Aggrieved by that, the appellant--Insu.rance\n\nCompany has filed this appeal, questioning the \n\n4. In brief, the facts are; that on  \n\n9.30 p.m., when the deceased Mariajvleoses  ll\n\non his cycle on the left side of the. road, \n\nP.P.Circle, a Maruti Car bear1ng1\u00a7'o\u00bb.,cTnl; 1616_icvarne\"\"'at 'highly\n\nspeed, being driven by it,.s.._driver\" infa*rashllandvnegligent\nmanner and dashed against   a result of that,\nthe deceased  head  snccumbed to the\n\nsame. The respondientsllll.  are-the parents, brothers\n\nand sisters' of .. claimed compensation of\nRs.l0,00,000  awarded compensation of\nRs  interest at 6% per annum from the date of\n\npetition\"  of realisation. Aggrieved by that, the\n\n Company has filed this appeal,\n\n_  qnlestioning quantum.\n\n  The learned counsel for the appellant contended\n\n \"compensation awarded by the Tribunal is highly\n\ni,\/\n\n\n\nexcessive. He aiso submitted that the respondents 3 to \"6 are\n\nthe brothers and sisters of the deceased and they.:are..f_i1ot\n\ndependants and therefore, they are not entitled A =\n\ncompensation and therefore, the Tribunalwas not'j--u'sti\ufb01e:d in if\n\nawarding compensation to them. He \n\nTribunal has taken the income of deceased, -l\" l\n\nper month without any basis.  h'e.subrni\"ttetiE that the\nage of the parents shouid   seiecting the\nmultiplier and  adopting the\nmultiplier of 17.   the deceased was a\nbachelor   was not justified in\ndeducting   expenses. He, therefore.\nsubmitted,thpatllthelZiinpu\u00e9nedl judgment and award needs to\n V '''''' f  \n\n this, the Iearned counsel for the\n\nlf'i\"~i'r*espond\u00bbents'.1lZtb  submitted that, the Tribunal on proper\n\n.. :CC}flSlCle71'atl.0Ii:Of the material on record, has awarded just and\n\nreasonable compensation and therefore, it does not cal} for\n\n linterference. He also submitted that the Tribunal has rightly\n\n1,2\n\n\n\ntaken the income of the deceased at Rs.6,000\/-- per month.\n\nFurther he submitted that the Tribunal takingi\n\nconsideration that there are large number of depeiidants:';'  *\n\ndeducted 1\/3rd towards personal expenses  'pitta\n\ndoes not call for interference. He \n\nmultiplier adopted by the  proper;.,.He;\"\"there:fore,'V'V\n\nsubmitted that the impugned jupd'grnentVV\"and awards\" does not\n\ncall for interference.\n\n7. We have i V ' c.aref;tdl3f 'consitderevd  . the submissions\n\n8. The 'point'fftha.t \"t'a_1__\"ises' for our consideration is,\nwhether the Tr:Z_bunai._ hasratzwarded just and reasonable\n.CorflP\u20ac\ufb02$'Ci{iQ'\u00a7?  Z _____ \n\n   T itiis  to note, the Tribunal has awarded a\n\n of~ towards loss of dependency, taking the\n\n of..:ti;1eV deceased at Rs.6,000\/-- per month and\n\n \/3\"' towards persona} expenses and adopting the\n\nh  of '17\". The learned counsel for the appellant\n\nL\/p\n\n\n\ncontended that the Tribunal was not justified in deducting\n1\/3rd towards personal expenses as the deceased was a\n\nbachelor and the Tribunal should have deducteVda'.:.:E5()\u00b0\/in \"case--.oi'v_.a\"'--ihvache1or,TV'\n50% is deducted towards :\"persoriai=.expenses.T\"But, in the\npresent case, there are six Vddepe'n'dantsl\"-an.d'.'__therefore, the\nTribunal has dedqeted:yj'1\/Std  expenses. We\ndo not \ufb01nd any4'Ve1_V\u00a7r'orV'V'o'r  it. The Tribunal has\n\n_ ____  '\u00abi.;:::__   \"  ilkeclecewieai 15,\u00bb\nadopted mu.itiplier.iVo_Vf 1?, Theage of the fatheikwas 54 years\nat the time ofaecident._jf.The're\"is no clinching evidence on\nrecord regarding  age 'of the mother or the other\n   _  _____  gfy\ufb02te Ci\u20ac\"--9\"\"'w\u00a3;,...\n(Zjlf3p\u20aci'1(j1';';iIi$,S.:*hHO'\\P5?t3V\u20acI', we can take the age of the motherAas\n\nbetweeri.\/$6  years. The dependency of the respondents\n\n 6 \\yould..__'not\u00ab:\"have lasted long as most of them are either\n\ntheir-' \"majority or attained majority. Therefore, the\n\n vcias not justified in adopting multiplier of 17. The\n\n should have taken the age of the parents while\n\nL\/,\n\n\n\n\"me &lt;i\u20ac&#039;3\u20acG&#039;5e&amp; 1%\u00bb\nselecting the multiplier. if the age of the II10thEI}\\lS taken as\nbetween 46 to 50 years, then, the suitable multiplier  \n\nthe income of the deceased is taken at Rs.6,000\/if \nand 1\/ 3&quot;&#039; is deducted towards personaleexpaeiisels;iilthellllo\u00e9ss  nu\ndependency per month comes to land  \n\nit comes to Rs.48,000\/- and ifV&#039;11:1:i:jltiplie&#039;1 ._of \n\nthen, the compensation pvayable,toWai\u00b0dVs&#039;&lt;.1oss&#039;of&#039;-dependency\n\ncomes to Rs.s,24,o00\/- and&#039;aeeordii1g1yi:.tit.&quot;iS\u00a7Vxawarded.\n\n10. The   the Tribunal\ntowards   expenses, loss of\nestate and tnediealei just and proper and therefore,\nit does not ca.ll&quot;foi&#039;  it\n\n1 file  vvvlpppppeompensation payable comes to\n\n breakup is as fo11oWs:-\n\nr,\/\n\n\n\n(a) Towards loss of dependency Rs.6,24,000\/--\n\n(bl Towards loss of estate Rs. 4\n\n(C) Towards funeral expenses Rs.    \n\n{d} Towards transportation charges    &quot;.:,*j9&#039;_v,&#039;};&#039;E&quot;:f3V&quot;&#039;,&#039;.,.V  \n(e) Towards medical expenses   *  \n\nTOTAL    \n\n12.
