\tPetitioner
\nis the grand-father of an unfortunate girl named Saroj who admittedly
\ndied an unnatural death on 9.12.09.  Her dead body was found hanging
\nwith her dupatta tied to a hook from the ceiling of a ladies toilet
\nof the school where she was studying. The incident was reported by
\nthe school teacher to  the police. It however appears that since
\nprima faice  the scene suggested  suicide of the girl, no FIR has
\nbeen recorded. Police has inquired into the case of death and appears
\nto be of the opinion that the girl died by committing suicide.\n<\/p>\n
\tSince
\naccording to the petitioner, there were several suspicious
\ncircumstances and indicators pointing towards foul play rather than a
\nsimple case of suicide, he has been  running from pillar to post to
\nhave the case properly investigated.  It is his grievance  that even
\nthe  complaint has not been registered as an FIR and  whatever
\ninquiry  conducted by the police leaves much to be desired.\n<\/p>\n
\tIn
\nresponse to the  order dated 16.9.2010, the police has produced  a
\nreport dated  24.9.2010 submitted by the  Deputy Superintendent of
\nPolice, Idar.  In the report, it is suggested that  the girl died due
\nto hanging and during inquiry, no material  has been found  to
\nsuggest that she was hanged after  killing her.\n<\/p>\n
\tFrom
\nvarious documents such as the statement of the school teacher,
\npanchnama of the scene of incident, inquest panchnama, the medical
\nreport regarding the cause of death, photographs produced by the
\npetitioner, few aspects seem worth investigating into, which are as
\nfollows:-\n<\/p>\n
There
\n\tis nothing on record to suggest  that a young girl of about 14 years
\n\t should have ended her life in such a tragic and violent manner. No
\n\tstatements are recorded  of any student, teacher or  family members
\n\tto suggest that  she was under extreme distress so as to take such
\n\tan extreme step. Cause of suicide, if at all, is thus completely
\n\tunknown after a long time.\n<\/p>\n
From
\n\tthe photographs  produced on record, it appears that  the legs of
\n\tthe girl were almost touching the floor  even while she was hanging
\n\tfrom the ceiling.  It may be that the photographs might have  been
\n\ttaken after a long gap of time and that therefore,  either due to
\n\telasticity of the body or stretchability of the cloth, such
\n\tappeararance  may have been  created.  In any case, this is also an
\n\taspect which cannot be discarded  out of hand.\n<\/p>\n
On
\n\tthe body of the deceased, some injury marks were spotted especially
\n\tin her inner thigh.\n<\/p>\n
Her
\n\tvagina was found swollen.\n<\/p>\n
FSL
\n\treport suggests that semen was found from her vagina as well as from
\n\ther under-pant.\n<\/p>\n
More
\n\tsignificantly, bath room walls had blood marks.\n<\/p>\n
\tNone
\nof these factors in isolation may disprove the theory  of suicide.
\nHowever, seen together, they provide for too much of a coincidence
\nparticularly when there is no earthly reason why, if the girl
\nintended to commit suicide in a running school quietly, there would
\nbe blood marks on the wall of the toilet  where she was found dead.
\nThese and other relevant aspects of the matter need much closer and
\nmore sincere investigation  than what has been carried out so far.\n<\/p>\n
\tUnder
\nthe circumstances, following directions are issued:\n<\/p>\n
The
\n\tpetitioner shall approach the CID Crimes, Gandhinagar and lodge a
\n\tcomplaint which  shall be recorded as FIR and investigation will be
\n\tcarried out.  It is directed that such investigation shall be
\n\tsupervised by an officer not below the rank of Dy.S.P. of CID
\n\tCrimes.\n<\/p>\n
It
\n\tis, however, clarified that if in the complaint  that the petitioner
\n\tlodged, there are any pointers to suspect  any individuals, the
\n\tInvestigating Agency shall collect at least prima facie material
\n\trecording their involvement before causing their arrest.\n<\/p>\n
The
\n\tInvestigating Agency shall inquire  into all aspects of the matter
\n\tparticularly those highlighted in the earlier part of the order.\n<\/p>\n
With
\nthe above directions, the petition is disposed of.\n<\/p>\n
