MUKHOPADHAYA\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.B.PARDIWALA\n\t\t\n\t\n\n \n\nDate\n: 11\/08\/2011 \n\n \n\nCAV\nJUDGMENT \n<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE J.B.PARDIWALA)<\/p>\n<p>1.\tIn<br \/>\nthis appeal, the appellant-original petitioner challenges judgment<br \/>\nand order dated 25.10.2010 passed by the learned Single Judge in<br \/>\nSpecial Civil Application No.16056 of 2007 whereby, according to the<br \/>\nappellant herein, the learned Single Judge allowed the petition but<br \/>\nthe second part of the relief, as prayed for, with regard to<br \/>\nutilization of the space in the market yard is neither granted nor<br \/>\nrejected.\n<\/p>\n<p>2.\tFacts relevant for<br \/>\nthe purpose of deciding this appeal can be summarized as under:-\n<\/p>\n<p>2.1.\tThe<br \/>\nappellant-original petitioner claims to be the holder of general<br \/>\nlicense issued by the respondent-Market Committee and is trading in<br \/>\nthe market area. He also happens to be the ex-Director of the<br \/>\nrespondent-Market Committee  for the period from 1999 to 2001 from<br \/>\nagriculturist constituency. He claims that as a license holder of the<br \/>\nrespondent-market committee, he is duty bound to protect the funds of<br \/>\nthe market committee as per the provisions of law. It appears that<br \/>\nthe elected body of the market-committee decided to put up statue of<br \/>\nEx-Chairman of the Market Committee &#8211; Late Shri Atmarambhai M.<br \/>\nPatel. It appears that the proposal was submitted and respondent No.2<br \/>\naccorded the necessary approval in this regard. Some time in the year<br \/>\n2006, the appellant preferred a representation<br \/>\naddressed to the Minister, Agriculture and Co-operation Department of<br \/>\nthe State Government as regards the decision of the Market Committee<br \/>\nfor putting up the statue and also as regards the misuse of the funds<br \/>\nof the Market Committee. The record also reveals that against the<br \/>\ndecision of the respondent No.2 according the approval for putting up<br \/>\nthe statue, the appellant preferred Revision Application No.38 of<br \/>\n2007 before the respondent No.1-authority under Section 48 of the<br \/>\nGujarat Agricultural Produce Market Committee Act, 1963 challenging<br \/>\nthe approval dated 21.02.2007 given by respondent No.2 and also<br \/>\nprayed to restrain the respondent-Market Committee from placing the<br \/>\nstatue of Late Shri Atmarambhai Patel &#8211; Ex-Chairman of the Market<br \/>\nYard in the principle market yard, Vijapur as well as sub-market yard<br \/>\nat Kukarwada. It appears that initially, respondent No.1-authority<br \/>\nordered the respondent-Market Committee to maintain status quo.<br \/>\nFinally, respondent No.1-authority rejected the revision application<br \/>\nconfirming the approval given by respondent No.2-authority for<br \/>\nplacing the statue of Late Shri Atmarambhai Patel. It is at that<br \/>\nstage, that the appellant herein preferred Special Civil Application<br \/>\nNo.16056 of 2007 and challenged the decisions of respondent Nos.1 and\n<\/p>\n<p>2.<\/p>\n<p>3.\tLearned<br \/>\nSingle Judge came to the conclusion that there was some substance in<br \/>\nthe say of the appellant-original petitioner that there is no<br \/>\nprovision under the Act, Rules or bye-laws to allocate the funds and<br \/>\nincur the expenses for the purpose of putting up a statue of the<br \/>\nEx-Chairman of the market yard. The learned Single Judge also came to<br \/>\nthe conclusion that there is no power with respondent No.2 to grant<br \/>\napproval under Section 33(12) of<br \/>\nthe Act framing the committee to incur huge expenses for the purpose<br \/>\nof putting up of a statue. In short, the learned Single Judge came to<br \/>\nthe conclusion that the order passed by the respondent No.2 according<br \/>\nthe approval to the Committee to incur expenses for putting up statue<br \/>\nfrom the funds of the Market Committee is not in accordance with law.<br \/>\nTo that extent, the learned Single Judge agreed with the<br \/>\nappellant-original petitioner and finally, while allowing the<br \/>\npetition, observed that the statue can be permitted to be erected but<br \/>\nthe members of the Agricultural Produce Market Committee will have to<br \/>\nbear the expenses from their own pockets or from other public funds<br \/>\nbut not from the funds of the market committee. The learned Single<br \/>\nJudge accordingly, quashed and set aside the order dated 17.05.2007<br \/>\npassed by respondent No.1 in Revision Application No.38 of 2007<br \/>\nconfirming the approval granted by respondent No.2. The learned<br \/>\nSingle Judge finally<br \/>\nobserved as under:-\n<\/p>\n<p>&#8220;For<br \/>\nthe foregoing reasons, present petition is hereby allowed. The<br \/>\nimpugned order dated 17th<br \/>\nMay 2007 passed by the respondent No.1 in Revision Application No.38<br \/>\nof 2007 confirming the approval granted by the respondent No.2 is<br \/>\nhereby quashed and set aside.\n<\/p>\n<p> \tIt is, however,<br \/>\nclarified that if the market funds so expended  are repaid in the<br \/>\nrespondent-Market Committee within a period of six months from today,<br \/>\nno interest will be recovered on the said principal amount, failing<br \/>\nwhich it will be open to the concerned District Registrar to recover<br \/>\nthe amount of interest on the principal amount from the Members of<br \/>\nthe Agricultural Produce Market Committee and he will be entitled to<br \/>\ninitiate appropriate proceedings in this respect under Section 51 of<br \/>\nthe Act. Till the aforesaid amount is not repaid, the interim relief<br \/>\ngranted by this Court will continue, otherwise it will amount to<br \/>\ndismissing the petition. Rule is made absolute accordingly.&#8221;\n<\/p>\n<p>4.\tWe have heard learned<br \/>\nadvocate Mr.Dilip B. Rana appearing for the appellant.\n<\/p>\n<p>5.\tWe<br \/>\nhave taken notice of the fact that the statue has already been put up<br \/>\nat principle market yard, Vijapur. We have also taken notice of the<br \/>\nfact that the statue at Vijapur was unveiled on 27.02.2011. We have<br \/>\nalso taken notice of the fact that the entire amount incurred towards<br \/>\nputting up of the statue has been paid up by the Directors as per the<br \/>\naffidavit-in-reply filed by<br \/>\nthe respondent No.3. In the affidavit-in-reply filed by the<br \/>\nrespondent No.3, it has been averred as under:-\n<\/p>\n<p>&#8220;5.\tI say and<br \/>\nsubmit that the said statue has been placed and unveiling of the said<br \/>\nstatue has already been done on 27.2.2011 and the said statue is<br \/>\nstanding as on day. Copies of photographs of the unveiling function<br \/>\nof the statue are annexed herewith and marked as Annexure-R-I Colly.<br \/>\nto this reply.\n<\/p>\n<p>6.\tI<br \/>\nsay and submit that therefore, the statue of late Shri Atmaram Patel<br \/>\nhaving already been unveiled and inaugurated, present appeal may not<br \/>\nbe entertained as the same has become academic and therefore, the<br \/>\nsame may be dismissed.\n<\/p>\n<p>7.\tAnother<br \/>\nimportant aspect, which may kindly be considered, is that the very<br \/>\nappellant had preferred another application being Special Civil<br \/>\nApplication No.2398 of 2011 restraining the Market Committee from<br \/>\nutilizing the place in the market yard for placing and inaugurating<br \/>\nthe statue of late Shri Atmaram Patel. In the said petition earlier<br \/>\nvide order dated 24.2.2011, the learned Single Judge of this Hon&#8217;ble<br \/>\nCourt issued notice and directed to produce record showing that the<br \/>\namount as directed by the learned Single Judge in its order dated<br \/>\n25.10.2010 passed in Special Civil Application No.16056 of 2007 has<br \/>\nbeen deposited by the members of the Market Committee.\n<\/p>\n<p>8.\tThereafter,<br \/>\nwhen the aforesaid petition was taken up for hearing on 25.2.2011,<br \/>\nthe opponent No.3 &#8211; Market Committee produced on record<br \/>\ncontemporaneous evidence showing that the amount in question has been<br \/>\ndeposited by the Directors of the Market Committee.\n<\/p>\n<p>9.\tI<br \/>\nsay and submit that the learned Single Judge therefore recorded the<br \/>\nsaid contention regarding restraining the Market Committee from<br \/>\nutilizing the place in the market yard for placing the statue, the<br \/>\nlearned Single Judge found that the said prayer is barred by<br \/>\nprinciples and res-judicata since the very prayer was made in Special<br \/>\nCivil Application No.16056 of 2007 which has not been granted by the<br \/>\nlearned Single Judge and therefore same amounts to rejection of the<br \/>\nsaid prayer.\n<\/p>\n<p>10.\tI<br \/>\nsay and submit that therefore, the learned Single Judge dismissed<br \/>\nSpecial Civil Application No.2398 of 2011 vide order dated 25.2.2011<br \/>\nand pursuant thereto, the unveiling function of the statue was<br \/>\nundertaken on 27.2.2011.\n<\/p>\n<p>11.\tI<br \/>\nsay and submit that the appellant never challenged or even thought to<br \/>\nchallenge the order passed by the learned Single Judge in Special<br \/>\nCivil Application No.16056 of 2007 till March,2011 and sought to<br \/>\nchallenge the action of utilizing the place in the market yard by<br \/>\nfiling a fresh petition.\n<\/p>\n<p>12.<br \/>\nThe petitioner submits that the appellant therefore by his own<br \/>\nconduct had acquiescenced and had accepted the order passed by the<br \/>\nlearned Single Judge dated 25.10.2010 passed in Special Civil<br \/>\nApplication No.16056 of 2007.\n<\/p>\n<p>19.\tEven<br \/>\n\totherwise, the learned Single Judge has struck the balance by<br \/>\n\tdirecting the Directors of the Market Committee to contribute from<br \/>\n\ttheir personal funds towards expenditure incurred for placing the<br \/>\n\tstatue of late Shri Atmaram Patel and has held that the market funds<br \/>\n\tshould not be used for the said purpose. Accordingly, the Directors<br \/>\n\thave deposited the amount of expenditure incurred by the Market<br \/>\n\tCommittee, and therefore, the market funds have not been utilized<br \/>\n\tfor placing and unveiling statue of late Shri Atmaram Patel.&#8221;\n<\/p>\n<p>6.\tTaking into<br \/>\nconsideration the fact that the statue has already been erected and<br \/>\nunveiled in the month of February, 2011 and also taking into<br \/>\nconsideration the fact that the amount which was spent by the<br \/>\nDirectors from the funds of the Market Committee, has been made good<br \/>\nby the Directors by depositing the entire amount with the Market<br \/>\nCommittee from their own pockets nothing further is required to be<br \/>\ndone in the matter.\n<\/p>\n<p>7.\tIn this view of the<br \/>\nmatter, we do not see any reason to interfere with the impugned order<br \/>\npassed by the learned Single Judge. The appeal is accordingly<br \/>\ndismissed with no order as to costs.
