Justice P.N.RAVINDRAN\n\n Dated :09\/06\/2009\n\n O R D E R\n                            P.N.RAVINDRAN, J.\n                       -------------------------------------\n                        W.P.(C)No.15796 of 2009\n                       --------------------------------------\n                            Dated 9th June, 2009\n\n                                 JUDGMENT\n<\/pre>\n<p>            Heard Sri.P.Sanjay, the learned counsel appearing for the<\/p>\n<p>petitioner and Smt.Anu Sivaraman, the learned Senior Government<\/p>\n<p>Pleader appearing for the official respondents.<\/p>\n<p>            2. The petitioner who is presently working as Personal<\/p>\n<p>Assistant in the office of the District Educational Officer, Ernakulam has<\/p>\n<p>filed this writ petition challenging Ext.P2 order dated 5.6.2009 passed<\/p>\n<p>by the Director of Public Instruction transferring and posting her as<\/p>\n<p>Personal Assistant to the District Educational Officer, Chavakkad. The<\/p>\n<p>petitioner contends that she was posted at Ernakulam only by Ext.P1<\/p>\n<p>order dated 28.2.2009 and that her transfer to Chavakkad within three<\/p>\n<p>months thereafter, is not in the exigencies of service or for<\/p>\n<p>administrative reasons. She contends that the order of transfer has<\/p>\n<p>been passed at the behest of vested interests.\n<\/p>\n<p>            3. The learned Government Pleader appearing for the<\/p>\n<p>respondents submitted on instructions that there were complaints that<\/p>\n<p>the petitioner was irregular in attending office and was not attending<\/p>\n<p>to her duties. It is also stated that the Deputy Director of Education,<\/p>\n<p>Ernakulam conducted a surprise visit on 6.6.2009 and that after such<\/p>\n<p><span class=\"hidden_text\">WP(C).No.15796\/2009                 2<\/span><\/p>\n<p>surprise inspection the Deputy Director reported that the petitioner is<\/p>\n<p>lethargic in attending to her duties. The learned Government Pleader<\/p>\n<p>also submitted that it was in view of the complaints received from<\/p>\n<p>various persons that the petitioner was transferred out from<\/p>\n<p>Ernakulam to Chavakkad. The learned Government Pleader also made<\/p>\n<p>available to me a copy of the report submitted by the Deputy Director<\/p>\n<p>of Education, Ernakulam after the inspection conducted on 6.6.2009.<\/p>\n<p>The report reads as follows:\n<\/p>\n<blockquote><p>                &#8220;A surprise visit was conducted on 6\/6\/09 in<br \/>\n         the    District  Educational     Office,  Ernakulam.<br \/>\n         Smt.C.A.Kanjana was holding additional charge of<br \/>\n         the District Educational Officer, Ernakulam from<br \/>\n         April 2009 onwards. She joined duty in the District<br \/>\n         Educational Office as Personal Assistant to the<br \/>\n         District Educational Officer Ernakulam on 7\/3\/09.\n<\/p><\/blockquote>\n<blockquote><p>                It is noted at the time of visit that she is<br \/>\n         irregular in attending office and at the same time<br \/>\n         more than 200 files relating to aided school matters<br \/>\n         and other matters of urgency are kept pending with<br \/>\n         her from the date on which she assumed charge.<\/p><\/blockquote>\n<blockquote><p>         Majority of the files pertain to approval of<br \/>\n         appointments     of  aided   school    teachers,  non<br \/>\n         teaching staff and grade fixation to teachers. Her<br \/>\n         lethargic attitude in attending to the files evoked<br \/>\n         wide    spread   complaint   and    allegations  from<br \/>\n         different corners.   The inordinate delay in taking<br \/>\n         timely   action   on    the  files   kept   idle with<br \/>\n         Smt.C.A.Kanjana point to dereliction of duty and<br \/>\n         administrative inefficiency on her part.       Such a<br \/>\n         situation   has   totally   disrupted   the    smooth<br \/>\n         functioning of the office of the District Educational<br \/>\n         Office Ernakulam.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">WP(C).No.15796\/2009                 3<\/span><\/p>\n<blockquote><p>                The Aided school staff members had to wait<br \/>\n         for an indefinite period to get their legitimate claims<br \/>\n         sanctioned.    More over the monthly salary bill of<br \/>\n         aided school staff got unduly delayed due to the<br \/>\n         irregular attendance of Smt.C.A.Kanjana who is the<br \/>\n         counter     signing   authority   of    aided   school<br \/>\n         establishment bill. Thus the apathy and inefficiency<br \/>\n         has resulted in undue delay in getting the claims of<br \/>\n         teaching and non teaching staff of aided school.<br \/>\n         Such an attitude is most unbecoming of a<br \/>\n         responsible officer like Smt.C.A.Kanjana who is<br \/>\n         expected to perform her duties with utmost care<br \/>\n         and diligence.<\/p><\/blockquote>\n<blockquote><p>                In this circumstance it is recommended that<br \/>\n         stringent     action   may     be     taken    against<br \/>\n         Smt.C.A.Kanjana Personal Assistant who is now<br \/>\n         holding the full additional charge of District<br \/>\n         Educational Officer, Ernakulam for dereliction of<br \/>\n         duty, irregularity and administrative inefficiency.&#8221;<\/p><\/blockquote>\n<p>            4. It is evident from the report submitted by the Deputy<\/p>\n<p>Director of Education, Ernakulam that the petitioner has not been<\/p>\n<p>attending to her duties and that she was lethargic in disposing of files.<\/p>\n<p>The visit report submitted by the Deputy Director of Education reveals<\/p>\n<p>a very sorry state of affairs.      In such circumstances, I am not<\/p>\n<p>persuaded to agree with the learned counsel for the petitioner that the<\/p>\n<p>petitioner&#8217;s transfer was at the behest of vested interests. A learned<\/p>\n<p>single Judge of this Court has in <a href=\"\/doc\/1357948\/\">Ramachandran Nair v. Director of<\/p>\n<p>Training (ILR<\/a> 1992(3) Ker. 149) held that a transfer intended to<\/p>\n<p>ensure efficiency in administration and maintenance of discipline in an<\/p>\n<p>establishment cannot be termed as arbitrary or discriminatory. In my<\/p>\n<p><span class=\"hidden_text\">WP(C).No.15796\/2009                4<\/span><\/p>\n<p>opinion, on the facts disclosed in the report submitted by the Deputy<\/p>\n<p>Director of Education, Ernakulam after the inspection conducted on<\/p>\n<p>6.6.2009, it cannot be stated that the petitioner&#8217;s transfer from<\/p>\n<p>Ernakulam was not in the exigencies of service or for administrative<\/p>\n<p>reasons. The challenge to Ext.P2 cannot therefore be entertained.<\/p>\n<p>            5. The learned counsel for the petitioner however submits<\/p>\n<p>that seeking a transfer and posting to a station other than Ernakulam<\/p>\n<p>the petitioner has filed Ext.P4 representation before the Secretary to<\/p>\n<p>Government, General Education Department. The learned counsel for<\/p>\n<p>the petitioner also submits that notwithstanding the view taken by this<\/p>\n<p>Court, the Secretary to Government, General Education Department<\/p>\n<p>may be directed to consider Ext.P4 representation and pass orders<\/p>\n<p>thereon within a time limit to be fixed by this Court.     The learned<\/p>\n<p>Government Pleader appearing for the respondents submits that the<\/p>\n<p>Secretary to Government, General Education Department will consider<\/p>\n<p>the request made by the petitioner in Ext.P4 representation and take<\/p>\n<p>decision thereon. I accordingly direct that notwithstanding the view<\/p>\n<p>taken by me that the writ petition is liable to be dismissed,      the<\/p>\n<p>Secretary to Government, General Education Department shall<\/p>\n<p>consider the request made by the petitioner in Ext.P4 representation<\/p>\n<p>dated 8.6.2009 and pass orders thereon expeditiously and in any<\/p>\n<p><span class=\"hidden_text\">WP(C).No.15796\/2009                 5<\/span><\/p>\n<p>event within six weeks from the date on which the petitioner produces<\/p>\n<p>a certified copy of this judgment along with a copy of the writ petition.<\/p>\n<p>             The writ petition is dismissed subject to the above<\/p>\n<p>observation.\n<\/p>\n<\/p>\n<p>                                                 P.N.RAVINDRAN<br \/>\n                                                        Judge<\/p>\n<p>TKS<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court C.Kanchana vs Secretary on 9 June, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 15796 of 2009(T) 1.
