Whether the judgement should be reported in the Digest ?\n\n\nM.M.KUMAR,J.\n<\/pre>\n<p>           The matter regarding interim direction is listed today,<\/p>\n<p>however, on the joint request of learned State counsel, the writ<\/p>\n<p>petition is taken up for final hearing today.<\/p>\n<p>           State of Haryana has approached this Court with a prayer<\/p>\n<p>for quashing various show cause notices (Annexure P\/1 to P\/13)<\/p>\n<p>claiming that these show cause notices are in contravention of<br \/>\n<span class=\"hidden_text\"> CWP 6771\/2009                                             2<\/span><\/p>\n<p>section 3(f), Schedule&#8221;A&#8221; of the Punjab Motor Vehicle Taxation<\/p>\n<p>Act,1924 and also order dated 27.5.2008 (Annexure P\/14) passed<\/p>\n<p>by the Joint State Transport Commissioner-cum-Appellate<\/p>\n<p>Authority      under   the   Punjab   Motor    Vehicles       Taxation<\/p>\n<p>(Amendment) Act,1993.\n<\/p>\n<p>            According to the averments made in the petition the<\/p>\n<p>special road tax on the basis of presumptive seating capacity<\/p>\n<p>against the actual seating capacity of the Tata vehicles being run<\/p>\n<p>by the State of Haryana and passing through the State of Punjab<\/p>\n<p>cannot be charged.\n<\/p>\n<p>            For resolving such like disputes Officers&#8217; Committee<\/p>\n<p>of both the States has to consider the issue and decide the same. In<\/p>\n<p>that regard reliance may be placed on the judgments of Hon&#8217;ble the<\/p>\n<p>Supreme Court in <a href=\"\/doc\/619283\/\">Oil and Natural Gas Commission and<\/p>\n<p>Another v. Collector of Central Excise,<\/a> 1995 Supp.(4) SCC 541<\/p>\n<p>and <a href=\"\/doc\/1808521\/\">Mahanagar Telephone Nigam Ltd. v. Chairman, Central<\/p>\n<p>Board, Direct Taxes and<\/a> another (2004) 6 SCC 431.<\/p>\n<p>            Both the learned State counsel have agreed to adopt the<\/p>\n<p>aforesaid course and have prayed that the matter be relegated to the<\/p>\n<p>Principal Secretaries, Department of Transport of the respective<\/p>\n<p>States to assemble and resolve the issue amicably.<\/p>\n<p>            Accordingly, the writ petition is disposed of with a<\/p>\n<p>direction to     Principal Secretaries, Department of Transport of<br \/>\n<span class=\"hidden_text\"> CWP 6771\/2009                                              3<\/span><\/p>\n<p>State of Punjab and Haryana to meet and decide the issue raised in<\/p>\n<p>the instant petition within a period of four weeks from the date of<\/p>\n<p>receipt    of a copy of this order.
