M.P.S.Chuckal, counsel for the applicant.\n      None for respondents.<\/pre>\n<p>      By this application,the applicant is seeking review\/recall of<br \/>\nthe order dated 14.7.2006 passed by the Division Bench of this<br \/>\nCourt in Misc.Appeal No.40 of 2001.\n<\/p>\n<p>      By the aforesaid order, this Court while deciding the matter<br \/>\ndirected thus:\n<\/p>\n<blockquote><p>        &#8220;6.    In the present case as stated hereinabove the Court<br \/>\n        while remanding the matter vide order dated 5.11.1998<br \/>\n        fixed the date of hearing before the Arbitrator as<br \/>\n        20.11.1998 and both the parties were directed to remain<br \/>\n        present before the Arbitrator. On 20.11.1998 some of the<br \/>\n        parties appeared but the Arbitrator was not available as he<br \/>\n        was on official tour and the Reader fixed the date as<br \/>\n        30.11.1998.      Though the respondents were having<br \/>\n        knowledge but as the date was fixed by the Reader the<br \/>\n        Arbitrator ought to have noticed to the respondents when<br \/>\n        they were not present on the next date. Thereafter<br \/>\n        various applications were received by the Arbitrator for<br \/>\n        grant of short adjournment. The order dated 5.11.1998<br \/>\n        was challenged before the High Court and respondents<br \/>\n        were expecting some orders from the High Court, and<br \/>\n        were continuously sending letters to the Arbitrator. The<br \/>\n        Arbitrator while turning down the aforesaid prayer ought to<br \/>\n        have seen the fact that previous order sheets were written<br \/>\n        by the Reader. Even after rejecting the prayer made by<br \/>\n        the respondents in the aforesaid application an intimation<br \/>\n        ought to have been sent to the respondents. In place of<br \/>\n        adopting the aforesaid procedure the Arbitrator proceeded<br \/>\n        in the matter and passed the exparte award. In these<br \/>\n        peculiar facts the Court below has considered the matter<br \/>\n        and found that the principles of natural justice has been<br \/>\n        violated in the matter, has set aside the award and<br \/>\n        remanded the case to the Arbitrator. Another aspect of<br \/>\n        the matter is that the Arbitrator has not complied with the<br \/>\n        remand order passed by the Court dated 5.11.1998. Even<br \/>\n        for arguments it is assumed that respondents were having<br \/>\n        knowledge in respect of date of hearing fixed, and after<br \/>\n        proceeding exparte the Arbitrator ought to have decided<br \/>\n        the matter in compliance of remand order, failing which the<br \/>\n        Arbitration award itself was liable to be set aside, on this<br \/>\n        ground. In the aforesaid circumstances if the Court below<br \/>\n        has considered the aspect in both the perspective and<br \/>\n        remanded the matter with an opportunity to the<br \/>\n            respondents to appear and to participate           in   the<br \/>\n           proceedings, no fault is found in the order.\n<\/p><\/blockquote>\n<blockquote><p>           7.    This appeal against the aforesaid remand order has<br \/>\n           no merit and accordingly it is dismissed. However, the<br \/>\n           parties present herein are directed to remain present<br \/>\n           before the Arbitrator on 21st of August, 2006 for which<br \/>\n           date no notice shall be necessary to the parties by the<br \/>\n           Arbitrator. Before the Arbitrator respondents shall remain<br \/>\n           present on each and every date of hearing.             The<br \/>\n           Arbitrator shall decide the matter expeditiously after<br \/>\n           complying the order passed by the Court below dated<br \/>\n           2.12.2000 and also order dated 5.11.1998 passed in<br \/>\n           previous round.&#8221;<\/p><\/blockquote>\n<p>          It is submitted by Smt. Chuckal that by the aforesaid order<br \/>\nparties were directed to appear before the Arbitrator              on 21st<br \/>\nAugust, 2006. Earlier the Managing Director of the applicant was<br \/>\nthe Arbitrator under the agreement. It is submitted by Smt.<br \/>\nChuckal that now this Madhya Pradesh Film Development<br \/>\nCorporation Limited has been merged with the Department of<br \/>\nExcise and there is no Managing Director of the Corporation. So,<br \/>\nfor deciding the dispute, some independent arbitrator may be<br \/>\nappointed. It is suggested by Smt. Chuckal that a former Judge of<br \/>\nMadhya Pradesh High Court, Bench Gwalior may be appointed as<br \/>\nan arbitrator to decide the matter finally.\n<\/p>\n<p>          As none is appearing for the respondents, and we do not<br \/>\nfind any reason not to accept the contention of Smt. Chuckal, the<br \/>\ncounsel appearing for the applicant, hence prayer made in this<br \/>\napplication is allowed.\n<\/p>\n<p>          Justice Shri R.B.Dixit, the former Judge of this Court, is<br \/>\nappointed as an Arbitrator, who shall proceed in the matter as per<br \/>\norder dated 14.7.2006 passed by this Court in M.A. No.40 of<br \/>\n2001. Necessary record of the Arbitration Proceedings shall be<br \/>\ntransmitted by the applicant to the aforesaid Arbitrator.
