Civil Application (Stamp) No.966 of 2010.\n<\/p>\n<p>2.\tThe<br \/>\napplicants herein appear to have presented an appeal, being First<br \/>\nAppeal (Stamp) No.5141 of 2007. Presentation of the appeal was<br \/>\ndelayed. Therefore, an application, being Civil Application No.6115<br \/>\nof 2008, was filed with a request that the delay caused in presenting<br \/>\nthe appeal may be condoned. For the reasons mentioned in order dated<br \/>\n11.12.2009, the said Civil Application was rejected. It appears that<br \/>\nthe applicants desire that the order dated 11.12.2009 in Civil<br \/>\nApplication No.6115 of 2008 may be recalled. Hence, it was necessary<br \/>\nfor the applicants to prefer appropriate application. However,<br \/>\npresentation of the said application was also delayed by the<br \/>\napplicants. Ultimately, after causing delay of 95 days, present<br \/>\napplicants filed Misc. Civil Application (Stamp) No.966 of 2010,<br \/>\nseeking restoration of Civil Application No.6115 of 2008.<br \/>\nConsequently, it became necessary for the applicants to seek<br \/>\ncondonation of delay of 95 days caused in filing the above-mentioned<br \/>\nMisc. Civil Application (Stamp) No.966 of 2010 and that, therefore,<br \/>\nthe applicants have preferred present application, i.e. Civil<br \/>\nApplication No.5636 of 2010.\n<\/p>\n<p>3.\tMr.\n<\/p>\n<p>Soni, learned advocate, has appeared for the applicants, Mr.<br \/>\nNanavati, learned advocate, has appeared for respondent No.3, Mr.<br \/>\nNair, learned advocate, has appeared for respondent No.6 and Mr.<br \/>\nSingh, learned advocate, has entered his appearance for respondent<br \/>\nNo.5, however today, at the time of hearing, he is not present. Ms.<br \/>\nDesai, learned advocate, has appeared for respondent No.2.\n<\/p>\n<p>4.\tThe<br \/>\napplicants have explained the reasons in paragraph Nos.3 to 5 of the<br \/>\napplication, which caused delay in filing the Misc. Civil Application<br \/>\n(Stamp) No.966 of 2010.  Since we are otherwise also satisfied with<br \/>\napplicants&#8217; explanation, we, having regard to the fact that the<br \/>\nlearned counsel for respondent Nos.2,3 and 6 have graciously extended<br \/>\ntheir consent without recording reasons in detail, deem it<br \/>\nappropriate to condone the delay of 95 days caused in preferring<br \/>\nMisc. Civil Application (Stamp) No.966 of 2010.  Accordingly, the<br \/>\napplication is allowed.  Delay of 95 days caused in filing  Misc.<br \/>\nCivil Application (Stamp) No.966 of 2010 is condoned.
