Thereafter, they returned home and again went<br \/>\nto borewell in their field with Bhikhaji Oghaji and Amraji Gambhirji<br \/>\nat about 8:30 at night. When they reached at the borewell in a jeep,<br \/>\nthe accused formed unlawful assembly with object to make deadly<br \/>\nassault armed themselves with deadly weapons.  Accused Suraji called<br \/>\ndeceased Kanchanji on the pretext of talk and accused Vikramji @<br \/>\nTikaji, accused Nagjiji Vihaji and accused Jivanji Ishwarji caught<br \/>\nhold of Kanchanji and accused Suraji Nagjiji and accused Mahadevji<br \/>\nRayaji made assault with knife and caused injuries on chest, stomach<br \/>\nand neck of Kanchanji.  On account of the injuries, Kanchanji died.\n<\/p>\n<p>3.\tOn<br \/>\nthe basis of the first information report lodged by PW 4 Swaroopji<br \/>\nHarchandji, offence was registered and investigation was started. At<br \/>\nthe end of investigation, charge sheet came to be filed against the<br \/>\naccused for the aforesaid offences.  As the offence was triable by<br \/>\nSessions Court, the case was committed to the Sessions Court and it<br \/>\nwas registered as Sessions Case No.176 of 2000.  The learned<br \/>\nAdditional Sessions Judge framed charge Exh-12 for the aforesaid<br \/>\noffences against the accused. Charge was read over and explained to<br \/>\nthem.  The accused denied having committed the offences and claimed<br \/>\nto be tried.  Therefore, the prosecution adduced evidence.  On<br \/>\ncompletion of recording of evidence, the incriminating circumstances<br \/>\nappearing in the evidence against the accused were explained to them.<br \/>\n The accused in their further statement recorded under section 313 of<br \/>\nthe Code of Criminal Procedure, 1973, stated that they are innocent.<br \/>\nAfter hearing the learned Additional Public Prosecutor and learned<br \/>\nadvocate for the accused, the Court convicted the the accused and<br \/>\nsentenced them as mentioned hereinbefore.  Being aggrieved by the<br \/>\nsaid decision, the accused have preferred these appeals.\n<\/p>\n<p>4.\tAs<br \/>\nboth these appeals arise out of the same judgment, both are heard and<br \/>\ndecided by this common judgment.\n<\/p>\n<p>5.\tWe<br \/>\nhave heard learned advocate Ms. Banna Dutta for the appellants and<br \/>\nlearned APP Mr. HH Parikh at length and in great detail.  We have<br \/>\nalso perused the impugned judgment and record and proceedings of the<br \/>\ntrial Court.\n<\/p>\n<p>6.\tIn<br \/>\norder to prove the case, the prosecution examined three eye<br \/>\nwitnesses.  PW 4 Swaroopji Harchandji, PW 5 Amraji Gambhirji and PW 6<br \/>\nBhikhaji Ogharji.\n<\/p>\n<p>7.\tPW<br \/>\n4 Swaroopji Harchandji (Exh-54) has in detail described the incident.<br \/>\n According to the witness, on the day of incident at about 5:00 p.m.,<br \/>\nwhen he was at the field with his son Kanchanji, accused Suraji came<br \/>\nthere in inebriated condition and hence they rebuked him.<br \/>\nThereafter, at about 8:30 at night,  he with his son deceased<br \/>\nKanchanji, Amraji Gambhirji and Bhikhaji Ogharji went to the borewell<br \/>\nin the field, at that time, accused Suraji called Kanchanji on the<br \/>\npretext of having talk with him and as soon as, Kanchanji went near<br \/>\nthem, accused Nagjiji and accused Vikramji caught hold of arms and<br \/>\nshoulder of Kanchanji, accused Jivanji Ishwarji caught hold of his<br \/>\nlegs and accused Suraji and accused Mahadevji started inflicting<br \/>\nknife blows and on account of injuries, Kanchanji fell down.  The<br \/>\nwitness has been extensively cross-examined by the accused.  The<br \/>\ncross examination indicates that the witness has stuck to his version<br \/>\ngiven in the examination-in-chief.  The accused have not been able to<br \/>\nelicit in the cross examination any material in their favour to<br \/>\nindicate that the evidence is not trustworthy.  This evidence<br \/>\nindicates that before the incident, the complainant and deceased<br \/>\nKanchanji rebuked accused Suraji.  Therefore, keeping grudge of this,<br \/>\nthe accused armed with deadly weapons, made assault on the deceased.\n<\/p>\n<p>8.\tThe<br \/>\nevidence of PW 5 Amraji Gambhirji Ex-58 and PW 6  Bhikhaji Ogharji<br \/>\nExh-62 are on the same line.  Both the witness have supported the<br \/>\nprosecution case.  The accused have not been able to elicit from<br \/>\ncross-examination that the witnesses are not reliable and<br \/>\ntrustworthy.  On the contrary, it clearly establishes their<br \/>\ninvolvement in the incident.  In view of this consistent evidence, it<br \/>\nemerges that prior to the assault by the accused, the complainant and<br \/>\nthe deceased had rebuked accused Suraji.  Therefore, accused Suraji<br \/>\nwith other accused armed with deadly weapons with object to do away<br \/>\nwith the deceased, made assault in same night.  The manner in which<br \/>\nattack was made, it was with a pre-determined mind.  Therefore, in<br \/>\nour considered view, the learned trial Judge was justified in coming<br \/>\nto the conclusion that the accused formed an unlawful assembly, armed<br \/>\nwith deadly weapons caused fatal injuries to the deceased.\n<\/p>\n<p>9.\tThe<br \/>\nmedical evidence of PW 1 Dr. Bhikhubhai Akediwala, Exh-20 indicates<br \/>\nthat there were about four external injuries on the vital parts of<br \/>\nKanchanji.  It also indicates that the injuries were possible with<br \/>\nknife and the injuries were sufficient in the ordinary course of<br \/>\nnature to cause death.  The postmortem report Exh-23 indicates the<br \/>\ninjuries and cause of death was hemorrhagic shock due to rupture of<br \/>\nvital organs like liver and spleen.  In view of this evidence, it<br \/>\nclearly emerges that the death was homicidal.\n<\/p>\n<p>10.\tIn<br \/>\nview of above evidence, in our considered view, the learned trial<br \/>\nJudge was justified in recording conviction of the accused for the<br \/>\noffences charges against them.  The learned advocate for the<br \/>\nappellants has not been able to point out any infirmity in the<br \/>\nimpugned judgment.  Therefore, the appeals must fail.\n<\/p>\n<p>11.\tIn<br \/>\nthe result, the appeals fail and stand dismissed.
