and was sentenced  to undergo R.I.<br \/>\nfor two years and fine of Rs.4,50,000\/- by judgment and order dated<br \/>\n29th June 2007 in Electricity Special Criminal Case No.8<br \/>\nof 2006 and, in appeal, he was granted bail, but the fact remains<br \/>\nthat the dues of the electricity company still remain outstanding.<br \/>\nMr. K.B. Pujara has relied upon Section 43 of the Act and submitted<br \/>\nthat the distribution licencee shall give supply of  electricity to<br \/>\n&#8216;the premises&#8217; and, therefore, the energy dues are relatable to the<br \/>\npremise where supply is granted and not certainly to the owner or<br \/>\noccupier of the premises. He further submits that Regulations 4.1.11,<br \/>\n4.8.3 and 8.7.5 of the Supply Code confer certain rights upon the<br \/>\ndistribution licensee and, in case of default of electricity dues,<br \/>\nsupply of electricity to the said premise may be disconnected. He,<br \/>\ntherefore,submits that the petitioner has no right to seek<br \/>\nelectricity connection  to the said flat whose  erstwhile owner has<br \/>\nnot paid outstanding dues to the electricity company.\n<\/p>\n<p>8\tIt<br \/>\ntranspires from the record that the petitioner has got possession of<br \/>\nthe said flat  by virtue of unregistered agreement to sell  and<br \/>\ngeneral power of attorney both dated 9th June 2007,<br \/>\nwhereas the the erst-while owner of the said flat  was convicted and<br \/>\nsentenced   by judgment and order dated 29th June 2007 in<br \/>\nElectricity Special Criminal Case No.8 of 2006. However,  the learned<br \/>\ncounsel for the petitioner is not able to show any specific<br \/>\nprovisions of the Act under which a right accrues to the petitioner<br \/>\nto seek electricity connection, or, under which provisions of the<br \/>\nAct, he can challenge refusal to supply electricity to the said flat,<br \/>\nwhose erst-while owner  committed theft of electricity and was<br \/>\nsentenced  to undergo R.I. for two years and fine of Rs.4,50,000\/- by<br \/>\njudgment and order dated 29th June 2007 in Electricity<br \/>\nSpecial Criminal Case No.8 of 2006.  Therefore, the<br \/>\nrespondent-Electricity Company cannot be restrained from exercising<br \/>\nits statutory right to disconnect the supply and keep the supply<br \/>\ndiscontinued until the outstanding dues of electricity remain unpaid.<br \/>\nOn a perusal of  Regulations 4.1.11, 4.8.3 and 8.7.5,  it is clear<br \/>\nthat the refusal on the part of the Electricity Company  to provide<br \/>\nelectricity connection to the said flat of the petitioner is just and<br \/>\nproper and cannot be said to be, in any way, unreasonable, arbitrary<br \/>\nor violative of Articles 14 and 19 of the Constitution of India.\n<\/p>\n<p>9\tThe<br \/>\nissue involved in the case of M\/s. Isha Marble vs. Bihar State<br \/>\nElectricity Board, JT 1995 (2) SC 626 and <a href=\"\/doc\/467667\/\">M\/s. Sarvodaya Corporation<br \/>\nvs.  Gujarat Electricity Board,<\/a> 1995 (1) GLR 196, whether electricity<br \/>\ndues constitute a charge on the property so far as transferor and<br \/>\ntransferee of the unit is concerned, is referred to the Larger Bench<br \/>\nof the Apex Court. In the cognate matter, being Special Leave to<br \/>\nAppeal [C] No. 10732 of 2006 in the case of <a href=\"\/doc\/1571031\/\">Maharashtra State<br \/>\nElectricity Board vs. MJ\/s. Jai Tirath Financiers Private Limited,<br \/>\nthe Apex Court<\/a> has stayed the order of the High Court. Hence the<br \/>\nreliance placed by the learned counsel for the petitioner on the<br \/>\nabove-referred decisions is of no help.\n<\/p>\n<p>10\tIn<br \/>\nthe result, this petition has no substance and is rejected. Rule is<br \/>\ndischarged with no order as to costs.\n<\/p>\n<p>(ANANT<br \/>\nS.
