Justice M.SASIDHARAN NAMBIAR\n\n Dated :16\/06\/2009\n\n O R D E R\n                 M.SASIDHARAN NAMBIAR, J.\n                 ====================\n                 W.P.(C) No. 15355 of 2009-R\n                 ====================\n            Dated this the 16th day of June, 2009.\n\n                             JUDGMENT\n<\/pre>\n<p>      This petition is filed under Articles 226 and 227 of Constitution<\/p>\n<p>of India for a direction to the Special Judge (CBI\/SPE)-I, Ernakulam<\/p>\n<p>not to conduct trial of C.C.No.4\/2004 in the court room contending<\/p>\n<p>that it is not convenient to accommodate all the lawyers appearing for<\/p>\n<p>accused 5 to 24 and therefore no fair trial is possible.<\/p>\n<p>      2.     As the learned Counsel appearing for the petitioner<\/p>\n<p>asserted that there is no convenience for 23 accused to appear and<\/p>\n<p>their Counsel to represent them and to take notes at the time of<\/p>\n<p>recording the evidence, a report was called for from the Registrar<\/p>\n<p>(Subordinate Judiciary). The Registrar has reported that out of the 23<\/p>\n<p>accused, only 21 accused now appear and the case as against the<\/p>\n<p>other two accused was split up. The Registrar has also reported that<\/p>\n<p>it is possible to accommodate the accused and their Counsel in the<\/p>\n<p>court room. In such circumstances, I do not find any justification to<\/p>\n<p>give a direction as sought for.
