Justice S.S.SATHEESACHANDRAN\n\n Dated :16\/09\/2009\n\n O R D E R\n                    S.S.SATHEESACHANDRAN, J.\n                    -----------------------------------\n                    W.P.(C).No.30350 of 2008 - K\n                     ---------------------------------\n             Dated this the 16th day of September, 2009\n\n                            J U D G M E N T\n<\/pre>\n<p>      Writ petition is filed seeking the following reliefs:<\/p>\n<p>         &#8220;i)   To call for the records leading to Ext.P10 and<\/p>\n<p>         quash the same by a writ of certiorari or any other<\/p>\n<p>         appropriate writ, direction or order.\n<\/p>\n<p>         ii)   To issue a writ of prohibition restraining the<\/p>\n<p>         Munsiff Court, Punalur from granting the prayer in<\/p>\n<p>         Ext.P8.\n<\/p>\n<p>         iii)  To stay all further proceedings in O.S.No.82 of<\/p>\n<p>         2005 before the Munsiff Court, Punalur until the<\/p>\n<p>         disposal of the writ petition.&#8221;\n<\/p>\n<p>      2.     Petitioners are the defendants in O.S.No.82 of 2005 on<\/p>\n<p>the file of the Munsiff Court, Punalur. Suit is one for fixation of<\/p>\n<p>boundary      and      the    respondents       are    the   plaintiffs.<\/p>\n<p>Petitioners\/plaintiffs applied for an advocate commissioner to<\/p>\n<p>measure out the property with reference to survey records. That<\/p>\n<p>application was objected to by the petitioners\/defendants in the<\/p>\n<p>suit.   Learned Munsiff after hearing both sides allowed the<\/p>\n<p>commission application vide Ext.P10 order.              Propriety and<\/p>\n<p>correctness of Ext.P10 order is challenged in this writ petition<\/p>\n<p>W.P.(C).No.30350 of 2008 &#8211; K<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>invoking the supervisory jurisdiction vested with this Court under<\/p>\n<p>Article 227 of the Constitution of India.\n<\/p>\n<p>      3.   I heard the counsel on both sides.\n<\/p>\n<p>      4.   Learned counsel for the petitioner submitted that<\/p>\n<p>previously the respondents\/plaintiffs had filed another suit as<\/p>\n<p>O.S.No.198 of 2005 against survey authorities in which the first<\/p>\n<p>petitioner herein was the additional third defendant, seeking a<\/p>\n<p>decree of mandatory injunction directing the survey authorities to<\/p>\n<p>measure out the properties as per a deed produced by the<\/p>\n<p>plaintiffs. That suit was dismissed by Ext.P3 judgment.          In<\/p>\n<p>Ext.P3 judgment, the learned counsel submits, a finding has been<\/p>\n<p>entered into that the third respondent, the present first petitioner<\/p>\n<p>has perfected his title by adverse possession over the property.<\/p>\n<p>That being the case, it is submitted, the present application for<\/p>\n<p>appointment of a commission at the instance of the plaintiff to<\/p>\n<p>measure out the property with reference to survey records should<\/p>\n<p>have been rejected by the court below. On the other hand, the<\/p>\n<p>learned counsel for the respondents\/plaintiffs submits that the<\/p>\n<p>previous suit was one for injunction and the dismissal of that suit<\/p>\n<p>will not way affect the right of the plaintiff to prosecute the<\/p>\n<p>W.P.(C).No.30350 of 2008 &#8211; K<\/p>\n<p><span class=\"hidden_text\">                                3<\/span><\/p>\n<p>present suit seeking the relief of fixation of boundaries over the<\/p>\n<p>plaint property. Ext.p1 is the copy of the plaint in the present<\/p>\n<p>suit. Ext.p2 is the written statement filed in the suit by the first<\/p>\n<p>defendant.   Perusing Ext.P2 written statement I find that the<\/p>\n<p>defendant has set up a counter claim the suit. It is seen, by the<\/p>\n<p>counter claim raised the first defendant sought for a decree<\/p>\n<p>declaring that he has perfected title over the property by adverse<\/p>\n<p>possession. Admittedly, issues have not been settled in the suit.<\/p>\n<p>The question emerging for consideration is whether in view of the<\/p>\n<p>dismissal of the previous suit, prosecution of the present suit is<\/p>\n<p>barred by res judicata or under any other provisions of law. on<\/p>\n<p>the facts presented, prima facie, it appears, whatever be the<\/p>\n<p>objections to the maintainability of the suit even if any issue is<\/p>\n<p>raised thereof it cannot be decided without taking evidence. So<\/p>\n<p>much so, a disposal of the suit on a preliminary issue without<\/p>\n<p>taking evidence as contemplated under Order XIV Rule 2 is not<\/p>\n<p>possible.   Then the question, what will be the effect of the<\/p>\n<p>observations made in Ext.P3 judgment rendered in the previous<\/p>\n<p>suit.  Identity of the property in both the suits is not under<\/p>\n<p>dispute.   But in a suit for injunction, possession is the main<\/p>\n<p>W.P.(C).No.30350 of 2008 &#8211; K<\/p>\n<p><span class=\"hidden_text\">                                  4<\/span><\/p>\n<p>criteria to be determined. Perusing Ext.P3 judgment, I find that<\/p>\n<p>no issue has been raised with reference to the observations made<\/p>\n<p>by the learned Munsiff that the defendant had perfected his title<\/p>\n<p>by adverse possession. So the title question was not an issue in<\/p>\n<p>the suit. Such being the position, it is futile to contend that in<\/p>\n<p>view of the observations made in Ext.P3 judgment rendered in<\/p>\n<p>previous suit a commission cannot be taken in the present suit.<\/p>\n<p>If at all the defendant has got a case that the suit is barred by<\/p>\n<p>res judicata or under any other provisions of law he has to invite<\/p>\n<p>the attention of the court to frame issues thereof and decide that<\/p>\n<p>question.
