Justice V.RAMKUMAR\n\n Dated :21\/12\/2010\n\n O R D E R\n                         V.RAMKUMAR, J.\n            ---------------------------------------------------\n               Bail Application No.7941 of 2010\n           -----------------------------------------------------\n         Dated this the 21st day of December, 2010\n\n                                ORDER\n<\/pre>\n<p>     Petitioner, who is accused No.7 in Crime No.1011 of<\/p>\n<p>2010 of Kollam East Police Station for offences punishable<\/p>\n<p>under Sections 420, 465, 468, 471 &amp; 120(B) I.P.C. and Sec.12<\/p>\n<p>(1)(a) of Indian Passport Act, seeks anticipatory bail.<\/p>\n<p>      2.    The    learned      Public    Prosecutor      opposed     the<\/p>\n<p>application.\n<\/p>\n<p>     3.     After evaluating        the    factors     and parameters<\/p>\n<p>which are to be taken into consideration in the light of<\/p>\n<p>paragraph 122 of the verdict dated 2-12-2010 of the Apex<\/p>\n<p>Court    in   <a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of<\/p>\n<p>Maharashtra and Others<\/a> (2010 (4) KLT 930), I am of the<\/p>\n<p>view that anticipatory bail cannot be granted in a case of this<\/p>\n<p>nature, since the investigating officer has not had the<\/p>\n<p>advantage of interrogating the petitioner.             But at the same<\/p>\n<p>time,   I am inclined to permit the petitioner to surrender<\/p>\n<p>before    the   Investigating      Officer     for   the    purpose    of<\/p>\n<p>interrogation and then to have his application for bail allowed<\/p>\n<p>by   the   Magistrate      or    the    Court     having     jurisdiction.<\/p>\n<p>Bail Appln.No.7941\/2010<br \/>\n<span class=\"hidden_text\">                                : 2 :<\/span><\/p>\n<p>Accordingly, the petitioner shall surrender before the<\/p>\n<p>investigating officer on 30\/12\/2010 or on 31\/12\/2010 for<\/p>\n<p>the purpose of interrogation and recovery of incriminating<\/p>\n<p>material, if any. In case the investigating officer is of the<\/p>\n<p>view that having regard to the facts of the case arrest of the<\/p>\n<p>petitioner is imperative he shall record his reasons for the<\/p>\n<p>arrest in the case diary as insisted in paragraph 129           of<\/p>\n<p>Siddharam Satlingappa Mhetre&#8217;s case (supra).                  The<\/p>\n<p>petitioner shall thereafter be produced before the Magistrate<\/p>\n<p>or the Court concerned and permitted to file an application<\/p>\n<p>for regular bail.      In case the interrogation of the petitioner<\/p>\n<p>is   without arresting him, the petitioner shall thereafter<\/p>\n<p>appear before the Magistrate or the Court concerned           and<\/p>\n<p>apply for regular bail. The Magistrate or the Court on being<\/p>\n<p>satisfied that the petitioner has been interrogated by the<\/p>\n<p>police shall, after hearing the prosecution as well, release<\/p>\n<p>the petitioner on bail.\n<\/p>\n<p>      4. In case the accused while surrendering before the<\/p>\n<p>Investigating Officer has deprived the investigating officer<\/p>\n<p>sufficient time for interrogation, the officer shall complete the<\/p>\n<p>Bail Appln.No.7941\/2010<br \/>\n<span class=\"hidden_text\">                                  : 3 :<\/span><\/p>\n<p>interrogation even if it is beyond the time limit fixed as above<\/p>\n<p>and submit a report to that effect          to the Magistrate or the<\/p>\n<p>Court concerned. Likewise, the Magistrate or the Court also<\/p>\n<p>will not be      bound by the time limit          fixed as above    if<\/p>\n<p>sufficient time was not available after the production or<\/p>\n<p>appearance of the accused .\n<\/p>\n<p>      5.     The release of the        petitioner shall be on the<\/p>\n<p>petitioner executing a bond for `15,000\/- (Rupees fifteen<\/p>\n<p>thousand only) with two solvent sureties each for the like<\/p>\n<p>amount to the satisfaction of the            Court concerned      and<\/p>\n<p>subject to the following conditions:-<\/p>\n<blockquote><p>             1.     The  petitioner    shall  report   before    the<\/p>\n<p>             Investigating Officer between 9 a.m. and 11 a.m. on<\/p>\n<p>             all Wednesdays.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>             2. The petitioner shall make himself available for<\/p>\n<p>             interrogation including custodial interrogation as<\/p>\n<p>             and when required by the Investigating Officer.<\/p>\n<\/blockquote>\n<blockquote><p>             3.     The petitioner shall not influence or intimidate<\/p>\n<p>             the prosecution witnesses nor shall he attempt to<\/p>\n<p>             tamper with the evidence for the prosecution.<\/p>\n<\/blockquote>\n<p>Bail Appln.No.7941\/2010<br \/>\n<span class=\"hidden_text\">                                  : 4 :<\/span><\/p>\n<p>             4.     The petitioner shall not commit any offence<\/p>\n<p>             while on bail.\n<\/p>\n<\/p>\n<p>              5.
