Kuriakose, J<\/p>\n<p>      This appeal preferred by the Government<\/p>\n<p>pertains to acquisition of land in Kanhangad village for<\/p>\n<p>the purpose of construction of a Railway Over Bridge.<\/p>\n<p>The relevant Section 4(1) notification was published<\/p>\n<p>on 09\/08\/99. The Land Acquisition Officer awarded<\/p>\n<p>land value at the rate of Rs.5,145.58\/- per cent. The<\/p>\n<p>Reference Court under the impugned judgment re-<\/p>\n<p>fixed land value at Rs.15,000\/- per cent. Even though<\/p>\n<p>the claimants had claimed for enhanced value for the<\/p>\n<p>building and Exts.A1 and A2 were produced and<\/p>\n<p>engineer was examined as AW2, the learned Sub<\/p>\n<p>Judge did not become inclined to grant enhancement<\/p>\n<p><span class=\"hidden_text\">L. A. A. No.355 of 2008          -2-<\/span><\/p>\n<p>      towards building value. The only evidence to support<\/p>\n<p>      the claimants&#8217; claim to enhanced land value was the<\/p>\n<p>      oral evidence of AW1 alone. The learned Sub Judge<\/p>\n<p>      himself observed that no document have been<\/p>\n<p>      produced by the claimants in support of his claim for<\/p>\n<p>      enhanced land value. However, obviously, on guess<\/p>\n<p>      work the land value has been enhanced by 200% of<\/p>\n<p>      what was awarded by the Land Acquisition Officer. We<\/p>\n<p>      are unable to approve the action of the learned Sub<\/p>\n<p>      Judge in granting such steep enhancement on the<\/p>\n<p>      basis of oral evidence alone.\n<\/p>\n<\/p>\n<p>           2.   It   is  submitted   by   Sri.M.Gopikrishnan<\/p>\n<p>      Nambiar, the learned counsel for the respondent that<\/p>\n<p>      if an opportunity be given, the claimants will be able<\/p>\n<p>      to produce evidence not only in support of land value<\/p>\n<p>      but also in support of claim for building value. Under<\/p>\n<p><span class=\"hidden_text\">L. A. A. No.355 of 2008         -3-<\/span><\/p>\n<p>      the above circumstances, we set aside the judgment<\/p>\n<p>      and decree under appeal and remand the LAR No.3\/03<\/p>\n<p>      back to the Subordinate Judge&#8217;s Court, Hosdurg. That<\/p>\n<p>      court will give opportunity to the respondents\/<\/p>\n<p>      claimants to adduce evidence in support of their claim<\/p>\n<p>      towards higher building value and higher land value. It<\/p>\n<p>      will be observed that the best evidence which is<\/p>\n<p>      possible for claim of higher land value is production of<\/p>\n<p>      sale documents pertaining to comparable properties. If<\/p>\n<p>      further evidence is adduced by the claimants, the<\/p>\n<p>      Government will also be given opportunity to adduce<\/p>\n<p>      counter evidence. Learned Sub Judge will pass the<\/p>\n<p>      revised judgment on the basis of the entire evidence<\/p>\n<p>      which comes on record at the earliest and at any rate,<\/p>\n<p>      within five months of the parties entering appearance<\/p>\n<p>      before the court below pursuant to this judgment.<\/p>\n<p><span class=\"hidden_text\">L.
