\tIn
\nthe facts and circumstances of the case and by consent of both the
\nsides, this matter is taken up for hearing today.\n<\/p>\n
2.\tThis
\nis an application for anticipatory bail under Section 438 of the Code
\nof Criminal Procedure in connection with the FIR bearing C.R. I No.70
\nof 2011 registered with Kadi Police Station, for the offences
\npunishable under Sections 326, 323, 504, 506(2) and 114 of Indian
\nPenal Code and Section 135 of the Bombay Police Act.\n<\/p>\n
3.\tLearned
\nadvocate Mr. Ansari for the applicants submitted that the applicants
\nare the innocent persons and they have been wrongly arraigned in the
\ncase of the prosecution. The applicants were not present at the place
\nof incident. The names of the applicants are falsely given by the
\ncomplainant. The accused No.1 and 2 have been released by the learned
\nSessions Court. Therefore, the applicants may kindly be granted
\nanticipatory bail by imposing suitable conditions.\n<\/p>\n
4.\tMs.\n<\/p>\n
Shah, learned Additional Public Prosecutor representing the State
\nsubmitted that from the bare reading of the complaint, prima facie,
\nit appears that the role is attributed on the part of the applicants.
\nConsidering the nature of offences in which the applicants are
\ninvolved as well as the manner in which the offences are committed by
\nthe applicants, the application deserves to be rejected.\n<\/p>\n
5.\tPerused
\nthe application along with papers and considered the submissions
\nadvanced by the learned advocate of respective parties and provisions
\nof the offence alleged, gravity of the offence andfFrom the papers,
\nprima facie, it appears that there is no direct evidence links the
\napplicants in the commission of the offence and even at this stage of
\nanticipatory bail, this Court is not entering into merit of the case.\n<\/p>\n
6.\tIn
\nview of the above facts and circumstances of the case, I am inclined
\nto exercise discretion in favour of the applicants.\n<\/p>\n
7.\tThe
\napplication is stands allowed. The applicants are granted
\nanticipatory bail in the event of his arrest in connection with CR
\nNo. I – 70 of 2011 registered with Kadi Police Station for the
\noffences as alleged in FIR on their executing  bond of Rs.10,000\/-
\neach [Rupees Ten thousand only] with one surety of the like amount on
\nthe following conditions that they shall:\n<\/p>\n
[a]\tco-operate
\nwith the investigation and make themselves available for
\ninterrogation whenever and wherever he required.\n<\/p>\n
[b]\tshall
\nremain present at the concerned Police Station on 5.10.2011
\nat 11.00 AM<\/p>\n
[c]\tshall
\nnot hamper the investigation in any manner nor shall directly or
\nindirectly make any inducement, threat or promise to any person
\nacquainted with the facts of the case so as to dissuade them from
\ndisclosing such facts to the Court or to any police officer;\n<\/p>\n
[d]\tat
\nthe time of execution of bond, furnish them residential address to
\nthe investigating officer and the Court concerned and shall not
\nchange the residence till the final disposal of the case or till
\nfurther orders;\n<\/p>\n
[e]\tnot
\nleave India without the permission of the Court and, if holding a
\npassport, they shall surrender the same before the Trial Court within
\na week;\n<\/p>\n
[f]\tnot
\nobstruct or hamper the police investigation and not play mischief
\nwith the evidence collected or yet to be collected by the police;\n<\/p>\n
8.\tIt
\nwould be open to the Investigating Officer to file an application for
\nremand if he considers it proper and just; and the competent Court
\nwould decide it on merits.\n<\/p>\n
9.\tIt
\nwould be open for the Investigating Agency to apply to the competent
\nMagistrate for police remand of the applicant. The applicant shall
\nremain present before the learned Magistrate on the first date of
\nhearing on such application and on all subsequent occasion, as may be
\ndirected by the learned Magistrate. This would be sufficient to treat
\nthe accused in the judicial custody for the purpose of entertaining
\napplication of the prosecution for police remand. This is, however,
\nwithout prejudice to the rights of the accused to seek stay against
\nan order of remand, if ultimately granted, and the power of the
\nlearned Magistrate to consider such a request in accordance with law.
\nIt is clarified that the applicant, even if remanded to the police
\ncustody upon completion of such period of police remand, shall be set
\nfree immediately, subject to other conditions of this anticipatory
\nbail order.\n<\/p>\n
10.\tAt
\nthe trial, the Trial Court shall not be influenced by the
\nobservations of preliminary nature, qua the evidence at this stage,
\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n
11.\tThe
\napplicant is permitted to obtain regular bail as per the established
\nprovision of law, within suitable time.\n<\/p>\n
\tRule
\nmade absolute. Direct service is permitted.\n<\/p>\n
