The size and details concerning       -As above-\n<\/p>\n<blockquote><p>          the height and number of floors<br \/>\n          of the shops in Amrit Kour Mkt.<br \/>\n          Ram Nagar, M.M.Road, Thana,<br \/>\n          under the S.P.Zone area.<br \/>\n          Accompanied by the Proprietary<br \/>\n          rights of the same.\n<\/p><\/blockquote>\n<p>The First Appellate Authority ordered.\n<\/p>\n<p>Not replied.\n<\/p>\n<p>Relevant Facts emerging during Hearing:\n<\/p>\n<p>The following were present<br \/>\nAppellant : Mr. Harish Kumar<br \/>\nRespondent : Absent<br \/>\nThe appellant states that the reply of the PIO dated 28\/05\/2008 has been posted on 27\/06\/2008.<br \/>\nHe has attached the copy of the speed post envelope and receipt with the appeal. He also states<br \/>\nthat the information has not been provided completely. The appellant is willing to inspect the<br \/>\nrecords.\n<\/p>\n<p>The First Appellate Authority is guilty of dereliction of duty by not passing any order on the<br \/>\nappeal.\n<\/p>\n<p>The PIO appears to have sent the reply on 27\/06\/2008 that is 30 days later than the required date.<br \/>\n Decision:\n<\/p>\n<p>The Appeal is allowed.\n<\/p>\n<p>The Commission directs the PIO to facilitate the inspection of records on points 1<br \/>\nto 6 of the RTI query before 30 May 2009. If the appellant wants photocopy of the<br \/>\nrecords the PIO will provide upto 100 pages free of cost.<br \/>\nThe issue before the Commission is of not supplying the complete, required information by<br \/>\nthe PIO Mr. Ved Prakash Asst. Commission L&amp;E, within 30 days as required by the law.<br \/>\nFrom the facts before the Commission it is apparent that the PIO is guilty of not furnishing<br \/>\ninformation within the time specified under sub-section (1) of Section 7 by not replying within<br \/>\n30 days, as per the requirement of the RTI Act. He has given the reply 30 days late. It appears<br \/>\nthat the PIO&#8217;s actions attract the penal provisions of Section 20 (1) .<br \/>\nA showcause notice is being issued to him, and he is directed give his reasons to the Commission<br \/>\nto show cause why penalty should not be levied on him. The penalty le The issue before the<br \/>\nCommission is of not supplying the complete, required information by the PIO within 30<br \/>\ndays as required by the law.\n<\/p>\n<p>From the facts before the Commission it is apparent that the PIO is guilty of not furnishing<br \/>\ninformation within the time specified under sub-section (1) of Section 7 by not replying within<br \/>\n30 days, as per the requirement of the RTI Act. He has further refused to obey the orders of his<br \/>\nsuperior officer, which raises a reasonable doubt that the denial of information may also be<br \/>\nmalafide. The First Appellate Authority has clearly ordered the information to be given.<br \/>\nIt appears that the PIO&#8217;s actions attract the penal provisions of Section 20 (1) .<br \/>\nA showcause notice is being issued to him, and he is directed give his reasons to the Commission<br \/>\nto show cause why penalty should not be levied on him.\n<\/p>\n<p>He will give his written submissions showing cause why penalty should not be imposed on him<br \/>\nas mandated under Section 20 (1) before 5 June, 2009. He will also submit proof of having<br \/>\ngiven the information to the appellant.\n<\/p>\n<p>He will present himself before the Commission at the above address on 15 June 2009 at 4.30pm<br \/>\nalongwith his written submissions showing cause why penalty should not be imposed on him as<br \/>\nmandated under Section 20 (1). He will also submit proof of having given the information to<br \/>\nthe appellant. The penalty attracted by the PIO is at Rs. 250 per day of delay, ie.
