M. SAHAI)<\/p>\n<p>1.\tWe have<br \/>\nheard learned Assistant Government Pleader Mr. N.J. Shah for the<br \/>\nappellants. Though the board has been revised, learned counsel for<br \/>\nthe respondents Mr. B.S. Brahmbhatt is not present either in the<br \/>\nfirst call or in the second call.\n<\/p>\n<p>2.\tThis<br \/>\nintra court Letters Patent Appeal has been filed challenging<br \/>\njudgment and order dated 19.11.2007 passed by learned Single Judge in<br \/>\nSpecial Civil Application No.11067 of 2003. While allowing the writ<br \/>\npetition, in para 12, the following directions were issued by the<br \/>\nCourt.\n<\/p>\n<p>&#8220;12.\tIn<br \/>\n\tview of the aforesaid, this petition deserves to be \tallowed with<br \/>\n\tfollowing directions.\n<\/p>\n<p>\t\t\tThe<br \/>\n\t\t\trespondents are hereby directed to consider the petitioners&#8217; case<br \/>\n\t\t\teither for upgradation to the post of Driver or consider them for<br \/>\n\t\t\taccording benefits of higher grade pay scale admissible to the<br \/>\n\t\t\tpost of Driver in accordance with the provisions of Government<br \/>\n\t\t\tResolution dated 16.8.1994. The respondents are at liberty to<br \/>\n\t\t\teither upgrade the post of Peon-cum-Driver in case of the<br \/>\n\t\t\tpetitioners to that of Driver or accord the petitioners the<br \/>\n\t\t\tbenefit of higher grade pay scale in accordance with Government<br \/>\n\t\t\tResolution dated 16.8.1994. The entire exercise of considering and<br \/>\n\t\t\taccording appropriate pay scale and paying arrears to be completed<br \/>\n\t\t\twithin three months from the date of receipt of the order.&#8221;\n<\/p>\n<p>3.\tLearned<br \/>\nAssistant Government Pleader has urged that two directions were<br \/>\nissued by the learned Single Judge and the benefit of higher grade<br \/>\npay scale admissible to the respondents has been granted pursuant to<br \/>\nGovernment Resolution dated 16.8.1994 after completion of 9 years of<br \/>\nservice. Therefore, out of two directions given by the Court, one has<br \/>\nbeen complied. The Court has clearly  stated that either the post has<br \/>\nto be upgraded or benefit of higher pay scale in pursuance of<br \/>\nGovernment Resolution dated 16.8.1994 has to be granted. The<br \/>\nappellants were required to comply one of the aforesaid two<br \/>\ndirections. Since the appellants have complied the direction for<br \/>\ngiving higher pay scale after completion of 9 years service in<br \/>\npursuance of Government Resolution dated 16.8.1994, misapprehension<br \/>\nof the appellants that they have also to comply with the direction of<br \/>\nup-gradation to the post of Driver is misconceived.\n<\/p>\n<p>4.\tIn the<br \/>\nresult, the Appeal is devoid of any merit and is accordingly<br \/>\ndismissed.
