Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :23\/11\/2009\n\n O R D E R\n            THOTTATHIL B.RADHAKRISHNAN, J.\n                  -------------------------------------------\n                    W.P(C).No.32517 OF 2009\n                  -------------------------------------------\n            Dated this the 23rd day of November, 2009\n\n\n                              JUDGMENT\n<\/pre>\n<p>     The petitioner, a superintendent of the K.S.R.T.C., faces<\/p>\n<p>certain allegations by a woman officer in the assistant grade that<\/p>\n<p>he had indulged in what could be called as harassment of a<\/p>\n<p>woman employee in her place of work. The petitioner stands<\/p>\n<p>transferred from Parassala to Thodupuzha. He says that there<\/p>\n<p>are at least two reports on certain allegations against him. But<\/p>\n<p>what he has produced along with                  the writ petition are not<\/p>\n<p>reports of the committee constituted in terms of the directions by<\/p>\n<p>the Apex Court in Vishaka&#8217;s case, which should have a<\/p>\n<p>particular quorum, including persons who are not involved in the<\/p>\n<p>management or employed in the establishment. On query by this<\/p>\n<p>Court as to what happened to that enquiry, learned counsel for<\/p>\n<p>the petitioner states that the said committee had concluded that<\/p>\n<p>the petitioner should be transferred out of Parassala to avoid<\/p>\n<p>such further incidents. Learned counsel for the KSRTC states,<\/p>\n<p>WPC.32517\/09<\/p>\n<p><span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>on instructions,    that the initial proposal was to transfer the<\/p>\n<p>petitioner from Parassala to Trivandrum and he has been<\/p>\n<p>transferred to Thodupuzha because there are no vacancies in the<\/p>\n<p>cadre    of  superintendent     in   Trivandrum.      Taking    into<\/p>\n<p>consideration the distance from Trivandrum to Thodupuzha and<\/p>\n<p>the attendant circumstances, particularly that the management<\/p>\n<p>wanted the petitioner to be moved only to Trivandrum from<\/p>\n<p>Parassala, it is ordered that the petitioner&#8217;s request for a posting<\/p>\n<p>somewhere       near     Trivandrum      would     be   considered<\/p>\n<p>sympathetically by the management at the earliest. Subject to<\/p>\n<p>that, all other reliefs sought for are rejected.
