The petitioner is the<\/p>\n<p>second accused. The crux of the allegations is that the first<\/p>\n<p>accused was apprehended with 300 x 100 ml of Karnataka arrack<\/p>\n<p>in packets.     The first accused on interrogation furnished<\/p>\n<p>information to the investigating officer about the complicity of<\/p>\n<p>the petitioner herein. The petitioner\/second accused is allegedly<\/p>\n<p>the person who used to furnish contraband liquor to the first<\/p>\n<p>accused for local sales. The quantity allegedly seized was also<\/p>\n<p>obtained from the petitioner herein, it is alleged.<\/p>\n<p>      2.   The learned counsel for the petitioner submits that<\/p>\n<p>the allegations are totally false. Except the alleged confession<\/p>\n<p>statement of the first accused, there is no material whatsoever<\/p>\n<p>against the petitioner. The petitioner was hospitalised and was<\/p>\n<p>not even available on the relevant date to supply any contraband<\/p>\n<p>liquor to the first accused.             In these circumstances, the<\/p>\n<p>petitioner may be granted anticipatory bail, it is prayed.<\/p>\n<p>      3.   The application is opposed by the learned Public<\/p>\n<p>Prosecutor. The learned Public Prosecutor submits that at the<\/p>\n<p><span class=\"hidden_text\">B.A.No.5729\/07                    2<\/span><\/p>\n<p>moment and with the available inputs, there is absolutely no<\/p>\n<p>reason to justify the prayer for invocation of the extraordinary<\/p>\n<p>equitable discretion under Section 438 Cr.P.C. The petitioner<\/p>\n<p>has to be arrested and interrogated. Further materials have to<\/p>\n<p>be collected. It will be inexpedient and unnecessary to permit<\/p>\n<p>the petitioner to arm himself with an order of anticipatory bail at<\/p>\n<p>this stage.\n<\/p>\n<p>      4.    Having considered all the relevant inputs, I find merit<\/p>\n<p>in the opposition by the learned Public Prosecutor. I find no<\/p>\n<p>features in this case which would justify the invocation of the<\/p>\n<p>extraordinary equitable discretion under Section 438 Cr.P.C.<\/p>\n<p>There is not even an allegation that the powers of arrest are<\/p>\n<p>about to be invoked with any malicious or oblique motives. I am<\/p>\n<p>satisfied that this petition deserves to be dismissed.<\/p>\n<p>      5.    In the result, this petition is dismissed.
