Rashmi &amp; ors.\n\n\n\n7.01.2011\n\n\n      Shri Arun Shukla, Counsel for the applicant.\n      None for the respondents though served and represented.<\/pre>\n<p>      It is submitted by the petitioner that the order dated<br \/>\n26.10.2009 ought to have been complied with by respondent<br \/>\nNo.3 within a period of two weeks from the date of order passed<br \/>\nby this Court. Respondent No.3 was served with the copy of the<br \/>\norder immediately on 31.10.2009 vide Annexure P-4 but the<br \/>\nmatter has been decided belatedly vide Annexure A-3 dated<br \/>\n23.8.2010. It is submitted that the order has not been complied<br \/>\nwith within the period as fixed by this Court and thereby the<br \/>\nrespondent No.3 has disobeyed the order of this Court.\n<\/p>\n<p>      From the perusal of the record, we find that respondent<br \/>\nNo.3 has submitted his unconditional apology in para 4 of the<br \/>\nreply for the belated compliance of the order.           This matter<br \/>\nremained pending since 21.5.2010 and during the pendency of<br \/>\nthis petition, after issuance of the notice, the compliance has<br \/>\nbeen made by the respondent No.3.           As the compliance has<br \/>\nbeen made by the respondents, no further action is required and<br \/>\nin this regard, apology submitted by respondent No.3 is<br \/>\naccepted.       However, because of the belated compliance,<br \/>\nrespondent No.3 is saddled with cost of the case, which we<br \/>\nquantify to Rs.1000\/-, payable by the respondent No.3 to the<br \/>\napplicant.\n<\/p>\n<p>      With the aforesaid directions, proceedings are closed.\n<\/p>\n<pre> (Krishn Kumar Lahoti)                          (G.D.
