APP (DB) No.1268 of 2010\n                         MUNI YADAV @ MUNNI YADAV\n                                        Versus\n                                  STATE OF BIHAR\n                                      -----------\n<\/pre>\n<p>2   3.11.2010             This criminal Appeal has been filed by one<\/p>\n<p>                Muni Yadav alias Munni Yadav challenging the<\/p>\n<p>                judgment and order dated      24.9.2010 and 28.9.2010<\/p>\n<p>                respectively passed in Sessions Trial No. 841 of 2009 by<\/p>\n<p>                the Additional Sessions Judge, FTC No.I, Banka,<\/p>\n<p>                convicting the appellant and others under Section 302\/34<\/p>\n<p>                of the Indian Penal Code and sentenced to undergo<\/p>\n<p>                rigorous imprisonment for six years for offence under<\/p>\n<p>                Section 201 of the Indian Penal Code and R.I. for life<\/p>\n<p>                for his conviction under Section 302\/34 of the Indian<\/p>\n<p>                Penal Code.\n<\/p>\n<p>                          The impugned judgment of the trial Court has<\/p>\n<p>                been challenged by the appellant on various grounds;<\/p>\n<p>                One of the grounds being      that the trial Court has<\/p>\n<p>                convicted the appellant considering the evidence of such<\/p>\n<p>                witnesses who were not in fact examined in Sessions<\/p>\n<p>                Trial No. 841 of 2009 but examined in Sessions Trial<\/p>\n<p>                No. 435 of 2009 which also arises out of same police<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>case that Banka P.S. case No. 537 of 2008). The sessions<\/p>\n<p>trials were split up and accused persons were being tried<\/p>\n<p>separately in two Sessions Trials. The reason assigned by<\/p>\n<p>the trial Court for not examining those witnesses in the<\/p>\n<p>present Sessions Trial but taking advantage of the<\/p>\n<p>evidence adduced in another sessions trial has been<\/p>\n<p>discussed in para 7 of the judgment. It has been admitted<\/p>\n<p>in para 7 of the judgment that charge-sheet witness no.7<\/p>\n<p>Ram Bilas Roy examined as P.W.6, P.W.4, P.W.5 and<\/p>\n<p>P.W.3 respectively in Sessions Case No. 435 of 2009<\/p>\n<p>arising out of the same P.S. case has not been examined<\/p>\n<p>in the trial in hand, but in view of the provisions of<\/p>\n<p>Section 33 of the Indian Evidence Act their evidences<\/p>\n<p>can be used in this trial also to the limited extent in view<\/p>\n<p>of the fact that the present trial is the subsequent<\/p>\n<p>proceeding of the same judicial proceeding and further<\/p>\n<p>since the said witnesses have neither been found nor<\/p>\n<p>examined being kept out of the way by the adversary. It<\/p>\n<p>has also been stated that the witnesses are not being<\/p>\n<p>examined since their presence was not possible to be<\/p>\n<p>obtained without an amount of delay and there is a<\/p>\n<p>direction of the High Court to dispose of the trial<br \/>\n<span class=\"hidden_text\">                    3<\/span><\/p>\n<p>preferably within nine months from 27.11.2009.<\/p>\n<p>          Counsel for the appellant submits that leaving<\/p>\n<p>apart other grounds, this ground is sufficient for setting<\/p>\n<p>aside the impugned judgment. The conditions which is<\/p>\n<p>provided under Section 33 of the Indian Evidence Act,<\/p>\n<p>for using evidence of witnesses non examined the<\/p>\n<p>proceeding in question, were not at all application in the<\/p>\n<p>present case. Despite this fact, the trial court have passed<\/p>\n<p>a judgment of conviction, using evidence of non<\/p>\n<p>examined witnesses.\n<\/p>\n<p>          Section 33 of the Indian Evidence Act relates<\/p>\n<p>to relevancy of certain evidence for proving the issue<\/p>\n<p>involved, in subsequent proceeding. This section<\/p>\n<p>provides circumstance in which evidence given by a<\/p>\n<p>witness in another judicial proceeding can be considered<\/p>\n<p>as relevant for the purposes of proving in a subsequent<\/p>\n<p>judicial proceeding or in a later stage of the same judicial<\/p>\n<p>proceeding. The conditions are, when witness is dead or<\/p>\n<p>cannot be found or incapable of giving evidence, or is<\/p>\n<p>kept out of the way by the adverse party, or if his<\/p>\n<p>presence cannot be obtained without an amount of delay<\/p>\n<p>or expense which, under the circumstances of the case is<br \/>\n<span class=\"hidden_text\">                   4<\/span><\/p>\n<p>not viable.&#8221;\n<\/p>\n<p>           The provision mentioned under Section 33 of<\/p>\n<p>the Indian Evidence Act, despite fulfillment of<\/p>\n<p>circumstances mentioned can be made applicable,<\/p>\n<p>provided the proceeding is in between the same party or<\/p>\n<p>their representatives in interest, or the adverse party in<\/p>\n<p>the first proceeding had the right and opportunity to<\/p>\n<p>cross-examine the witnesses,; or the questions in issue<\/p>\n<p>were substantially the same in the first as in the second<\/p>\n<p>proceeding.\n<\/p>\n<p>          Apparently none of the conditions mentioned<\/p>\n<p>in the section 33 as well as its proviso were available to<\/p>\n<p>the trial Court in the facts and circumstance of the<\/p>\n<p>present case. The parties were not the same. The adverse<\/p>\n<p>parties have not been given opportunity to cross-examine<\/p>\n<p>the witness examined in another proceeding and there<\/p>\n<p>was nothing to show that the witnesses were withheld by<\/p>\n<p>the adversary from being examined before the Trial<\/p>\n<p>Court. The reason which has been assigned by the trial<\/p>\n<p>Court indicates completely non application of judicial<\/p>\n<p>mind as well as finding recorded against the provision of<\/p>\n<p>law.\n<\/p>\n<p><span class=\"hidden_text\">                              5<\/span><\/p>\n<p>                    Without considering any other grounds taken<\/p>\n<p>          by the appellant challenging the impugned judgment, we<\/p>\n<p>          are of the view that the judgment of conviction and the<\/p>\n<p>          order of sentence passed by the trial Court in Sessions<\/p>\n<p>          Trial No. 841 of 2009 is fit to be set aside and it demands<\/p>\n<p>          re-trial of the accused persons in Sessions Trial No. 841<\/p>\n<p>          of 2009 by following the procedure in accordance with<\/p>\n<p>          law.\n<\/p>\n<p>                    Accordingly the impugned judgment is set<\/p>\n<p>          aside.
