DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 05\/03\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tIn<br \/>\nthis  Revision Application, the petitioner who is tried under various<br \/>\nprovisions of NDPS Act namely, Sections 22 and 29 read with section 8<br \/>\n[c] of the NDPS Act and under section 120-B of Indian Penal Code, has<br \/>\nchallenged the order dated 18.1.2010 passed by the learned<br \/>\nAddl.Principal Judge, Court No.2, Ahmedabad  rejecting  the<br \/>\napplication for discharge on the ground that the co-accused in the<br \/>\ncase  one Manoj Gohil  who  has passed away and  is no more to be<br \/>\ntried along with the petitioner and otherwise  also the co-accused&#8217;s<br \/>\nstatement has no value so far as the evidence is concerned.  It is<br \/>\nfurther submitted that  reliance was placed  by the learned Judge on<br \/>\nthe statement of the said Manoj Gohil  who is no more to be tried is<br \/>\ncontrary to law as  decided by the Hon&#8217;ble Apex Court in  various<br \/>\ndecisions.  Learned Counsel further submitted that though  it is<br \/>\nright that scope of power to be<br \/>\nexercised by the court while deciding application for discharge is<br \/>\ngoverned by a decision of the Hon&#8217;ble Apex Court (AIR 1998 SC  3257),<br \/>\nin this case,  there is no  iota of evidence so far as the conspiracy<br \/>\nis concerned and, therefore, the impugned order deserves to be<br \/>\nquashed and set aside.\n<\/p>\n<p>2.\t\tI<br \/>\nhave  also heard the learned APP Mr Shivang Shukla appearing for the<br \/>\nrespondent-State.    The learned APP, under the instructions of the<br \/>\nDRI submits that the charge is already framed after the order dated<br \/>\n18.1.2010 is passed, and there is a very limited scope for the<br \/>\nlearned Judge conducting the trial to look into the nature of<br \/>\nevidence  in light of the application of discharge made by the<br \/>\naccused.  It is submitted that it is not necessary for the learned<br \/>\nSessions Judge to   scrutinise the evidence in detail as  only  prima<br \/>\nfacie conclusion  is arrive at.  Learned APP further submits that<br \/>\nconsidering the nature and gravity of the offence for which the<br \/>\npetitioner is tried under the NDPS Act, the order passed by the<br \/>\nlearned Judge rejecting the application for discharge of the accused<br \/>\nis just and proper  and it does not require any interference by this<br \/>\ncourt in exercise of provisions under section 397 read with section<br \/>\n401 and 482 of the Code of Criminal Procedure. In support of his<br \/>\narguments, the learned APP has relied upon a decision  dated 5.4.2005<br \/>\nby this Court (Coram:  M.D. SHAH, J.) in Criminal Revision<br \/>\nApplication No.38 of 2002 wherein    the court  has allowed  the<br \/>\nRevision Application relying upon  a<br \/>\ndecision of the Hon&#8217;ble Apex Court in the case of OM<br \/>\nWATI (SMT)  AND ANOTHER  v.  STATE<br \/>\nThrough  Delhi Administration &amp;  Ors., reported in 2001 SCC<br \/>\n(Cri.) 685.  In the said decision, the Apex Court has held in<br \/>\nparagraphs 7 and 8 as under:\n<\/p>\n<p>&#8220;Now<br \/>\nno reasons are required to be recorded when the charges are framed<br \/>\nagainst the accused persons.  At the stage of passing the order in<br \/>\nterms of section 227 of the Code, the court has merely to peruse the<br \/>\nevidence in order to find out whether or not there is sufficient<br \/>\nground for proceeding against the accused. If upon consideration the<br \/>\ncourt is satisfied that a prima facie case is made out against the<br \/>\naccused, the Judge must proceed to frame charge in terms of section<br \/>\n228 of the Code.  Only in a case where it is shown that the  evidence<br \/>\nwhich the prosecution proposes to adduce to prove the guilt of the<br \/>\naccused, even if fully accepted before it is challenged in<br \/>\ncross-examination or rebutted by defence evidence cannot show that<br \/>\nthe accused committed the crime, then and then alone the court can<br \/>\ndischarge the accused.  The court is not required to enter into<br \/>\nmeticulous consideration of evidence and material placed before it at<br \/>\nthis stage.&#8221;\n<\/p>\n<p>4.\t\tHaving<br \/>\nheard the learned counsel appearing for the parties, I am of the<br \/>\nopinion that no illegality is committed by the learned Addl.Principal<br \/>\nJudge, Court No.2 while rejecting the application for discharge of<br \/>\nthe accused.  Hence after considering the fact  of the  death of the<br \/>\nco-accused, the learned trial Judge has considered certain factors<br \/>\nprima facie, namely, the reference to the truck driver- Subhash<br \/>\nSingh and also the co-accused   being tried together with the<br \/>\npetitioner and the mobile number which  revealed the contact with<br \/>\nthe present applicant-accused  and the print out pertaining to   such<br \/>\nmobile along with panchnama dated 28.7.2006 are required to be<br \/>\nconsidered  in detail at the stage of trial.\n<\/p>\n<p>5.\t\tIn<br \/>\nmy opinion, the above circumstances at the stage of discharge<br \/>\napplication considered  by the learned trial Judge cannot be said to<br \/>\nbe  in any manner contrary to the decisions  relied upon by the<br \/>\nlearned Advocate for the applicant.\n<\/p>\n<p>6.\t\tIn<br \/>\nview of the above, I do no find any substance in this application of<br \/>\nthe applicant who is involved in serious crimes for which he is to be<br \/>\ntried by the competent court of law.\n<\/p>\n<p>7.\t\tNo case is made out<br \/>\nand this petition stands disposed of accordingly.\n<\/p>\n<p>\t\t\t\t\t\t\t[ANANT<br \/>\nS.
