JANG RAWANI S\/O ROJHAN RAWANI VILLAGE AND POST- ICHARI, P.S.-\n       AYER, DISTT.- BHOJPUR\n                                         -----------\n<\/pre>\n<p>2.   07.04.2011           Heard learned Counsel for the petitioner and the learned<\/p>\n<p>                  Counsel for the State as also the learned Counsel for private<\/p>\n<p>                  Respondent no.11.\n<\/p>\n<p>                          The petitioner is stated to be Chairman of Ichari Primary<\/p>\n<p>                  Agriculture Credit Society Limited (hereinafter referred to as &#8216;the<\/p>\n<p>                  PACS&#8217;). He is aggrieved by the order dated 3.4.2010 passed by the<\/p>\n<p>                  SDO Sadar, Arrah directing private Respondent no. 11 to operate PDS<\/p>\n<p>                  licence standing in the name of the PACS.\n<\/p>\n<p>                          Assailing the order learned Counsel for the petitioner submits<\/p>\n<p>                  that entire action was mala fide. A meeting of the managing committee<\/p>\n<p>                  was not to be held in the chambers of the SDO. The Block Supply<\/p>\n<p>                  officer, Koilwar had nothing to do with the licence which related to<\/p>\n<p>                  Garhani Block. The order of the SDO was therefore thoroughly without<\/p>\n<p>                  jurisdiction.\n<\/p>\n<p>                          There can be no quarrel with the very broad proposition<\/p>\n<p>                  advanced on behalf of the petitioner that the SDO was not competent to<\/p>\n<p>                  change the operator of the licence standing in the name of the PACS<\/p>\n<p>                  through its Chairman. The fact that the name of the petitioner may have<\/p>\n<p>                  been entered in the licence because he may have been the Chairman,<br \/>\n<span class=\"hidden_text\">                                                                          2<\/span><\/p>\n<p>at this stage is inconsequential. The licence was standing in the name<\/p>\n<p>of the PACS.\n<\/p>\n<p>       But, if the members of the managing committee of the PACS<\/p>\n<p>have made a request to the SDO who has then passed the impugned<\/p>\n<p>order, it cannot be said that the order of the SDO is without jurisdiction.<\/p>\n<p>If it be the request of the managing committee there arises a dispute<\/p>\n<p>between the petitioner and the members of the managing committee.<\/p>\n<p>That becomes a dispute amenable to Section 48 of the Bihar<\/p>\n<p>Cooperative Societies Act before the Registrar of the Cooperative<\/p>\n<p>Societies. Whether the resolution of the managing committee was in<\/p>\n<p>accordance with law and the bylaws of the PACS are matters to be<\/p>\n<p>more appropriately examined in an application preferred by the<\/p>\n<p>petitioner under Section 48 of the Bihar Cooperative Societies Act<\/p>\n<p>before the Registrar of the Cooperative Societies. The order of the SDO<\/p>\n<p>being founded on the request of the members of the managing<\/p>\n<p>committee and the resolution\/decision of the managing committee if not<\/p>\n<p>findiPng favour with the Registrar of Cooperative Societies on an<\/p>\n<p>application to be preferred by the petitioner, naturally the impugned<\/p>\n<p>order shall become unsustainable.\n<\/p>\n<p>       The Court is therefore not satisfied that the impugned order calls<\/p>\n<p>for any interference at this stage. If the petitioner files any such<\/p>\n<p>application before the Registrar of Cooperative Societies questioning<\/p>\n<p>the decision of the managing committee in pursuance of which the<\/p>\n<p>impugned order has been passed, it is expected that the same shall be<\/p>\n<p>disposed off expeditiously after hearing all concerned within a maximum<\/p>\n<p>period of three months positively without granting frivolous or<\/p>\n<p>unnecessary adjournment to either parties.
