(2) 207\n JT 1991 (3)   603\t  1991 SCALE  (2)492\n\n\nACT:\n    Constitution of India: Articles 136, 226--Writ  petition\ndismissed  by  a non-speaking order--Whether reasons  to  be\ngiven.\n    Service  Law:  Haryana Police--Inspectors--Out  of\tturn\npromotion  as  Deputy Superintendents--Promotion  order\t not\nmentioning reasons for--Validity of.\n\n\n\nHEADNOTE:\n    Respondents\t no. 3 and 4, who were junior to the  appel-\nlants as Inspectors of Police in the State of Haryana,\twere\ngiven  out of turn promotions as Deputy\t Superintendents  of\npolice\tearlier\t than the appellants. The  Appellants  chal-\nlenged the said promotion order in a writ petition which was\ndismissed  by  the High Court by a non-speaking\t order.\t Ag-\ngrieved, the appellants filed the appeal by special leave to\nthis Court.\nDisposing of the appeal, this Court,\n    HELD: 1. The order dismissing the writ petition must  be\na  speaking  one in order to enable the person\taffected  to\nknow what were the reasons which weighed with the High Court\nin  dismissing it. The High Court should not pass a  laconic\norder. [860G]\n    2. In the instant case, in the order of promotion  there\nwas not a single whisper why the said out of turn  promotion\nwas given. [860E]\n    3.\tThe order of the High Court is fit to be set  aside,\nand  the  case be sent back on remand to the High  Court  to\nhear  the writ petition after giving an opportunity  to\t the\nparties\t and recording a reasoned speaking order on  merits.\n[861A]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>    CIVIL  APPELLATE JURISDICTION: Civil Appeal No. 3471  of<br \/>\n1991.\n<\/p>\n<p>    From  the Judgment and Order dated 14.9.1990 Punjab\t and<br \/>\nHaryana High Court in C.W.P. No. 12328 of 1990.\n<\/p>\n<p><span class=\"hidden_text\">860<\/span><\/p>\n<p>G.K. Bansal for the Appellants.\n<\/p>\n<p>    K.C.  Bajaj, Ms. Kusum Chaudhary and Y.K. Jain  for\t the<br \/>\nRespondent.\n<\/p>\n<p>The following Order of the Court was delivered:<br \/>\nSpecial leave granted.\n<\/p>\n<p>    We\thave heard learned counsel for both the parties\t and<br \/>\nalso  considered the order passed by the High Court.  Admit-<br \/>\ntedly,\tthese two appellants were appointed much earlier  to<br \/>\nthe  appointment of respondent Nos. 3 and 4 in the  post  of<br \/>\nAssistant  Sub-Inspector of Police. Their appointment  being<br \/>\non 30.3.71 and 24.4.71 whereas the appointment of respondent<br \/>\nNos. 3 and 4 were on 18.2.83. They were promoted in 1983  as<br \/>\nAssistant  Sub-Inspectors  of Police. On  1.1.89  respondent<br \/>\nNos.  3\t and 4 and appellant Nos.1 and 2  were\tpromoted  as<br \/>\nInspectors  of\tPolice\tand a composite\t Seniority  List  of<br \/>\nappellants,  respondent\t Nos. 3 and 4  and  other  similarly<br \/>\nappointed  persons was issued by respondent No. 1  in  which<br \/>\nappellant No- 1 was shown at serial No. 33, appellant No.  2<br \/>\nat  serial  No. 34 and the respondent Nos. 3 and 4  were  at<br \/>\nserial numbers 46 and 47 respectively. On 16.10.89 by  order<br \/>\nof  respondent Nos. 1 and 2, State of Haryana  and  Director<br \/>\nGeneral of Police respondent No. 3 was promoted out of\tturn<br \/>\nas  Deputy Superintendent of Police. On 23.10.89  respondent<br \/>\nNo.  4 was promoted as Deputy Superintendent of Police,\t out<br \/>\nof turn. It is rather curious that not a single whisper\t was<br \/>\nthere  in the order of promotion why the said, out of  turn,<br \/>\npromotion was given. It was tried to be contended by learned<br \/>\ncounsels  on behalf of respondent Nos. 3 and 4 that  because<br \/>\nof  their  gallantry this out of turn promotion\t was  given.<br \/>\nHowever,  there\t is  no whisper about this  in\tthe  letters<br \/>\ngiving\tpromotion. The appellants, on the other\t hand,\twere<br \/>\npromoted as Deputy Superintendents of Police as on  11.1.90.<br \/>\nWhile  filing the Writ Petition before the High\t Court,\t the<br \/>\nappellants stated that they came to know of this out of turn<br \/>\npromotion sometime on 3.8.90.\n<\/p>\n<p>    We\thave considered the order of the High Court.  It  is<br \/>\nreally\ta  matter of great regret that\tinspite\t of  several<br \/>\npronouncements\tof this Court that the order dismissing\t the<br \/>\nwrit  petition must be a speaking order in order  to  enable<br \/>\nthe  persons  affected to know what were the  reasons  which<br \/>\nweighed with the High Court in dismissing the writ petition.<br \/>\nThis  Court has observed several times that the\t High  Court<br \/>\nshould\tnot pass laconic order.
