Application No.10563\/2010 dated<br \/>\n\t24.09.2010, which is produced at Annexure-C and submitted that it<br \/>\n\twas on the basis of the information and statement given by the<br \/>\n\tlearned A.P.P. that the applicant herein has violated the condition<br \/>\n\tby entering into the district and, thereafter, assaulted the victim,<br \/>\n\tit has led to passing of the order. However, he submitted that in<br \/>\n\tfact, when the incident has occurred, the applicant was permitted to<br \/>\n\tenter into the district as per the order passed in Criminal Misc.<br \/>\n\tApplication No.2122\/2010 dated 12.03.2011 by this Court (Coram :<br \/>\n\tZ.K. Saiyed, J.) and as per the said order, the said condition was<br \/>\n\tdeleted. Therefore, he submitted that ultimately the Court has to<br \/>\n\tconsider the facts and merits of the case, for which, he referred to<br \/>\n\tthe details and submitted that the applicant was only a driver and<br \/>\n\tother two persons, who are said to have assaulted the victim with<br \/>\n\tsword, have been released and the applicant had no enmity and as<br \/>\n\tstated, he is said to have assaulted on hand. He, therefore,<br \/>\n\tsubmitted that the present application may be allowed.\n<\/p>\n<p>Learned<br \/>\n\tA.P.P., Mr.Kodekar resisted the present application.\n<\/p>\n<p>Learned<br \/>\n\tcounsel, Mr.Mankad appearing for the original complainant resisted<br \/>\n\tthe present application and placed on record the affidavit-in-reply<br \/>\n\tcontending as to what has transpired. He tried to submit that the<br \/>\n\torder was passed by the Sessions Court permitted the accused to<br \/>\n\tenter into the district and being aggrieved by the said order,<br \/>\n\tCriminal Misc. Application No.2287\/2010 was preferred before this<br \/>\n\tCourt by the victim and this Court (Coram : A.S. Dave, J.) passed an<br \/>\n\torder in the said Criminal Misc. Application No.2287\/2010 setting<br \/>\n\taside the order modifying the condition  and immediately thereafter,<br \/>\n\tinspite of the said order, another Criminal Misc. Application<br \/>\n\tNo.2122\/2010 was preferred, wherein the order came to be passed. He,<br \/>\n\ttherefore, submitted that there is misleading the Courts on facts<br \/>\n\tand, therefore, the present application may not be entertained.<br \/>\n\tFurther, he submitted that the role is attributed to all the accused<br \/>\n\tand, therefore, the present application may not be entertained.\n<\/p>\n<p>Having<br \/>\n\theard learned Sr. Counsel, Mr.Raju for the applicant, learned<br \/>\n\tA.P.P., Mr.Kodekar for the respondent no.1-State and learned<br \/>\n\tcounsel, Mr.Mankad for the complainant and having considered the<br \/>\n\trival submissions, it transpires that when this Court has passed<br \/>\n\tearlier order in Criminal Misc. Application No.10563\/2010 dated<br \/>\n\t24.09.2010 (Annexure-C), the facts were not clarified that the<br \/>\n\tapplicant has been permitted to enter into district. Though the<br \/>\n\tlearned counsel, Mr.Mankad has stated that it was without hearing<br \/>\n\tthe complainant, the order came to be passed in Criminal Misc.<br \/>\n\tApplication No.2122\/2010 dated 22.03.2010 by the High Court, the<br \/>\n\tfact remains that coordinate bench has permitted the applicant to<br \/>\n\tenter into district modifying the order of the Sessions Court in<br \/>\n\tother offence. Therefore, it cannot be said that there is any breach<br \/>\n\tof any condition and if the complainant has any grievance, he could<br \/>\n\thave moved before the same bench for appropriate order. Therefore,<br \/>\n\tin the circumstances, what is required to be considered is the<br \/>\n\tmerits of the matter with regard to grant of bail considering the<br \/>\n\tbasic aspect\/criteria like nature of offence, manner in which it is<br \/>\n\talleged to have been committed, role attributed etc. The applicant,<br \/>\n\twho is a driver, is alleged to have assaulted with sword on hand and<br \/>\n\tcharge is for the offence under Section 307 of the Indian Penal<br \/>\n\tCode. At the same time, other co-accused are also alleged to have<br \/>\n\tassaulted the victim with sword and are released on bail. The<br \/>\n\tapplicant is admittedly a driver, who had no enmity with the victim.\n<\/p>\n<p>In<br \/>\n\tthe circumstances, when the other co-accused have been released; the<br \/>\n\tvictim is out of danger and is discharged, the present application<br \/>\n\tdeserves to be allowed.\n<\/p>\n<p>Accordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with I-C.R.No.84\/2010<br \/>\n\tregistered with Mundra Police Station on his executing a bond of<br \/>\n\tRs.5,000\/- (Rupees Five Thousand Only) with one solvent surety of<br \/>\n\tthe like amount to the satisfaction of the lower Court and subject<br \/>\n\tto the conditions that he shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court.\n<\/p>\n<p>(f)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p>(g)\tmark<br \/>\nhis presence before concerned Police Station 1st day of<br \/>\nevery calender month between 11:00 AM and 2:00 PM for a period six<br \/>\nmonths.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute.
