Elementary Educational Officer,\n  Peravurani at Avanam &amp; Post,\n  Peravurani Taluk,\n  Thanjavur District.\t...    \t\tRespondents\n\n\nPrayer\n\n\nWrit Petition filed under Article 226 of the Constitution of India\npraying this Court to issue a Writ of Certiorari Mandamus calling for the\nrecords of the third respondent in Aathimu No.123\/A1\/2003 dated 12.12.2003 and\nto quash the same and to direct the respondents to continue to pay the incentive\nincrements with effect from October, 1995 to the petitioner.\n\n\n!For Petitioner\t\t...\t\tMr.V.Sitha Ranjandas\n\n\n^For Respondents  \t...\t\tMr.So.Paramasivam\n\t\t\t\t\tGovernment Advocate (CS)\n\n\n:ORDER\n<\/pre>\n<p>\tThis Writ Petition has been focussed to call for the records of the third<br \/>\nrespondent in Aathimu No.123\/A1\/2003 dated 12.12.2003 and to quash the same and<br \/>\nfurther to direct the respondents to continue to pay the incentive increments<br \/>\nwith effect from October, 1995 to the petitioner.\n<\/p>\n<p>\t2. Heard both sides.\n<\/p>\n<p>\t3. A re&#8217;sume&#8217; of facts which are absolutely necessary and germane for the<br \/>\ndisposal of this Writ Petition would run thus:\n<\/p>\n<p>\tThe Writ petitioner herein, presently a retired head master, who worked in<br \/>\nEducational Department under Tamil Nadu Government,  while he was in service it<br \/>\nso happened that he through Correspondence course studied B.Ed.  as well as M.A.<br \/>\nand got both the degrees.  In recognition of his acquisition of academic<br \/>\nqualification he was granted two incentive increments vide order dated<br \/>\n29.03.1993 of the Assistant Educational Officer, Peravurani, with effect from<br \/>\n16.11.1992.  However, subsequently, the Assistant Educational Officer,<br \/>\nPeravurani, vide order dated 16.10.1995 cancelled the two incentive increments<br \/>\ni.e. 4 increments ordered in his favour on the main ground that the petitioner<br \/>\ncompleted the M.A. degree course and B.Ed. Decree course during one and the same<br \/>\nperiod of time.  The petitioner preferred appeal but it was kept in cold<br \/>\nstorage.\n<\/p>\n<p>\t4. Thereupon the petitioner preferred O.A.No.865 of 1999 before the State<br \/>\nAdministrative Tribunal, Madras. The Tribunal directed the respondents to<br \/>\nconsider the appeal on merits and to pass orders within a period of ten weeks.<br \/>\nWhereupon the authority concerned  rejected by his Cryptic order dated<br \/>\n12.12.2003 that since the Writ Petitioner had did his both the aforesaid courses<br \/>\nduring the same period of time, no such increments could be given.  Challenging<br \/>\nsuch stand taken by the third respondent this Writ Petition has been filed.\n<\/p>\n<p>\t5. The point for consideration is as to whether the authorities concerned<br \/>\nwere justified in withdrawing the two incentives ie. four increments granted in<br \/>\nfavour of the Writ Petitioner for the reasons set out supra?\n<\/p>\n<p>\t6. The learned counsel for the Writ petitioner would submit that at the<br \/>\nfirst instance the petitioner duly applied for B.Ed. course so as to under go<br \/>\nthat course through correspondence under the Madras University Distant<br \/>\nEducation.  As he failed in one subject i.e., Psychology he completed it during<br \/>\nthe year 1992.  Even before that during August, 1989, he applied for M.A. Course<br \/>\nthrough correspondence and completed it by May 1992; the Assistant Educational<br \/>\nOfficer, Peravurani, in recognition of that passed orders dated 29.03.1993<br \/>\ngranting two incentives i.e., four increments, but it was subsequently withdrawn<br \/>\non the main ground that the petitioner was not entitled to get increments as he<br \/>\nhad completed the two academic courses during one and the same period.\n<\/p>\n<p>\t7. Drawing the attention of this Court to the communication dated<br \/>\n28.10.2002 sent by the Director, Institute of Correspondence Education,<br \/>\nUniversity of Madras, to the District Elementary Educational Officer, Thanjavur,<br \/>\nthe learned counsel for the petitioner would develop his arguments to the effect<br \/>\nthat as per the said communication there is no express embargo in undergoing two<br \/>\ncourses simultaneously even though by way of convention it is not entertained.<br \/>\nAn excerpt from the communication of the said Director is extracted hereunder<br \/>\nfor ready reference:\n<\/p>\n<p>\t&#8220;With reference to your letters cited, I am to inform you that there is no<br \/>\nspecific ruling in the laws of this University preventing the students from<br \/>\nundergoing two courses simultaneously.  However, it is only a convention not to<br \/>\npermit students to undergo for two different courses simultaneously in the<br \/>\nInstitute of Correspondence Education where the requirement of required<br \/>\nattendance is not required.&#8221;\n<\/p>\n<p>\t\t\t(emphasis supplied)<\/p>\n<p>\t8. It is therefore clear that the petitioner has not committed any<br \/>\nillegality or fraud.  In fact he showed academic interest and enthusiasm in<br \/>\nstudying two courses. No doubt Courts should discourage fraudulent acts as well<br \/>\nas misconducts on the part of the Government Servants.  But in this case the<br \/>\nGovernment Servant completed the two degree courses showing enthusiasm, and that<br \/>\nmight have certainly helped him to perform his function as headmaster,<br \/>\nefficiently.  In such a case, the Department could have taken a lenient view.  I<br \/>\ncould see no illegality or fraud involved in the act of the Writ Petitioner.\n<\/p>\n<p>\t9. In such a case this Court could elucidate the misery of the Writ<br \/>\nPetitioner and accordingly quashed the order of the third respondent in Aathimu<br \/>\nNo.123\/A1\/2003 dated 12.12.2003 and the Writ Petition is allowed.  The<br \/>\nconsequential arrears of pay shall be paid to the petitioner within three months<br \/>\nfrom the date of receipt of a copy of this order. The connected W.P.M.P.(MD)<br \/>\nNo.10743 of 2005 is closed.
