1.\tMr.Chauhan,
\nlearned advocate for Mr.Desai, learned advocate for the respondents,
\nhas submitted that the reply affidavit was filed in the Registry on
\n22.03.2011. However, the affidavit, as claimed to have been filed by
\nthe respondents, is not available on record of the petition.\n<\/p>\n
1.2\tMr.Chauhan,
\nlearned advocate for the respondents, has submitted that on inquiry,
\nthe Registry informed that some mistake appears to have occurred as a
\nresult of which the affidavit is not placed on record of the
\npetition. Therefore, so as to facilitate the hearing, Mr.Desai,
\nlearned advocate for the respondents, has tendered photocopy of the
\naffidavit made by one Mr.K.L. Bhatt, Registrar (Incharge), Bhavnagar
\nUniversity.\n<\/p>\n
1.3\tMr.\n<\/p>\n
Shah, learned advocate for the petitioner, has, after perusing the
\nphotocopy, confirmed that the same affidavit has been served on him
\nas well.\n<\/p>\n
1.4\tMr.Desai,
\nlearned advocate for the respondents, has submitted that the
\nrespondents are bound by the averments and submissions stated in the
\naffidavit made on 17th March, 2011 by the deponent Mr.K.L.
\nBhatt, Registrar (Incharge), Bhavnagar University.\n<\/p>\n
1.5\tIn
\nview of the aforesaid, for the purpose of passing appropriate order
\nin present petition, the said affidavit is accepted on record.\n<\/p>\n
1.6\tHowever,
\nthe Registry is directed to take immediate action to trace-out the
\noriginal affidavit and place it on record of present petition.\n<\/p>\n
2.\tSo
\nfar as the grievance made by the petitioner and present petition is
\nconcerned, it appears that the respondent-University has not declared
\npetitioner’s result of the examination of M.Sc. (Part-II) Industrial
\nChemistry, for the academic year 2008-2009, though the petitioner was
\nallowed to appear in the said examination.\n<\/p>\n
2.1\tIt
\nis not in dispute between the parties that no order is passed by any
\nCourt directing or requiring the respondent-University to not to
\ndeclare the result of the petitioner’s examination.\n<\/p>\n
2.2\tActually,
\nwhat transpires from the record and submissions of the learned
\nadvocates for the contesting parties is that in view of the certain
\nproceedings which are in progress against the Principal of the
\nrespondent no.2-Institute and also the students (including the
\npetitioner) the petitioner’s result has not been declared.\n<\/p>\n
2.3\tThe
\nrespondent-University has claimed that certain students of the
\nrespondent no.2-Institute, including the petitioner, did not complete
\nthe requisite number of attendance during the academic year and that
\ntherefore, they were otherwise not eligible to take the examination,
\nhowever, according to the prima-facie view of the
\nrespondent-University, the Principal of the respondent-University in
\ncollusion with the students, as per the University’s allegation
\nmanipulated the attendance record of the students so as to show that
\nthe students had completed requisite\/minimum number of  attendance.\n<\/p>\n
3.\tMr.\n<\/p>\n
Desai, learned advocate for the respondents, has submitted that it is
\nin respect of the said incident and such allegation that the inquiry
\nagainst the Principal of the institute and certain students,
\nincluding the petitioner, is in progress and that therefore, the
\nresult has not been declared.\n<\/p>\n
3.\tMr.\n<\/p>\n
Desai, learned advocate for the respondents, has, with regard to the
\nrelief prayed for by the petitioner in present petition, however,
\nreferred to Para Nos.6 and 7 of the affidavit dated 17.03.2011 made
\nby the aforesaid deponent Mr. K. L. Bhatt. The said paragraphs of the
\nreply affidavit read thus:-\n<\/p>\n
“6.\tIt
\nis humbly submitted that the petitioners students of M.Sc. Part-II
\nIndustrial Chemistry for the academic year 2008-09. Their result was
\nwithheld pending inquiry since their attendance was short than the
\nrequired as per rules. However, subsequently, on the representations
\nof the petitioner and other students, the matter was placed before
\nthe Executive Council of Bhavnagar University and vide Resolution
\nNo.53 in the meeting of the Executive Council held on 25.11.2009 it
\nwas decided to withhold the result of 19 students and if they give an
\nundertaking in the prescribed form, the result would be declared and
\nthey were informed accordingly vide letter dated 15.12.2009. A copy
\nof the said letter dated 15.12.2009 is attached as Annexure-E on
\npage-44 of the petition by the petitioner. Inspite of this letter
\ndated 15.12.2009, the petitioner has not given undertaking in the
\nprescribed form and therefore the delay has taken place in
\npetitioner’s case.\n<\/p>\n
7.\tIt
\nis humbly submitted that till today, the petitioner has not given the
\nundertaking as stated above and therefore the result of the
\npetitioner was not declared and if the petitioner furnishes the
\nundertaking, the result of the petitioner would be declared.”\n<\/p>\n
3.1\tIn
\nlight of the said stipulation by the respondent-University, Mr.Desai,
\nlearned advocate for the respondent-University, has submitted  that
\nif the petitioner gives an undertaking prescribed by the
\nrespondent-University then the respondent-University would declare
\nthe result of the petitioner.\n<\/p>\n
4.\tMr.Shah,
\nlearned advocate for the petitioner, has stated that the petitioner
\nis ready and willing to give the undertaking as demanded by the
\nrespondent-University.  He has relied upon the order dated 29.04.2010
\npassed in Special Civil Application No.4229 of 2010 wherein after
\nhaving given undertaking the concerned students had sought to
\nwithdraw the undertaken and that therefore, the said order was
\npassed. However, in present case, the petitioner has, until now, not
\ngiven any undertaking in the prescribed form to the
\nrespondent-University. Therefore, the petitioner’s advocate has, as
\naforesaid, submitted that the petitioner is ready and willing to
\ntender the undertaken as demanded by the respondent-University.\n<\/p>\n
5.\tTherefore,
\nthe following order is passed.\n<\/p>\n
5.1\tThe
\nrespondent-University shall supply a draft of the formate of the
\nundertaking required by it to the petitioner’s students within one
\nweek from today.\n<\/p>\n
5.2\tA
\nweek thereafter, the petitioner’s students will make the undertaking
\non affidavit and submit the same to the respondent-University as
\nstipulated by Mr.Shah, learned advocate for the petitioner, at the
\ntime of hearing of present petition.\n<\/p>\n
5.3\tThe
\nrespondent-University shall also inform the petitioner student about
\nthe name and designation of the authority to whom the undertaking
\nshould be submitted after duly signing and affirming the same.\n<\/p>\n
5.4\tThe
\npetitioner student shall accordingly submit the duly made (on
\naffidavit) undertaking to the authority.\n<\/p>\n
5.5\tAfter
\nthe undertaking is tendered and it is found to be in order by the
\nofficer of the respondent-University, the respondent-University shall
\nthereafter within 10 days, declare the result of the petitioner
\nstudent’s examination  for the academic year 2008-2009 for M.Sc.
\n(Part-II), Industrial Chemistry. The result so declared shall be
\nsubject to the final decision which may be taken by the
\nrespondent-University in the inquiry which is in progress.\n<\/p>\n
5.6\tIf
\nultimately the University takes any decision in the inquiry
\nproceeding which is against the petitioner, then the result shall be
\nsubject to such decision and also subject to the petitioner’s right
\nto take appropriate action against such decision.\n<\/p>\n
6.\tWith
\nthe aforesaid clarifications, observations and directions, the
\npetition stands disposed of. Direct service is permitted.\n<\/p>\n
