Justice R.BASANT\n\n Dated :24\/10\/2007\n\n O R D E R\n                                 R.BASANT, J\n                         ------------------------------------\n                          B.A.No.6419 of 2007\n                         -------------------------------------\n                Dated this the 24th day of October, 2007\n\n                                     ORDER\n<\/pre>\n<p>       Application for anticipatory bail. Petitioners are the husband and<\/p>\n<p>mother in law of the defacto complainant. The marriage took place on<\/p>\n<p>22.10.06.     Complaint has been lodged on 01.10.07.                  Matrimonial<\/p>\n<p>cruelty of the culpable variety is alleged against the petitioners. It<\/p>\n<p>was the second marriage of the defacto complainant and the first<\/p>\n<p>marriage of the petitioner. The petitioners are alleged to be guilty of<\/p>\n<p>physical and mental cruelty against the defacto complainant.                  The<\/p>\n<p>crime was registered on 1.10.07. In the crime it is alleged that on<\/p>\n<p>13.08.07, the 1st petitioner, the husband had beaten the defacto<\/p>\n<p>complainant with a log of wood and had caused a fracture.                      But<\/p>\n<p>admittedly they had subsequently resumed harmonious cohabitation.<\/p>\n<p>It is later that the present complaint has been filed on 1.10.07.<\/p>\n<p>       2.    The learned counsel for the petitioners submits that the<\/p>\n<p>allegations are totally false. The marriage was less than one year old.<\/p>\n<p>There was some strain in the matrimonial tie. Because of such strain,<\/p>\n<p>false allegations are being raised.             The petitioners may, in these<\/p>\n<p>circumstances, be granted anticipatory bail, submits the learned<\/p>\n<p>counsel for the petitioners.\n<\/p>\n<p>       3.    The learned Public Prosecutor                 opposes the application.<\/p>\n<p>The learned Public Prosecutor points out that the defacto complainant<\/p>\n<p><span class=\"hidden_text\">B.A.No.6419 of 2007                   2<\/span><\/p>\n<p>is shown to have suffered a grievous injury in the incident which took<\/p>\n<p>place on 13.08.07, though no prompt complaint was raised before the<\/p>\n<p>authorities. Notwithstanding the fact that no complaint had been filed<\/p>\n<p>and notwithstanding the fact that the spouses had resumed<\/p>\n<p>cohabitation after 13.08.07, the 1st petitioner husband may not be<\/p>\n<p>granted anticipatory bail. So far as the 2nd petitioner mother in law is<\/p>\n<p>concerned, the learned Public Prosecutor raises no objection against<\/p>\n<p>grant of anticipatory bail.\n<\/p>\n<p>       4.    I have considered all the relevant inputs. Considering the<\/p>\n<p>totality of facts and circumstances I am of the opinion that this is a fit<\/p>\n<p>case where anticipatory bail can be granted to the petitioners<\/p>\n<p>notwithstanding the allegations raised about the incident that took<\/p>\n<p>place on 13.08.07. What tilts the scales in favour of the petitioners in<\/p>\n<p>my mind is the fact that the parties thought it proper and fit to resume<\/p>\n<p>cohabitation even after the incident that took place on 13.08.07. I<\/p>\n<p>further take note of the fact that arrest and incarceration of the<\/p>\n<p>petitioners in custody is likely to mar the matrimonial tie beyond<\/p>\n<p>repair. Appropriate conditions can of course be imposed.<\/p>\n<p>       5.    In the result, the Bail Application is, allowed. The following<\/p>\n<p>directions are issued under Section 438 Cr.P.C.<\/p>\n<p>       i)    The petitioners shall appear before the learned Magistrate<\/p>\n<p>at 11 a.m on 31.10.07. They shall be enlarged on regular bail on their<\/p>\n<p><span class=\"hidden_text\">B.A.No.6419 of 2007                 3<\/span><\/p>\n<p>executing a bond for Rs.25,000\/- (Rupees Twenty Five thousand only)<\/p>\n<p>each with two solvent sureties each for the like sum to the satisfaction<\/p>\n<p>of the learned Magistrate;\n<\/p>\n<p>      ii)   The petitioners shall make themselves available for<\/p>\n<p>interrogation before the Investigating Officer between 10 a.m and 3<\/p>\n<p>p.m on 01.11.07 and 02.11.07 and thereafter between 10 a.m and 12<\/p>\n<p>noon on all Mondays and Fridays for a period of 2 months.<\/p>\n<p>Subsequently the petitioners shall make themselves available for<\/p>\n<p>interrogation before the Investigating Officer as and when directed by<\/p>\n<p>the Investigating Officer in writing to do so;\n<\/p>\n<p>      iii)  If the petitioners do not appear before the learned<\/p>\n<p>Magistrate as directed in clause (i), directions issued above shall<\/p>\n<p>thereafter stand revoked and the police shall be at liberty to arrest the<\/p>\n<p>petitioners and deal with them      in accordance with law as if those<\/p>\n<p>directions were not issued at all;\n<\/p>\n<p>      iv)   If the petitioners were arrested prior to their surrender on<\/p>\n<p>31.10.07 as directed in clause (1) above, they shall be released from<\/p>\n<p>custody on their executing a bond for Rs.25,000\/- (Rupees Twenty<\/p>\n<p>Five thousand only) without any sureties undertaking to appear before<\/p>\n<p>the learned Magistrate on 31.10.07.\n<\/p>\n<\/p>\n<p>                                                (R.BASANT, JUDGE)<br \/>\nrtr\/-\n<\/p>\n<p><span class=\"hidden_text\">B.A.No.6419 of 2007    4<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Saji vs State Of Kerala on 24 October, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 6419 of 2007() 1.
