THRO&#8217; HEIRS &#8211; Appellant(s)<\/p>\n<p>Versus<\/p>\n<p>SPECIAL<br \/>\nLAQ OFFICER &amp; 3 &#8211; Defendant(s)<\/p>\n<p>=========================================================<\/p>\n<p>Appearance<br \/>\n:\n<\/p>\n<p>MR<br \/>\nHM PARIKH for<br \/>\nAppellant(s) : 1,<br \/>\nMS SACHI MATHUR, ASST.GOVERNMENT PLEADER for<br \/>\nDefendant(s) : 1,<br \/>\nRULE SERVED for Defendant(s) : 2,<br \/>\nDELETED for<br \/>\nDefendant(s) : 3 &#8211;\n<\/p>\n<p>4.<br \/>\n=========================================================<\/p>\n<p>CORAM<br \/>\n\t\t\t:\n<\/p>\n<p>HONOURABLE<br \/>\n\t\t\tMR.JUSTICE J.C.UPADHYAYA<\/p>\n<p>Date<br \/>\n: 23\/02\/2011 <\/p>\n<p>ORAL<br \/>\nCOMMON JUDGMENT <\/p>\n<p>Both<br \/>\n\tthese appeals arise out of a common judgment and award rendered by<br \/>\n\tlearned Civil Judge (S.D.), Nadiad on 24.2.2004 in Land Acquisition<br \/>\n\tCase Nos.214 and 215 of 1991 whereby the land references preferred<br \/>\n\tby the respective claimants came to be dismissed.\n<\/p>\n<p>Perusing<br \/>\n\tthe impugned judgment and award, it transpires that the reference<br \/>\n\tCourt did not ascertain the market value of the lands under<br \/>\n\tacquisition, but both these cases came to be dismissed on same<br \/>\n\ttechnical grounds. So far as LAQ No.214 of 1991 was concerned, the<br \/>\n\treference Court held that there was a dispute between claimant<br \/>\n\tIshwarbhai Dholabhai Desai (now deceased) and the opponents No.3 and<br \/>\n\t4, namely, Vaghri Ratibhai Gulabbhai and Shankarbhai Gulabbhai<br \/>\n\tVaghri regarding the ownership and possession of the land under<br \/>\n\tacquisition. The case of the claimant was to the effect that the<br \/>\n\topponents No.3 and 4 did not succeed before the tenancy Court and<br \/>\n\tthe tenancy Court came to the conclusion that they had no right or<br \/>\n\tlien over the land. However, mere fact that in village forms 7 and<br \/>\n\t12, the names of opponents No.3 and 4 emerged as cultivator and,<br \/>\n\ttherefore, the reference Court came to the conclusion that the whole<br \/>\n\treference deserved dismissal. The reference Court further observed<br \/>\n\tthat after the death of the original claimant Ishwarbhai Dholabhai,<br \/>\n\tthough by substitution his son Kanubhai Ishwarbhai was impleaded as<br \/>\n\tclaimant, but the reference Court came to the conclusion that<br \/>\n\tKanubhai Ishwarbhai, the son of Ishwarbhai failed to produce probate<br \/>\n\tof will allegedly executed by Ishwarbhai and on that count it was<br \/>\n\theld by the reference Court that LAQ Case No.214 of 1991 deserved<br \/>\n\tdismissal. So far as LAQ Case No.215 of 1991 is concerned, the<br \/>\n\treference Court while dismissing the said case observed that in LAQ<br \/>\n\tCase No.215 of 1991, opponents No.3 and 4 are not joined and,<br \/>\n\ttherefore, both the cases could not have been consolidated. In<br \/>\n\tshort, by assigning the above reasons, the reference Court dismissed<br \/>\n\tboth the reference cases without determining the just and fair<br \/>\n\tamount of compensation.\n<\/p>\n<p>Mr.H.M.Parikh,<br \/>\n\tlearned counsel representing the appellant submitted that the<br \/>\n\treference Court has taken a very hyper-technical view and without<br \/>\n\tdetermining just and fair compensation, which the claimants are<br \/>\n\tentitled to get, the reference Court dismissed both the land<br \/>\n\treference cases. It is submitted that so far as the Land Reference<br \/>\n\tCase No.214 of 1991 is concerned, even the other side did not raise<br \/>\n\tany dispute that Kanubhai Ishwarbhai was not the son and legal<br \/>\n\trepresentative of deceased claimant Ishwarbhai Dholabhai. Ishwarbhai<br \/>\n\tDholabhai died pending said reference case before the reference<br \/>\n\tCourt and by order of the reference itself, Kanubhai Ishwarbhai, the<br \/>\n\tson and legal representative of Ishwarbhai was brought on record. It<br \/>\n\tis further submitted that the claimant himself joined opponents No.3<br \/>\n\tand 4 in the reference, so that dispute, if any, can be conveniently<br \/>\n\tresolved and the claimant had come forward with documentary evidence<br \/>\n\tshowing that even the so called claim over the acquired land of the<br \/>\n\topponents No.3 and 4, was not considered by competent tenancy Court.<br \/>\n\tThat the opponents No.3 and 4 posed themselves as tenant in the<br \/>\n\tacquired land, but their case was not at all accepted by the<br \/>\n\tcompetent tenancy Court and they had lost said case.\n<\/p>\n<p>3.1\tSo<br \/>\n\tfar as the dismissal of Land Reference Case No.215 of 1991 is<br \/>\n\tconcerned, Mr.Parikh, learned counsel submitted that the aforesaid<br \/>\n\tland reference case was filed by appellant &#8211; claimant<br \/>\n\tRohitbhai Vinubhai Desai and it is true that opponents No.3 and 4<br \/>\n\twho were opponents in LAQ Case No.214 of 1991 were not joined in LAQ<br \/>\n\tCase No.215 of 1991 as they had no dispute whatsoever regarding the<br \/>\n\tland went in acquisition of claimant Rohitbhai, despite this the<br \/>\n\treference Court held that order of consolidation in both the matters<br \/>\n\twas not appropriate since opponents No.3 and 4 were not joined as<br \/>\n\tco-opponents in Land Reference Case No.215 of 1991 and, therefore,<br \/>\n\tcame to the conclusion that even Land Reference Case No.215 of 1991<br \/>\n\tdeserved dismissal.\n<\/p>\n<p>Mr.Parikh,<br \/>\n\tlearned counsel representing the appellants therefore submitted that<br \/>\n\tthe impugned judgment and award rendered by the reference Court may<br \/>\n\tbe set-aside and both the reference cases may be remanded to the<br \/>\n\treference Court with specific direction to decide both the cases on<br \/>\n\tmerits within a stipulated period.\n<\/p>\n<p>In<br \/>\n\tlight of the above situation and further the fact that the reference<br \/>\n\tCourt did not ascertain the market value of the lands under<br \/>\n\tacquisition and did not determine the amount of compensation,<br \/>\n\tMs.Mathur, learned AGP for the opponents submitted that necessary<br \/>\n\torders may be passed in this appeal.\n<\/p>\n<p>I<br \/>\n\thave gone through the record and proceedings in context with the<br \/>\n\tsubmissions advanced by the rival sides.\n<\/p>\n<p>First<br \/>\n\tof all, the bare perusal of the impugned judgment and award rendered<br \/>\n\tby the reference Court, it clearly transpires that though one of the<br \/>\n\tissues framed by the reference Court was to the effect as to whether<br \/>\n\tthe compensation awarded by the Land Acquisition Officer is not fair<br \/>\n\tand adequate? If yes, what additional compensation the claimants are<br \/>\n\tentitled to? It appears that the said issue has not at all been<br \/>\n\treplied by the reference Court and both the land reference cases<br \/>\n\tcame to be dismissed merely on technical ground.\n<\/p>\n<p>So<br \/>\n\tfar as dismissal of Land Reference Case No.214 of 1991 is concerned,<br \/>\n\tthe reference Court observed that since there was dispute about the<br \/>\n\tland between the claimant and opponents No.3 and 4 in said matter<br \/>\n\tand, therefore, instead of resolving the same, the reference Court<br \/>\n\ton that ground dismissed the reference case. Another ground arising<br \/>\n\tfor dismissal of same reference case is that the original claimant<br \/>\n\tIshwarbhai Dholabhai, who died during the pendency of aforesaid<br \/>\n\treference case and in his place his son and legal heir Kanubhai<br \/>\n\tIshwarbhai Desai was substituted as claimant, the reference Court<br \/>\n\tobserved that as Ishwarbhai Desai had executed a will and as<br \/>\n\tKanubhai Ishwarbhai failed to produce any probate of will, the<br \/>\n\treference case was deserved to be dismissed. It appears that none of<br \/>\n\tthe reasons assigned by the reference Court can be said to be<br \/>\n\tsufficient for dismissal of the reference case. As emerged from the<br \/>\n\timpugned judgment and order rendered by the reference Court, it was<br \/>\n\tthe case of the claimant that opponents No.3 and 4 had no right,<br \/>\n\ttitle or any interest in the land acquired and even their claim came<br \/>\n\tto be dismissed even by competent tenancy Court. Instead of<br \/>\n\texamining the issue in its true perspective and on merits, the<br \/>\n\treference Court thought it fit to make it a ground for dismissal of<br \/>\n\tthe reference case. Moreover, nothing emerges that so far as<br \/>\n\tsubsequently substituted claimant, namely, Kanubhai Ishwarbhai Desai<br \/>\n\twas concerned, the other side had ever raised the defence that he<br \/>\n\twas not heir and legal representative of deceased Ishwarbhai Desai.\n<\/p>\n<p>So<br \/>\n\tfar as dismissal of the land reference case No.215 of 1991 is<br \/>\n\tconcerned, the reference Court dismissed said reference case on<br \/>\n\trather more hyper-technical ground, namely, the consolidation of<br \/>\n\tboth the reference cases was held to be improper. There is no<br \/>\n\tdispute that both the land reference cases arise out of the common<br \/>\n\taward passed u\/s.11 of the Land Acquisition Act by the Land<br \/>\n\tAcquisition Officer. There was a common notification for the<br \/>\n\tacquisition of these lands published u\/s.4 of the Act. The reference<br \/>\n\tCourt observed that since in Land Reference Case No.215 of 1991, the<br \/>\n\topponents No.3 and 4, who were respondents in Land Reference Case<br \/>\n\tNo.214 of 1991 were not joined and, therefore, the consolidation was<br \/>\n\timproper. Perusing the impugned judgment and award rendered by the<br \/>\n\treference Court, nothing emerges that opponent Nos.3 and 4 in Land<br \/>\n\tReference Case No.214 of 1991 had any claim or alleged any claim in<br \/>\n\tthe land of claimant Rohitbhai Vinubhai Desai of Land Reference Case<br \/>\n\tNo.215 of 1991 and, therefore, this Court fails to understand as to<br \/>\n\thow the reference Court dismissed the Land Reference Case No.215 of<br \/>\n\t1991 on such ground.\n<\/p>\n<p>Resultant<br \/>\n\teffect to the above discussions is that the impugned judgment and<br \/>\n\taward rendered by the reference Court deserves to be set-aside. As<br \/>\n\tstated above, the reference Court did not address itself to decide<br \/>\n\tand determine the compensation of the lands under acquisition and,<br \/>\n\ttherefore, though the reference cases are very old, but there is no<br \/>\n\toption whatsoever but to remand both these matters. However,<br \/>\n\tconsidering the fact that the cases are very old, necessary<br \/>\n\tdirection to the reference Court shall have to be given.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, both these appeals are allowed. The judgment<br \/>\n\tand award rendered by learned Civil Judge (S.D.), Nadiad on<br \/>\n\t24.2.2004 in Land Reference Case Nos.214 and 215 of 1991 are hereby<br \/>\n\tset-aside. Both the aforesaid Land Reference Cases are ordered to be<br \/>\n\trestored to the file of the reference Court and are ordered to be<br \/>\n\tremanded with specific direction that the reference Court shall<br \/>\n\tdetermine the amount of just and fair compensation on merits and<br \/>\n\tdispose of both the land reference cases in accordance with law,<br \/>\n\tpreferably within three months from the date of receipt of the<br \/>\n\trecord and proceedings. Registry is directed to send back record and<br \/>\n\tproceedings immediately. There shall be no order as to costs.
