1.\tHeard
\nMr. Dave, learned Counsel for the applicants and Mr.Desai, learned
\nAPP for the respondent-State.\n<\/p>\n
2.\tThis
\napplication seeking regular bail under Section 439 of the Code of
\nCriminal Procedure, 1973 has been preferred by applicants in
\nconnection with the offence registered with Becharaji
\nPolice Station, Mehsana bearing
\nC.R. No.I -15 of
\n2011 for
\nthe offence punishable under Sections 147, 148, 149, 302, 307, 323,
\n324, 337, 120(B) of the Indian Penal Code, Section 25(1-B)(A), 27(1),
\n30 of the Arms Act and Section 135 of the Bombay Police Act.\n<\/p>\n
3.\tMr.Dave,
\nlearned advocate for the applicants has submitted the only allegation
\nagainst applicants who are, as per FIR accused Nos.6 and 11, is that
\nDesai Gemarbhai Lalbhai – the accused No. 6 used stick to give
\nblows to Mr.Ishwarbhai Govabhai Desai and Dhamasibhai Lakshamanbhai
\non their head and Desai Jairambhai Vaghubhai accused No.11 used stick
\nto give blows to one Mr.Vikrambhai Amthabhai. He further submitted
\nthat the other three accused persons viz. Desai Kanjibhai Ganeshbhai,
\nDesai Ganeshbhai Lalbhai and Desai Hargovanbhai Ganeshbhai against
\nwhom similar allegations of similar nature and gravity have been made
\nare already granted bail by orders dated 17.8.2011 in Criminal Misc.
\nApplication No.11286 of 2011, 25.8.2011 in Criminal Misc. Application
\nNo.11829 of 2011 and 9.9.2011 in Criminal Misc. Application No.12117
\nof 2011. He further submitted that now the chargesheet is filed and
\nthat therefore, the applicants may be released on bail on the ground
\nof parity.\n<\/p>\n
4.\tThe
\napplication is opposed by Mr.Desai, learned APP, who has submitted
\nthat the applicants had committed the alleged offence with the help
\nof other accused persons, which is serious in nature and that
\ntherefore the application deserves to be rejected. However, he
\nadmitted the fact that the injured person has been discharged from
\nthe hospital.\n<\/p>\n
5.\tHaving heard
\nthe learned Counsel for both the sides and considering the facts and
\ncircumstances of the case as well as the documents and other material
\nproduced on record of this case, the gravity of the offence, the
\nquantum of punishment, the allegations against the applicants, the
\nmanner in which the applicants are allegedly involved in the case as
\nper the allegation of the prosecution, coupled with the fact that (a)
\nthe two co-accused against whom allegations of serious nature viz. of
\nusing fire arms (revolver) and giving Dhariya blow on the head are in
\ncustody and are not released and they are not the applicants i.e.
\nthey have not preferred application seeking bail and (b) any
\nallegations of serious nature of causing grievous injury are not made
\nagainst the applicants (c) the investigation is over and the
\nchargesheet is filed, (d) the persons against whom similar
\nallegations are made have already released on bail; and (e) the
\ninjured person has been discharged from the hospital and the medical
\ncertificate does not show any serious injury, I am of the view that
\nthe applicants deserve to be released on bail on appropriate
\ncondition. Hence, I am inclined to allow this application and release
\nthe applicants.\n<\/p>\n

\n\tHence,
\nthis application is allowed. It is directed that the present
\napplicants i.e. accused Nos. 6 and 11 as per FIR in connection with
\nCR No.I-15 of
\n2011 registered
\nwith Becharaji
\nPolice Station, Mehsana be
\nreleased on bail, in respect of the offences alleged against them in
\nthis application, on their executing and furnishing a bond of
\nRs.10,000\/- (Rupees: Ten Thousand Only) each with two solvent
\nsureties each of like amount, by the concerned Police Officer, and on
\ncondition that they shall:-\n<\/p>\n
\t(a) not take
\nundue advantage of or abuse the liberty.\n<\/p>\n
(b) not act in
\nmanner injurious to the interest of the prosecution.\n<\/p>\n
(c) maintain
\nlaw and order.\n<\/p>\n
(d) not leave
\nthe State of Gujarat without prior permission of the Sessions Court
\nconcerned.\n<\/p>\n
(e) furnish the
\naddress of their residence at the time of execution of bond and shall
\nnot change the residence without prior permission of the Sessions
\nCourt\/this Court.\n<\/p>\n
(f) surrender
\ntheir passport, if any, to the lower court within 4 days from the
\ndate of this order.\n<\/p>\n
(g)
\nmark their presence at the Becharaji
\nPolice Station initially
\non 7.10.2011 and
\nthereafter on every first and fifteenth day of every month,
\nbetween
\n11.00 a.m. to
\n3.00 p.m.<\/p>\n
(h) not enter
\nthe revenue limit of village Surpura till the trial is over and the
\nrevenue limit of city and district Mehsana for 3 months except for
\nmarking their presence and attending the Court in connection with
\nthis case.\n<\/p>\n
7.\tThe
\nauthorities will release the applicants only if they are not required
\nin any other offence for the time being.\n<\/p>\n
8.\tIf breach of
\nany of the above conditions is committed the Sessions Judge concerned
\nwill be free to issue warrant or take any appropriate action in the
\nmatter.\n<\/p>\n
9.\tBail-bond
\nbefore the lower Court having jurisdiction to try the case.\n<\/p>\n
10.\tAt the
\ntrial, the trial Court shall not be influenced by the observations,
\nwhich are purely prima facie, tentative and preliminary nature and
\nhave been made only for the purpose of examining prayer for bail
\npending the trial. The Court shall arrive at its own conclusion
\nindependently on the basis of the evidence and other aspects of the
\ncase.\n<\/p>\n
11.\tRule is
\nmade absolute to the aforesaid extent. Direct service is permitted.\n<\/p>\n
