She was an<\/p>\n<p>applicant for the post of Junior Public Health Nurse Grade II in<\/p>\n<p>the Department of Health Services,        when applications were<\/p>\n<p>invited for the same by the Public Service Commission (for short<\/p>\n<p>&#8220;PSC&#8221;) by Ext.P2 notification. She participated in the written<\/p>\n<p>test and in the short list published by the PSC, she was included<\/p>\n<p>in the supplementary list for O.B.C. But, later, it was found by<\/p>\n<p>the   PSC that she did not have registration      with the Kerala<\/p>\n<p>Nurses and Midwives Council on 17.10.2007, the last date fixed<\/p>\n<p>for receipt of applications as per Ext.P2. Therefore, she was<\/p>\n<p>held to be not qualified and was not included in Ext.P8 rank-list<\/p>\n<p>published by the PSC for the said post.          Challenging non-<\/p>\n<p>inclusion of her name in Ext.P8 and seeking consequential<\/p>\n<p>reliefs, the Writ Petition was filed.\n<\/p>\n<p>      2. It is common ground that one of the qualifications<\/p>\n<p>WA No.2730\/2009\n<\/p>\n<p>                               &#8211; 2 &#8211;\n<\/p>\n<p>prescribed for the post is registration with the Kerala Nurses and<\/p>\n<p>Midwives Council.       It is also common ground that on<\/p>\n<p>17.10.2007, she did not have registration with the said Council.<\/p>\n<p>As evident from Ext.P7, she was qualified to practice, as she<\/p>\n<p>was having registration in Rajasthan from 23.3.1994. She<\/p>\n<p>submitted an application for registration with the Kerala Council<\/p>\n<p>on 26.12.2006. The application was finally allowed, as evident<\/p>\n<p>from Exts.P5 and P7, on 31.12.2007. So, it is not in dispute that<\/p>\n<p>the appellant did not have registration with the Kerala Nurses<\/p>\n<p>and Midwives Council on the last date              for receipt of<\/p>\n<p>applications. A candidate, who does not have the prescribed<\/p>\n<p>qualification as per the Special Rules on the last date for receipt<\/p>\n<p>of applications, is ineligible to apply for the post.     It is the<\/p>\n<p>settled position in law and it is the stand taken by the PSC.<\/p>\n<p>Clause 19 of the General Conditions of Ext.P2 notification also<\/p>\n<p>contains this stipulation. Further, it is a well-settled position in<\/p>\n<p>law that the relevant date for determining the qualification of<\/p>\n<p>the applicant is the last date for receipt of applications, unless<\/p>\n<p>otherwise specified. In view of the above facts, we find nothing<\/p>\n<p>WA No.2730\/2009\n<\/p>\n<p>                               &#8211; 3 &#8211;\n<\/p>\n<p>wrong with the stand of the PSC. It is bound by the provisions<\/p>\n<p>of the Special Rules. It has got no power or authority to ignore<\/p>\n<p>or relax the provisions of the rules. The State Government also<\/p>\n<p>supports the said stand.\n<\/p>\n<p>      3. But, the learned counsel for the appellant submitted<\/p>\n<p>that in the case of other Departments, for the very same post<\/p>\n<p>and also for the post of Staff Nurse, the Registration Certificate<\/p>\n<p>issued by the Kerala Council need be produced        only before<\/p>\n<p>joining service. In other words, the applicants need not have<\/p>\n<p>Kerala Registration on the last date for receipt of applications.<\/p>\n<p>When such a benefit is granted to similarly placed candidates<\/p>\n<p>who apply for appointment in the same or other Departments,<\/p>\n<p>there is no reason why the said benefit should not be extended<\/p>\n<p>to the candidates who apply for the post of Junior Public Health<\/p>\n<p>Nurse Grade II in the Health Services Department. But, we find<\/p>\n<p>that the appellant has not challenged the above stipulation<\/p>\n<p>contained in the Special Rules. In the absence of any challenge<\/p>\n<p>to the said stipulation in the Special Rules, the appellant, the<\/p>\n<p>State and the PSC are bound by the sane.\n<\/p>\n<p>WA No.2730\/2009\n<\/p>\n<p>                              &#8211; 4 &#8211;\n<\/p>\n<p>    4. But, the learned counsel for the appellant submitted<\/p>\n<p>that she has canvassed the invalidity of the rules in Grounds F<\/p>\n<p>and G in the appeal memorandum. Those grounds are quoted<\/p>\n<p>below for convenient reference:\n<\/p>\n<blockquote><p>           &#8220;F. If at all it was found that the qualification<\/p>\n<p>    viz. Registration with the Council in Kerala was<\/p>\n<p>    mandatory as on the date of application, as per the<\/p>\n<p>    Special Rules, the learned Single Judge ought to<\/p>\n<p>    have found that such a provision in the Special Rules<\/p>\n<p>    is illegal and arbitrary, at least in the cases of<\/p>\n<p>    persons like appellant. When registration with the<\/p>\n<p>    council is the authority to practice      as Nurse or<\/p>\n<p>    Midwife and when that authority to practice is<\/p>\n<p>    provided    to those with registration from outside,<\/p>\n<p>    pending their applications, there is no rationale in<\/p>\n<p>    insisting registration at the      time of submitting<\/p>\n<p>    application for appointment to the post. Rejection of<\/p>\n<p>    the candidature for selection and appointment as<\/p>\n<p>    JPHN Gr.II for not having the certificate, which is<\/p>\n<p>    only the authority to practice, when the candidate is<\/p>\n<p>    expected to practice only after entry in service and<\/p>\n<p>    that too when that candidate is having the authority<\/p>\n<p>    to practice as Nurse or Midwife pending decision on<\/p>\n<p>    her application by virtue of Sec.32 of the Travancore<\/p>\n<p>WA No.2730\/2009\n<\/p><\/blockquote>\n<blockquote><p>                               &#8211; 5 &#8211;\n<\/p><\/blockquote>\n<blockquote><p>     Cochin Nurses &amp; Midwives Act, even on the date of<\/p>\n<p>     her application, is highly unfair and unjust. There is<\/p>\n<p>     absolutely no reasonable nexus with the object<\/p>\n<p>     sought to be achieved in debarring such applicants<\/p>\n<p>     at a time when they are permitted to practice the<\/p>\n<p>     profession. The Special Rules to the extent it can be<\/p>\n<p>     interpreted    to mean that the qualification viz.<\/p>\n<p>     Registration with Kerala Nurses &amp; Midwives Council is<\/p>\n<p>     mandatory as on the date of application even to<\/p>\n<p>     person with registration from other States is<\/p>\n<p>     discriminatory, arbitrary and illegal.<\/p>\n<\/blockquote>\n<blockquote><p>           G.   Equals are treated unequally or unequals<\/p>\n<p>     are treated equally treating persons like appellant on<\/p>\n<p>     par with freshers who do not have any registration at<\/p>\n<p>     all, in total derogation of the fundamental rights of<\/p>\n<p>     appellant in violation of her fundamental rights under<\/p>\n<p>     Articles 14 and 16 of the Constitution of India. To<\/p>\n<p>     say that a person who can validly practice as a Nurse<\/p>\n<p>     cannot submit application for appointment to that<\/p>\n<p>     very same post is arbitrary, unreasonable and illegal.<\/p>\n<p>     No purpose is achieved by insisting such registration<\/p>\n<p>     as on date of application, except to deny opportunity<\/p>\n<p>     to candidates with outside registration.&#8221;<\/p>\n<\/blockquote>\n<p>But, we notice that a subordinate legislation can be impugned<\/p>\n<p>only on limited grounds.     A Division Bench of this Court in<\/p>\n<p>WA No.2730\/2009\n<\/p>\n<p>                                &#8211; 6 &#8211;\n<\/p>\n<p>Pankajaksy v. George Mathew [1987(2) KLT 723] had<\/p>\n<p>summarised the grounds available for impugning a subordinate<\/p>\n<p>legislation.   The relevant portion of the judgment reads as<\/p>\n<p>follows:\n<\/p>\n<blockquote><p>            &#8220;12. Thus, the rule made under a statute by an<\/p>\n<p>      authority   delegated   for    the  purpose   can    be<\/p>\n<p>      challenged on the ground (1) that it is ultra vires of<\/p>\n<p>      the Act; (2) it is opposed to the Fundamental rights;<\/p>\n<p>      (3) it is opposed to other plenary laws. To ascertain<\/p>\n<p>      whether a rule is ultra vires of the Act, the Court can<\/p>\n<p>      go into the question (a) whether it contravenes<\/p>\n<p>      expressly or impliedly any of the provisions of the<\/p>\n<p>      statute; (b) whether it achieves the intent and object<\/p>\n<p>      of the Act; and (c) whether it is &#8216;unreasonable&#8217; to be<\/p>\n<p>      manifestly arbitrary, unjust or partial implying<\/p>\n<p>      thereby want of authority to make such rules.&#8221;<\/p>\n<\/blockquote>\n<p>Going by the principles laid down in the above decision, we find<\/p>\n<p>that no ground has been made out in the above quoted<\/p>\n<p>grounds, to interfere with the rules, even assuming there was a<\/p>\n<p>prayer challenging the relevant provision of the rule.      In the<\/p>\n<p>case of some or similar posts, the Government decided, while<\/p>\n<p>framing the Special Rules, to grant relaxation for producing the<\/p>\n<p>WA No.2730\/2009\n<\/p>\n<p>                               &#8211; 7 &#8211;\n<\/p>\n<p>Registration Certificate issued by the Kerala Council till the date<\/p>\n<p>of joining duty.      In the case of the present post, the<\/p>\n<p>Government did not give any such relaxation. Such a stand<\/p>\n<p>cannot be described as without authority and therefore, ultra<\/p>\n<p>vires. The same is an area of policy where the Government<\/p>\n<p>should take the decision as the delegate of the legislature. The<\/p>\n<p>High Court, while sitting under Article 226 of the Constitution of<\/p>\n<p>India, cannot re-draft the rules according to its opinion. In this<\/p>\n<p>context, we notice the contention of the learned counsel for the<\/p>\n<p>appellant that the rules should be interpreted in such a way as<\/p>\n<p>to enable the incumbents, who apply for the post, to get time<\/p>\n<p>for obtaining the Kerala Registration till they join duty. Since<\/p>\n<p>there is no ambiguity in the rules, there is no necessity for<\/p>\n<p>interpreting the rules. As we are of the view that the said rule<\/p>\n<p>does not go against any plenary statutory provision or<\/p>\n<p>constitutional provision, there is no necessity to read it down, as<\/p>\n<p>suggested by the appellant.\n<\/p>\n<p>WA No.2730\/2009\n<\/p>\n<p>                             &#8211; 8 &#8211;\n<\/p>\n<p>    In the result, the Writ Appeal fails and it is dismissed.<\/p>\n<p>                                    K.
