Assigned the roster to hear writ petitions pertaining<br \/>\nto Para Military Forces, we are constrained to note that every<br \/>\n4th case dealt with by us pertains to a Constable or a Head<br \/>\nConstable of a Para Military Force overstaying leave or leaving<br \/>\nthe unit in a state of distress and claiming that he told the<br \/>\nCompany Havaldar Major of the reason why he was going to<br \/>\nhis village and needless to state the Company Havaldar Major<br \/>\nnot     being     the   competent   authority   to   sanction   leave,<br \/>\ndisciplinary action being taken against these Constables and<br \/>\nHead Constables for the misdemeanour of unauthorized<br \/>\n<span class=\"hidden_text\">W.P.(C) No.2610\/2010                                       Page 1 of 6<\/span><br \/>\n absence.      Invariably, penalty imposed is of removal or<br \/>\ndismissal from service or one of compulsory retirement.\n<\/p>\n<p>2.           These cases have a cry for justice on the part of<br \/>\nthe petitioners who render a tale of woes with reference to the<br \/>\nsocial conditions in their village. We highlight that each and<br \/>\nevery case dealt with by us in this category pertains to a<br \/>\nConstable or a Head Constbale from a rural area.\n<\/p>\n<p>3.          On the other hand is the call of discipline raised by<br \/>\na Para Military Force. We are told that the command structure<br \/>\nwould be adversely affected if jawans are allowed to decide for<br \/>\nthemselves as to when should they avail leave.\n<\/p>\n<p>4.          It is next to impossible to find a legal norm on which<br \/>\nthese cases can be decided with precisions or with previous<br \/>\ncases being used as precedents.\n<\/p>\n<p>5.          Each case has its own story to tell and whatever we<br \/>\ncan find with reference to past precedents is that, on case to<br \/>\ncase basis, Hon&#8217;ble Judges of this Court and other High Courts<br \/>\nas also the Supreme Court have tried to blend compassion and<br \/>\njustice with discipline.\n<\/p>\n<p>6.          Having joined as a Constable with CRPF, petitioner<br \/>\navailed leave from 26.02.2008 till 11.3.2008. He rejoined duty<br \/>\non 12.3.2008 but left the unit on 17.3.2008. He claims that he<br \/>\nverbally informed the Company Havaldar Major a fact denied<br \/>\nby the respondents, who additionally claim that the Company<br \/>\nHavaldar Major was not the competent officer to whom leave<br \/>\napplication could be made.      In any case, respondents state<br \/>\nthat the petitioner never claims to have submitted any written<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.2610\/2010                                    Page 2 of 6<\/span><br \/>\n application seeking leave. He claims that he verbally informed<br \/>\nthe Company Havaldar Major.\n<\/p>\n<p>7.           Be that as it may, petitioner joined back on<br \/>\n16.4.2008 and in the meanwhile a charge sheet had been<br \/>\ndrawn up on 26.3.2008, which was served upon the petitioner<br \/>\non 17.4.2008 i.e. the day next to his joining back.\n<\/p>\n<p>8.           It be noted that the petitioner remained absent for<br \/>\n30 days.\n<\/p>\n<p>9.           Unfortunately, for the petitioner, before the Inquiry<br \/>\nOfficer, he gave no proof to justify his remaining absent, save<br \/>\nand except his verbal statement that he did so on account of<br \/>\nhis wife having medical problems post caesarean operation;<br \/>\nfor which he had already availed leave from 26.2.2008 till<br \/>\n11.3.2008.\n<\/p>\n<p>10.          The Inquiry Officer indicted the petitioner and<br \/>\naccepting the report of the Inquiry Officer the Disciplinary<br \/>\nAuthority levied the penalty of removal from service vide order<br \/>\ndated 28.1.2009.\n<\/p>\n<p>11.          The Disciplinary Authority took the view that the<br \/>\npetitioner   had       shown   cowardice   inasmuch   as   the    unit<br \/>\nconcerned was to move to Chattisgarh, a Maoist affected area<br \/>\non 18.3.2008, and opined that this was the probable reason for<br \/>\nthe petitioner to abscond on 17.3.2008.\n<\/p>\n<p>12.          Appeal filed by the petitioner was rejected vide<br \/>\nAppellate Order dated 21.5.2009.           Revision filed has been<br \/>\nturned down vide revisional order dated 8.10.2009.\n<\/p>\n<p>13.          That the wife of the petitioner had a caesarean<br \/>\noperation is not in dispute. That a second female child was<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.2610\/2010                                       Page 3 of 6<\/span><br \/>\n born to the petitioner is also not in dispute. That the child was<br \/>\nborn during period when petitioner was sanctioned leave is<br \/>\nalso not in dispute.\n<\/p>\n<p>14.         The petitioner who is personally present in Court<br \/>\ninforms us that he had to rush to his village inasmuch as the<br \/>\nbirth of a second female child was not to the liking of his<br \/>\nparents and his wife who had undergone a caesarean<br \/>\noperation was mentally disturbed and this was adversely<br \/>\naffecting her health. On the one hand he had the call of his<br \/>\nduty. On the other hand he had a commitment to his ailing<br \/>\nwife and the newly born female child.\n<\/p>\n<p>15.         No doubt, the petitioner is in default, but we feel<br \/>\nthat the authorities have unnecessarily read into the conduct<br \/>\nof the petitioner, an act of cowardice.\n<\/p>\n<p>16.         It is not in dispute that after he was employed as a<br \/>\nConstable on 15.9.2001, petitioner has served in various parts<br \/>\nof India, including the troubled State of Tripura. It is apparent<br \/>\nthat the petitioner is not a coward.\n<\/p>\n<p>17.         In a somewhat similar situation, pertaining to a<br \/>\nConstable in CRPF who left for his hometown without<br \/>\nsanctioned leave; on account of the medical sickness of his<br \/>\nmother, in the decision dated 29.4.2008 W.P.(C) 1917\/2000<br \/>\nConst.P.Rajan Vs. UOI, a Division Bench of this Court set aside<br \/>\nthe penalty order and directed the Revisional Authority to<br \/>\nreconsider the matter and impose an appropriate penalty. In<br \/>\nsaid case order passed was of dismissal from service.\n<\/p>\n<p>18.         Pertaining to a Constable in the Provincial Armed<br \/>\nConstabulary (UP), in the decision reported as 2010 (2) SCC<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.2610\/2010                                    Page 4 of 6<\/span><br \/>\n 236 State of UP &amp; Ors. Vs. Ram Daras Yadav, the Supreme<br \/>\nCourt held that notwithstanding discipline being the backbone<br \/>\nof the police force requiring highest degree of discipline to be<br \/>\nmaintained for the smooth functioning of a police force, justice<br \/>\nhad to be tempered with said requirement. For an act of using<br \/>\nabusive language against his companion while on security<br \/>\nduty and adopting threatening postures with a rifle against<br \/>\nanother companion; the threatening posture being akin to a<br \/>\nprepatory act to eliminate the companion, the Supreme Court<br \/>\nset aside the penalty of dismissal from service and substituted<br \/>\nthat same to one of withholding two increments.                 The<br \/>\nrespondent therein was reinstated in service with only 50%<br \/>\nback wages paid. It was held that the penalty was squarely<br \/>\ndisproportionate.\n<\/p>\n<p>19.         We dispose of the writ petition quashing the<br \/>\nrevisional order dated 8.10.2009 and remit the revision<br \/>\npetition filed by the petitioner before the Revisional Authority<br \/>\nrequiring the Revisional Authority to pass a fresh order levying<br \/>\nan appropriate penalty upon the petitioner, which would not be<br \/>\nof a kind where the petitioner loses his job.        The petitioner<br \/>\nwould be reinstated in service and an appropriate penalty<br \/>\nwould be levied.       For the period post 28.1.2009 till he is<br \/>\nreinstated, and for which we fix the time limit as 6 weeks from<br \/>\ntoday, no wages would be paid to the petitioner.         However,<br \/>\nsaid period would be reckoned in service for all other<br \/>\npurposes.\n<\/p>\n<p>20.         The penalty levied upon the petitioner would be of<br \/>\na kind where the petitioner does not lose his job.\n<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.2610\/2010                                     Page 5 of 6<\/span><\/p>\n<p> 21.
